(End of addendum)

52.212-2 – Evaluation-Commercial Products and Commercial Services.

As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:

Evaluation – Commercial Products and Commercial Services. (Nov 2021)

(a) The government will award a single contract resulting from this solicitation to the responsible offeror, whose offer conforming to the solicitation, is determined to be the lowest-priced, technically acceptable (LPTA) offer. The government may award without interchanges, but reserves the right to hold interchanges if deemed necessary by the CO. The following factors shall be used to evaluate offers:

(1) Factor 1 – Technical Capability:

Subfactor 1: Past Experience Subfactor 2: Contractor Certifications Subfactor 3: Quality Control Plan

(2) Factor 2 – Price

(1) Factor 1 – Technical Capability Evaluation

Offerors will be evaluated on written documentation provided in accordance with paragraph (b)(4), Technical Capability, of the Addendum to FAR provision 52.212-1, Instructions to Offerors – Commercial Products and Commercial Services. Technical acceptability is based on successfully meeting these requirements. Each of the three (3) technical capability subfactors will be rated “Acceptable” or “Unacceptable” as follows:

Acceptable (Definition): Quote clearly meets or exceeds the minimum requirements of the solicitation.

Unacceptable (Definition): Quote does not clearly meet or exceed the minimum requirements of the solicitation.

Offerors must receive an “Acceptable” rating for each of the three (3) technical capability subfactors to receive an overall “Acceptable” rating for Factor 1 – Technical Capability. In the event one or more subfactors receive an “Unacceptable” rating, the quotation will receive an overall “Unacceptable” rating for Factor 1 – Technical Capability.

1. Subfactor 1 – Past Experience.

This subfactor is met when the offeror provides a minimum of one (1), but not more than three (3) contract references, of at least one (1) continuous year of contract performance entirely within the previous three (3) years from the issuance date of this solicitation, where the offeror (or subcontractor, teaming and/or joint venture partner being intended to perform the solicited services, or instances where the offeror performed as key personnel or a subcontractor) is/was responsible for the performance of relevant maintenance and repair services as defined in the Addendum to FAR provision 52.212-1 (b)(4) Technical Capability, Subfactor 1 – Past Experience, sub-para. (i) above. “Relevant” performance is defined as maintenance and repair services for a minimum of 30 hoists, and similar to the work identified in the PWS. If multiple contracts are needed in order to meet the minimum of the 30 hoists, this is acceptable, if maintenance and repair services were provided within a continuous twelve-month (12) period within the previous three (3) years from the issuance date of this solicitation.

2. Subfactor 2 – Contractor Certifications.

This subfactor is met when the offeror submits a copy of the certifications and proof of membership in accordance with the Addendum to FAR provision 52.212-1 (b)(4) Technical Capability, Subfactor 2 – Contractor Certifications, sub-para. (i) and (ii) and as indicated below:

a. Copies of certificates of competency for hoists/cranes (Befähigte Person für Hebezeuge/Krane) of the employees being intended to perform the solicited services upon submission of quote. The training certificates shall be obtained through an accreditation authority (for example TÜV–Technischer Überwachungsverein, DEKRA).

b. Proof of German Chamber of Commerce and Industry (Industrie- und Handelskammer) or German Chamber of Trade (Handwerkskammer) membership of contractor, subcontractor, teaming and/or joint venture partner being intended to perform the solicited services.

3. Subfactor 3 – Quality Control Plan.

This subfactor is met when the offeror submits a Quality Control Plan in accordance with the criteria defined in the Addendum to FAR provision 52.212‐1, (b)(4) Technical Capability, Subfactor 3 – Quality Control Plan.

(2) Factor 2 – Price Evaluation

The offer will be evaluated on the TOTAL price of all CLINs. Base and all option years must be quoted – no partial quotes will be accepted. Failure to include a unit price and extended amount for each CLIN, a total amount per performance period and the total proposed price within Atch 2, Bid Schedule, may exclude the offeror from further consideration for award. Price is determined by multiplying the unit price by the quantity of each CLIN. The amounts of all CLINs for all option periods represent the total proposed price. For the evaluation of the option price pursuant to FAR clause 52.217‐8, Option to Extend Services, 50% of the prices proposed for the last option period will be included in the Total Evaluated Price (TEP). The offeror's TEP will be calculated by adding the base period and all options, to include the option available under 52.217‐8. Prices shall be submitted in EURO currency only and will be evaluated in EURO currency. The TEP will be evaluated for fair and reasonableness in accordance with FAR 13.106‐3. The government reserves the right to obtain other than cost or pricing data if deemed necessary by the CO.

Arithmetic Discrepancies: For the purpose of evaluation of offers, the following will be utilized in resolving arithmetic discrepancies found on the face of the price list as submitted by the offeror.

A. Obviously misplaced decimal points will be corrected:

B. Discrepancy between unit price and extended price, the unit price will govern;

C. Apparent errors in extensions of unit prices will be corrected.

D. Apparent errors in extended amounts per CLIN will be corrected.

E. Rounding of unit price shall be limited to two (2) digits after the decimal.

The government will rely on the unit price, as proposed by the offeror, multiplied by the quantity to correct any apparent arithmetic discrepancies in the extended amount for each CLIN. The totals calculated by resolution of the arithmetic discrepancies listed above will represent the TEP. These procedures will not be used if the TEP displaces the low offeror. Interchanges with the offeror may then be conducted.

Award Process. The government intends to award to the lowest priced, technically acceptable offeror. The evaluation process is as follows:

1. The government will rank offers from lowest to highest total evaluated price.

2. Next, a technical evaluation will be performed beginning with the two (2) lowest priced offers. Evaluations will stop when two (2) offers are rated as technically acceptable for price comparison purposes. Only those offers determined to be technically acceptable, either initially or as a result of interchanges, will be considered for award.

3. A fair and reasonable determination will be made for the lowest-priced, technically acceptable offer.

4. If only one (1) offer is found to be technically acceptable, the CO will conduct a fair and reasonable determination of the offer found technically acceptable.

(b) Options. The government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the government to exercise the option(s). NOTE: Pricing for the option periods will be evaluated for use under Federal Acquisition Regulation clauses 52.217-8 and 52.217-9.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the government may accept an offer (or part of an offer), whether or not there are interchanges after its receipt, unless a written notice of withdrawal is received before award.
