MEMORANDUM FOR ALL CONTRACTORS

FROM: 374 CONS/CC

Unit 5228

APO AP 96328-5228

SUBJECT: Interim Guidance for Government of Japan Asbestos Reporting Requirements

Reference: Japan Air Pollution Control Act (APCA), Article 18-15, paragraph 6, promulgated 5 June 2020, effective 1 April 2022

1. The U.S. Government (USG) has been made aware that on April 1st, 2022, the Government of Japan (GOJ) implemented a new law that obligates local contractors to conduct identification surveys and report survey results regarding all asbestos (ACM) abatement projects to the ordinance-designated city or the responsible prefectural official. The Government of Japan currently takes the position that this obligation also applies to work associated with U.S.

operations in Japan. The law's reporting requirement appears to require U.S. Government contractors to provide relevant authorities with information concerning ACM abatement projects prior to execution, including the location of the abatement, materials being abated, and quantities to be abated.

2. This memorandum provides new interim guidance for Contractor’s compliance with the reporting instructions within Reference 1. Contractors may proceed with the identification survey as required within Reference 1. Contractors, however, shall not utilize the electronic filing procedures. Further, in accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 252.204-7000, contractors must obtain permission from the USG Contracting Officer prior to releasing identification survey information to GOJ officials. Contractors shall report the results of the identification survey to the Contracting Officer in written format in the same format in which the Contractor plans to submit the information to the appropriate GOJ official.

Construction contractors may use the material submittal process to submit the required information. The Contracting Officer will secure USG review of the submitted information. If the Contracting Officer determines that there is no sensitive information to be submitted or once the sensitive information is redacted, the Contracting Officer may grant permission for the Contractor to submit the information, in written form only, to the appropriate GOJ official.

Along with the information provided by the Contractor and approved by the USG, the Contracting Officer will include a letter stating the following:

“This information and the processes described in the enclosure are owned by the United States Government (USG) and provided to you only with the express permission of the USG. The activities described herein and all activities conducted within a US facility and area in Japan are solely within the purview of the USG under the rights and authorities granted to the USG under

Article III of the US/Japan Status of Force Agreement (SOFA) and may not be inspected, regulated or interfered with without the consent of the USG.”

3. Contractors are reminded that all USG contracts include DFARS 252.204-7000 which prohibits the dissemination of information pertaining to Government contracts without USG approval and consent. In addition to the foregoing, Contractors should not disseminate any information on USG facilities and areas that may cause a security risk.

4. If you have any questions, please contact the respective contracting officer for each project.
