1. Project Description:
1. This is a firm fixed-price, indefinite-delivery, indefinite-quantity (IDIQ) contract for Airfield and base paving work at Luke AFB, and Gila Bend AF Auxiliary Field (to include the Barry M. Goldwater Range). Each construction project will be awarded by issuing individual Task Orders (TO) against the basic contract on an as needed basis.
2. LOCATION: The project sites will be located at Luke AFB, and Gila Bend Air Force Auxiliary Field, Arizona.
a. Luke Air Force Base (LAFB) is located approximately seventeen (17) miles west-northwest of downtown Phoenix on Litchfield Road. LAFB consists of three main areas: the Main Base (Industrial Area), Medical Group/Commissary/BX, and the Housing Area. The specific project locations are indicated on drawings accompanying each task order issued against this contract.
b. Gila Bend AFAF/Barry Goldwater Ranges are located approximately 5 miles southwest of Gila Bend, Arizona, on Highway AZ-85. The specific project locations will be indicated on drawings accompanying each task order issued against this contract.
3. The work shall include providing all labor, equipment, plant, tools, transportation, and materials to perform various types of site work. The site work shall include, but is not limited to, excavation; pulverization; milling; hauling; dumping; surface preparation; grading; placing base or cement treated courses; select fill, decomposed granite, river rock; herbicide; asphaltic concrete and asphalt overlays; asphalt; concrete; sweeping; grooving or grinding pavements; surveying; quality control, testing and providing results; saw-cutting and routing; sealing of pavements; repair or replacement of existing concrete sidewalks, curb and gutter, aprons; airfield pavement slabs, joint seals and spalls; repair or replacement of airfield and base valves, catch basins; manholes; drains and culverts; trenching or excavation for installation of pipes and conduits; removal of paint and runway rubber (runway rubber removals) from airfield and base pavements by hydro-blasting; grinding; or biodegradable chemical; painting of stripes or markers on airfield and base pavements by truck mounted machine or portable push machine; Airfield paint markings shall conform to the requirements of Air Force Instructions 32-1042, STANDARDS FOR MARKING AIRFIELDS and Engineering Technical Letter (ETL) 04-02 (change 1). All work shall be accomplished in accordance with contract documents and most recent Federal and State regulations. Work is required for Luke AFB & Gila Bend AFAF, to include Barry Goldwater Ranges.
4. There is NO REQUIREMENT for the Contractor to establish and maintain a management office on Luke AFB, but if the Contractor would like to establish and maintain an on-base management office, lot space may be provided if available at the discretion of the Government. Individual jobs will vary in size from $2,000 to $10,000,000.
5. The Contractor must provide sufficient technical support and project management to assure quality and completeness of designs and drawings when applicable, accuracy of estimates; accommodate a number of concurrent "active" projects; provide flexibility of staff and subContractor pool to handle rapid increases in work volume, perform according to schedule, on time completion, process submittals in a timely manner; and present a professional demeanor and positive attitude of personnel.
6. Commencement of the contract will be within 10 days of notice to proceed and the duration will be twelve (12) months basic year period with four twelve (12) month option periods, which may be awarded at the option of the Government.
7. If the Government's requirements for services set forth in the solicitation does not result in orders totaling the amount described as "maximum" this shall not constitute the basis for an equitable price adjustment under this contract.
2. Definitions:
A. Contracting Officer: Aperson with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings.
B. Contracting Officer’s Representative: The Base Civil Engineer or his authorized representative is designated as the Contracting Officer's Representative (COR). The person fulfilling this role may also be referred to as the Construction Manager, for the purpose of technical surveillance and evaluation of the work performed under this contract. This designation in no way authorizes anyone other than the Contracting Officer to commit the Government to changes in the terms of the contract.
C. Contract Clauses: Where Special Clauses or General Provisions are referred to in the specifications, reference should be to Contract Clauses.
D. Statement of Work (SOW): Written descriptions documenting work required by each Government task order. May be provided by the Government or prepared by the Contractor, depending on the individual task order. Included in the SOW are the specific technical requirements for the project.
E. Statement of Objectives (SOO): The initial document, with drawings where applicable, provided to the Contractor by the Government outlining the work to be completed.
F. Professional Certification: The process of affixing a seal or statement to a drawing or design document to indicate that the work to which it is affixed has been performed by a person licensed as a professional, in that area of expertise, in the state of Arizona.
G. Color Board: A visual presentation consisting of samples of the various finishes, grouped together based on location within the project. Samples shall be of adequate size to show the full pattern, texture, and color of each item.
H. Designer of Record (DOR): The individual accountable for specific portions of the design documents. Where professional certification is required for the design, the DOR would be the individual providing certification for that portion of the design. Where professional certification is not required, the DOR would typically be the individual who provided the design or specifications for a particular aspect of the project (i.e.: architectural, civil, structural, mechanical or electrical).
3. Work by the Government:
a. The Government is not obligated to issue any particular type of work under this contract and reserves the right to accomplish work using government workforces or by other contracts, as the government deems necessary or desirable, and to do so will not breach or otherwise violate this contract.
b. Task order issuance procedures
a. Work under this contract will be ordered by written Task Orders issued on DD Form 1155 (Order for Supplies or Services) to the Contractor by the Contracting Officer. The individual TOs will be placed in a sequential numbering system, which relate back to the basic contract and their assigned TO number.
b. The Government will not be obligated to reimburse the Contractor for work performed, items delivered, or any costs incurred, nor shall the Contractor be obligated to perform, deliver, or otherwise incur costs except as authorized by duly executed TOs. TOs will be firm fixed price and clearly define the specific services to be performed or the performance desired. Each TO will contain applicable clauses.
4. Technical Design Support:
A. The government will only provide basic concept design information for a specific work requirements of low complexity where stamped designs are not required. The contractor, using the concept design information, as well as all governing codes and the Pavement IDIQ Specifications, will be required to complete the design and provide construction drawings for low complexity work not requiring stamped drawings. Construction drawings must be complete to a point where the drawings clearly indicate the proposed method of accomplishing the work. The Contractor is expected to use recognized industry standard practices in determining his proposed design materials and methods, unless the government specifies otherwise. For higher complexity projects, if a project requires design services and stamped drawings, the Government will provide the design to the contractor. Design-build capabilities are not required under this contract.
B. If specifically required by the Contracting Officer, on a particular Task Order, the contractor may be required to furnish documents/drawings bearing the stamp and signature of a registered architect or professional engineer. If such a need arises it will be negotiated on each task order as a non-priced item.
C. All drawings submitted by the Contractor shall be created from Computer-Aided Design and Drafting (CADD) software. Drawing files shall be compatible with AutoCAD, without any need for translation or modification by the government. AutoCAD drawings shall comply with the Tri-Service Center’s A/E/C and Spatial Data Standards. Custom menus, line types and text styles shall NOT be used without prior approval of the Contracting Officer. All external reference drawings, if used, must be provided with the basic drawing and be modifiable if required. The Contractor shall submit all CADD drawing files on a CD-ROM unless requested otherwise.
5. Performance Capabilities:
A. Throughout the life of this contract, whenever there are active TO's, the Contractor’s Project Manager (CPM) shall be available during normal business hours to meet with the Contracting Officer or his/her representative, at the location specified, within one (1) hour after notification by telephone. The CPM shall be available to meet with the CO or his/her representative within 24 hours when there are no active TO's. The CO must be able to contact the CPM at all times by dialing a local telephone number. The CPM shall provide overall contract management, including full authority to develop TO proposals, negotiate, sign award/modification paperwork, supervise individual project superintendents, provide subcontract purchasing and administration, review material submittals and shop drawings, and shall attend all weekly status meetings, site visits and final inspections. The CPM shall have a minimum of five (5) years previous experience as primary manager of Airfield pavement projects.
B. Whenever there are active TO's, Contractor personnel with the following management/technical support capabilities must be available to properly manage/superintend all TO proposals being developed and/or work under construction
1. Contractor's Project Superintendent (CPS) - Provides on-site supervision of active TO's. The CPS shall visit each active project site daily, submit detailed weekly progress reports (AF Form 3065) for each Task Order, schedule and coordinate subContractors and material suppliers, and attend all weekly status meetings, site visit, and pre-final/final inspections. The superintendent must have a minimum of five years’ experience as a superintendent, inspector, quality control manager, project manager, or construction manager of airfield and street paving projects.
OR
Must be a graduate of a four year accredited college program in one of the following disciplines: Engineering, Architecture, Construction Management, Engineering Technology or Building Science, with a minimum of two years’ experience as a superintendent, project manager, or construction manager for airfield and street construction projects.
2. Contractor's Quality System Manager (QCM) – Must have a minimum of seven years’ experience as a superintendent, inspector, quality control manager, project manager, or construction manager for airfield and street construction projects.
OR
Must be a graduate of a four year accredited college program in one of the following disciplines: Engineering, Architecture, Construction Management, Engineering Technology or Building Science, with a minimum of two years’ experience as a superintendent, inspector, quality control manager, project manager, or construction manager.
3. Contractor’s Safety Officer (CSO) - Provide safety management and enforce safety assurance. Responsible for developing and enforcing Contractor’s safety plan. The CSO ensures full compliance to the safety of the job site and workers. Contractor’s Safety Officer (CSO): The CSO shall have a minimum of three (3) years’ experience as a safety officer on paving projects and cannot be the same person as the QCM or CPS.
OR
Must be a graduate of a four year accredited college program in one of the following disciplines: Engineering, Architecture, Construction Management, Engineering Technology or , Environmental, Safety and Health discipline with a minimum of one year experience as a superintendent, inspector, quality control manager, project manager, safety officer or construction manager. The Contractor must provide contact information for all key personnel to include phone number and email address.
C. Government Approval of Personnel: The CPM, CPS, QCM, and CSO are required positions for this contract. Any change or replacement of personnel in any of these positions during the life of this contract shall meet the minimum capability requirements established within this section of the SOW, to include submission of the corresponding capabilities/experience of the replacement individual to the CO for approval within 7 Calendar Days of the Contractor knowing a replacement or change is necessary.
D. Overlapping functions of personnel: The Contractor’s Project Manager (CPM) is the only role that can perform more than one function. The CPM is allowed to function dually as the Contractor’s Safety Officer (CSO) as well as the CPM.
E. The Contractor shall also provide and maintain the following capabilities, at a local or remote office, to support the Luke’s Pavement IDIQ contract:
1. Cost estimator - Provide estimating support, capable of producing accurate quantity take-offs and cost proposals. The estimator shall have previous experience in development of detailed quantity take-off and line item cost estimates for multi-discipline Pavement IDIQ or commercial construction projects. NOTE: The estimator can be the CPM.
6. Construction Requirements:
A. All design and construction accomplished pursuant to this contract shall comply with the latest edition of the following documents unless the Contractor is directed otherwise by the Contracting Officer. Any exceptions must be approved in writing by the Contracting Officer prior to construction start-up.
1. AIR FORCE AND ARMY REGULATIONS: The latest editions of the following Air Force Regulations shall apply to this work:
MIL Handbook 1190, Facility Planning and Design Guide.
Air Force Safety and Health Standard: AFR127-12, Air Force Occupational Safety and Health Program, and applicable standards.

B. REGULATORY CODES: The latest editions of Federal, State, Industry, and local codes which govern this work include, but may not be limited to:
Federal:

Corps of Engineers Safety and Health Requirement Manual, EM385-1-1.
National Historic Preservation Act of 1966 as amended and 1980 as amended.
Executive Order 13101 – “Greening the Government through Waste Prevention, Recycling, and Federal Acquisition Resource Conservation and Recovery Act Section 6002 Manual on Uniform Traffic Control Devices (MUTCD)
C. Unified Facilities Guide Specifications (UFGS) The latest edition of the following UFGS Codes shall be used for all construction under this contract:

D. The Contractor shall maintain or have access to these documents during the term of this contract. Use this link to access the UFGS: https://www.wbdg.org/ccb/browse_cat.php?c=3 The Luke Base specifications is a general guide but the Contractor must use the UFGS for all construction projects (task orders) or MAG Standard Specifications.
E. If there is a conflict between these codes and regulations the most stringent requirements shall apply at all times.
7. Quality Control:
A. The Contractor shall submit a Quality Control Plan that clearly describes the Contractor's quality control program/process. This plan should address all aspects of quality control, including responsibility for surveillance of work by both subContractors and in-house quality control inspectors, process for acceptance, rejection, documentation and resolution of deficiencies, trend analysis, and any other areas that specifically and exclusively relates to the acceptable completion of work and subsequent government inspections and approval. The Quality Control Plan shall be approved by the Government prior to commencement of work. This Quality Control Plan shall include all phases of the construction process from material ordering through project completion. The plan should ensure that all components of construction meet industry standards. This plan will remain in effect for the life of the contract. The Contractor shall maintain adequate Quality Control capabilities regardless of the volume of workload. The Government reserves the right to request any necessary changes to the Quality Control Plan during the life of the contract. Individual Quality Control Plans will not be required for each TO.
B. The Contractor will be required to institute a comprehensive Quality Control Program in order to assure himself and the Government that all materials and workmanship are in strict accordance with the Pavement IDIQ specifications, Base Regulations, Federal, State and Local Codes. It is the Contractor's responsibility to provide, inspect, and document the level of quality that has been established by the minimum standards of the Statement of Work and the Pavement IDIQ Specifications.
C. Quality Control Manager: The Quality Control Manager shall direct the execution of the Contractor's approved Quality Control Plan with exclusive responsibility for administration of the plan and inspection of work. The Quality Control Manager shall be available during normal duty hours to investigate and resolve all problems related to Quality Control when notified by the Government Inspector and/or Contracting Officer that a problem exists. The Quality Control Manager shall be a separate individual from the Project Manager or Project Superintendent.
D. Government Inspection: When the Contractor considers that the work is acceptable to the Government and is complete to include final clean-up, he shall inform the Contracting Officer that the work is complete and ready for inspection. The Contracting Officer and his representative may inspect the work on site. In the event that the work is not acceptable, the Contractor shall record a list of items noted by the Government to be corrected. A subsequent inspection may take place in order to review the corrected items. The Government is not required to inspect all work. The Government inspection does not negate the need for regular Contractor quality control nor does it indicate either expressed or implied that all codes, safety regulations or any other criteria have been followed properly. Compliance with contract requirements remains the sole responsibility of the Contractor.
E. Government Approval of Work: The Government will notify the Contractor that work for a specific Task Order is or is not acceptable. Invoices for a specific Task Order shall not be permitted until the Government has accepted the work.
8. Provisions on Contracting Officer’s Authority:
No person other than a Contracting Officer shall have authority to modify the terms of this agreement. The Contracting Officer is the only person authorized to approve changes in any of the requirements under this agreement and not withstanding any provisions contained elsewhere in this agreement, the said authority remains solely with the Contracting Officer. The Contractor will not take direction from anyone other than the Contracting Officer. In the event the Contractor effects any such changes at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in costs incurred as a result thereof. The Contracting Officer is the only person authorized to obligate the government or make changes to the contract (other than health/life safety concerns). Any action taken in response to direction from other than the contracting officer is done so at the sole financial and legal responsibility of the Contractor.
9. Pre-Performance Conference:
Upon issuance of the first Task Order under this contract, the Contracting Officer will host a pre-performance conference. The purpose of this conference shall be to acquaint the Contractor with Government policies and procedures that are to be observed during the prosecution of this work and to develop mutual understanding relative to the administration of the contract. The Contractor and subContractors shall be represented at the scheduled conference and be prepared to discuss potential difficulties and obstacles.
10. Construction Start up Period:
Construction will start with the issuance of a project task order that will be awarded after issuance of the contract.
11. Weather Days:
A. The 56th Operations Support Squadron, Weather Operations Flight (OSW) located in Bldg. 453 (623-856-6837) publishes the historical average number of days that precipitation is expected and temperatures for each month of the year. This information is included in contract clause FAR 52.236-4, which is located in Section I of the solicitation and resultant contract. The Contractor shall consider this information when estimating Task Order performance times. The Contractor's Task Order proposals shall stipulate the number of weather days and performance days included in the total performance time. For outside work, the published average number of weather days shall be included in any negotiated performance time. Should inclement weather over and above the published average occur, the Contractor may request additional time if the work was affected.
B. Any request for additional weather days must be annotated in the remarks section of the Contractor's weekly progress report (AF Form 3065), and shall include the following information:
1. Each specific day requested.
2. Reason for each day requested, including which trades were affected
C. The Weather Operations Flight publishes a monthly weather report of actual daily temperatures and precipitation at Luke AFB. Any day when only a "trace" of precipitation was recorded will not be considered a rainy day.
12. Welding Permit:
No welding, soldering, torch cutting or open flame torch jobs will be permitted without first obtaining an AF Form 592 “Welding Permit” from the Base Fire Department. A copy of the AF Form 592 "Welding Permit" will be posted at the job site whenever torch work is in progress. All fire and safety regulations are to be stringently followed.
13. Excavation Permit (dig permit):
A. The Contractor shall apply for and obtain a properly approved and coordinated excavation permit(s) (AF Form 103) prior to any excavation. The Pavement IDIQ project manager upon request will provide the Contractor with a blank AF Form 103 which is to be filled in by the Contractor. The Contractor shall attach to the AF Form 103 drawings and/or details showing the exact location and description of the type of excavation to be accomplished. The Contractor shall insure that the location of all underground utilities, once located and marked by the government, are adequately maintained to preclude remarking by government personnel. Should any one of the coordination points indicate an additional underground utility or structure over and above those shown on the contract drawing either by sketch on the Contractor's drawing, by field pointing, or by flagging, the Contractor shall be responsible for protection of each of the items indicated. If the Contractor damages any of the items indicated, he shall be responsible for prompt repair of the damage to return the item to its original workable condition.
B. Excavations for street and existing utility will also include the following requirements unless waived by the Contracting Officer. Prior to the start of work, all valve locations will be identified/located so the utility can be shut off in the event of accidental damage. To preclude accidental damage, the Contractor shall locate the exact location of all marked utilities by hand digging at least three foot (3') on each side of the marked utility prior to any excavation with power equipment. Any utilities discovered during excavations that are not shown on the drawings or staked by the government will be marked on the contract drawings and will be identified on the Contractor's as-built drawings.
14. Pre-Final and Final Inspection:
A. The government normally will not perform a pre-final inspection of work accomplished on Task Orders. The Contractor may request a pre-final inspection for the purpose of having the government assist in identifying potential problems prior to the final inspection but the government has the right to deny the request. If the government agrees to perform a pre-final inspection, any discrepancies identified must be corrected before scheduling a final inspection, unless waived by the CO.
B. The Contractor shall submit a written request for final inspection to the Contracting Officer, with the following attachments:
1. Corrected "as-built" drawings in the format of a hard copy and CD.
2. A QC report signed by the Quality Control Manager (QCM) listing any outstanding discrepancies.
C. Any request for final inspection shall be submitted a minimum of five (5) working days prior to the desired date, unless waived by the Contracting Officer. Final inspection should be scheduled to occur prior to the specified contract completion date.
D. Final inspections will be conducted by the Contracting Officer or his authorized representative with the Civil Engineering Pavement IDIQ Project Manager, Contractor, and using agency representative. Discrepancies noted on the “punch list” will be corrected by the Contractor within the time limit specified by the Contracting Officer. If during a final inspection it is obvious to the Contracting Officer that the job site is not ready for a final, the final will be terminated and rescheduled after a minimum of a 24 hour waiting period. If the final was scheduled on the contracted date of completion and the final is terminated by the Contracting Officer, Liquidated Damages (LD's) may be assessed before another final inspection can be scheduled.
15. Warranty:
A. The Contractor shall provide a minimum one-year warranty on all work in accordance with FAR 52.246-21, Warranty of Construction. The Contractor will be notified of warranty issues by the Contracting Officer. After being notified of a problem, the Contractor must investigate the issue and respond within 24 hours. If the Contractor believes the issue is not warranty related, he may request a fact finding visit with the Contracting Officer and Pavement IDIQ Project Manager. If the fact-finding meeting determines the issue is warranty related, the Contractor must repair the item within 48 hours, or as determined by the Contracting Officer.
B. All warranty work will be performed by the Contractor to the complete satisfaction of the Contracting Officer in accordance with the applicable specifications.
C. The Contractor is responsible for ensuring subContractors fulfill warranty requirements on their work. All manufacturer warranties installed under an individual Task Order shall be submitted to the Contracting Officer with an AF Form 3000 prior to Task Order close-out.
16. Computer and Software Requirements:
The Contractor shall also install and maintain a copy of the latest version of AutoCAD (to be verified by Contracting Officer) on Contractor’s equipment for the development of construction drawings and "As-Built" drawings. In addition, if the Contractor elects to establish a Management Office on Luke AFB (upon request and approval) he/she must be able to send and receive E-Mail on the computer(s) located in this office. All drawings submitted by the Contractor shall be created from Computer-Aided Design and Drafting (CADD) software. Drawing files shall be compatible with AutoCAD, without any need for translation or modification by the government. AutoCAD drawings shall comply with the Tri-Service Center’s A/E/C and Spatial Data Standards. Custom menus, line types and text styles shall NOT be used without prior approval of the Contracting Officer. All external reference drawings, if used, must be provided with the basic drawing and be modifiable if required. The Contractor shall submit all CADD drawing files on a CD-ROM.
17. Government Furnished Equipment:
A. Government Furnished Equipment/Materials (GFE/GFM) will not be furnished to the Contractor as a general rule. However, the Government reserves the right to provide GFM and/or Government Furnished Equipment (GFE) to be used on any Task Order. If GFE and/or GFM is provided ONLY the UPB prices for labor and equipment cost will be used. The non-priced items clause will be used to price work involving GFE/GFM if and only if the UPB does not cover the work required.
B. In cases where GFE or GFM is furnished the Contractor will be required to receipt of the materials, and with his own forces, shall transport all items from the Government storage area to the work site indicated on the Task Order. The Contractor assumes the risk and responsibility for the loss or damage to Government furnished property.
C. The Contractor shall follow the instructions of the Contracting Officer's Representative regarding the disposition of all Government-furnished property not consumed in performance of a Task Order.
18. Work in Occupied Areas:
A. Delivery of materials and equipment shall be made with a minimum of interference to Government operations and personnel.
B. Any temporary construction used by the Contractor for preventing interruption of normal work activity, dust control, or loss of utilities services, etc. shall be subject to approval of the Base Civil Engineer through the Contracting Officer.
19. Coordination with Government Activities:
A. The Contractor shall adhere to the requirements of each individual user organization. Any infringement on the normal working conditions (i.e. closing a hallway) shall be coordinated with the user at least 24 hours in advance.
B. If it becomes necessary to interrupt the using agency's work activities in buildings and/or areas for construction purposes, permission to do so must be requested in writing to the Contracting Officer five (5) working days in advance. Written requests for street closings will be submitted to the Contracting Officer for approval fourteen (14) working days prior to closing of the street. The Contracting Officer shall coordinate requests with the Base Civil Engineer.
C. Work in connection with this contract which requires a temporary outages of any utility services (electrical, water, gas, Fire Detection etc.) which will close down or limit (as determined by the Contracting Officer) normal activities in the building, construction area, or other affected areas, shall be performed by the Contractor at a time other than regular work periods of the organization occupying the facility. Requests for utility outages shall be submitted in writing to the Contracting Officer for approval at least fourteen (14) working days in advance. Requests must show date the outage is required, time period for the outage, and specific utility system involved. Shut down of existing utility systems will be accomplished by government personnel IF and ONLY IF Contractor personnel are available at the time. Once a utility outage is arranged and work starts, the work must go on until the affected utility is restored and normal activities can resume. Section 48 of this SOW provides additional information and guidance respective to utility outages.
20. Noise Control:
The Contractor shall comply with all applicable state and local laws, ordinances, and regulations relative to noise control. The government may require that operations which generate excessive noise be scheduled at other than standard work hours.
21. Construction Site Maintenance:
A. When necessary the Contractor can store all supplies and equipment for each Task Order on the project site. Storage area will be determined by the Contracting Officer. Site shall be maintained in a neat and orderly manner. Fencing and visual screening will be required for outside construction sites to maintain a safe and neat appearance. Contractor shall not leave equipment or materials on site unless prior approval has been obtained from the Contracting Officer.
B. Cover equipment that is to remain in place within the area of contract operations and protect it against damage or loss. Store equipment that is removed in performance of work where directed or reuse in work as required by drawings and specifications. Equipment temporarily removed shall be protected, cleaned and replaced equal to or better than its condition prior to starting work. Security for equipment or material that is to be reused and is removed for temporary storage shall be the sole responsibility of the Contractor.
C. Each project site must be cleaned up at the end of each day. All debris (whether blown in or Contractor generated) on the job site shall be picked up and disposed of properly. All materials shall be neatly stacked and secured to prevent wind gusts from blowing materials around base. If the Contracting Officer or his authorized representative deems the project site is unsafe or unsightly the Contractor may be instructed to halt construction and clean-up the site.
D. Unless otherwise approved by the Contracting Officer, all Contractor generated waste shall be hauled from the construction site daily, to a disposal area to be selected by the Contractor located outside the physical boundaries of the installation. The Construction site shall be kept neat, orderly, and safe for workmen at all times.
E. The Contractor shall store all trash in appropriate containers on the job site. If a dumpster is to be used the location of the dumpster shall be as directed by the Pavement IDIQ Project Manager. The Contractor’s dumpster shall be removed prior to final inspection. The Contractor shall repair any damage the dumpster causes to paving or lawns.
F. If the Contractor uses trucks to remove refuse from the job site the refuse must be covered and secure prior to leaving the job site. If any materials are observed falling off the trucks, the truck shall be stopped and reloaded to prevent damage to any other vehicles caused directly/indirectly by falling debris. The Contractor shall bear the monetary responsibility to repair all damage associated with falling debris.
G. The base refuse contract supplies dumpsters for government produced refuse only. The Contractor shall not dump refuse from any Pavement IDIQ project in the government dumpsters. If the Contracting Officer discovers Pavement IDIQ refuse in government dumpsters, he may instruct the Contractor to immediately remove the refuse, or have government resources remove it at the Contractor’s expense.
H. All mud, dirt, debris, foreign objects, or spills of any kind from the Contractor's operations (including subContractors and suppliers) on streets and parking lots, used as access to the work or staging areas, shall be cleaned off the same day. Taxiways, runways, parking aprons and hard surfaces, used as access to the work or staging areas, shall be kept clean at all times.
I. Trees, Shrubs, Grass and Irrigation Systems: The Contractor shall take appropriate measures to prevent injury to plants and subsurface irrigation systems on the project site unless designated to be removed. The Contractor shall not remove or prune any plants without approval from the Contracting Officer or his designated representative. Plants and/or trees that are damaged during construction shall be replaced at no expense to the government with a 1 year warranty. Damaged shrubs or hedges shall be replaced with plants of equal size, type, and value. Any subsurface irrigation system damaged by the Contractor shall be repaired by the Contractor.
22. Contractor Parking:
Contractor vehicles and equipment will ONLY be parked in a designated area. The Contractor will not be permitted to park or run vehicles on grass areas. Only equipment required in direct performance of the work will be permitted to enter grass areas. Any damage done to lawns or shrubs will be repaired or replaced by the Contractor at no additional cost to the Government. At certain facilities/locations on Luke AFB, the Contractor may be required to load or off-load material and equipment and park elsewhere.
23. Environmental Laws and Regulations:
A. Contractor shall comply, and assure that all sub-Contractors comply, with all applicable federal, state, and local laws, regulations, ordinances, policies and standards related to environmental matters. Copies of local policies and procedures can be reviewed at the office of the Base Environmental Coordinator (BEC), Bldg. 302, phone (623)856-3621.
B. The use of materials which have been identified by Governmental agencies as being hazardous or creating potentially hazardous conditions will not be allowed on any project. Specifically, products containing lead, asbestos, polychlorinated biphenyl (PCB), and Ozone depleting chemicals are prohibited. The Contractor shall assume a strict and cautious position in responding to reports of other materials which may be identified as hazardous during construction period.
C. If any material originally specified or approved for use in the work should become listed as suspected or verified as being hazardous, the Contractor shall immediately notify the Contracting Officer and initiate efforts to postpone the installation or use of the material until the matter can be investigated.
D. Close out documents require affidavits from the general Contractor as well as each subContractor attesting to the fact that no product as prohibited for use in public facilities have been incorporated into the work.
24. Environmental Protection:
A. In performing work under this contract, the Contractor shall comply with all applicable Federal, State, Local and Air Force environmental regulations and their supplements. These regulations take precedence if they conflict with the Statement of Work.
B. The Contractor shall identify, characterize, store and dispose of any hazardous waste generated during work in strict accordance with Federal and State guidelines found in the Code of Federal Regulations.
C. Solid, Liquid, and Gaseous Contaminants: The Contractor shall be responsible for the proper disposal of all solid, liquid, and gaseous contaminants including asbestos in accordance with all applicable Federal, State, and Local codes and regulations, as described elsewhere herein.
D. Covered Chutes: All chutes for refuse, and the like, shall be covered or of such a design to fully confine the material to prevent dust dissemination.
E. Management of Liquid Wastes: The Contractor shall not dispose of any waste or residual material on the ground or in any storm sewer or drainage system. This includes but is not limited to paints, coatings, solvents, petroleum products, etc. Discharge of any material or diluted material into sanitary or industrial sewer systems shall be coordinated with the Staff Civil Engineer Environmental Coordinator through the Contracting Officer, and shall be approved by the Base Environmental Engineer (USAF CLINIC/SGPB). Waste material for disposal shall be disposed of in accordance with Federal and State waste regulations and with local base policies. If in doubt, consult with the Staff Engineering Environmental Coordinator, Luke AFB, through the Contracting Officer.
F. Hazardous Waste Disposal:
1. Hazardous Chemical and Liquid Petroleum Products Spill Prevention. The Contractor shall handle and store hazardous liquid materials in approved areas/buildings, and shall comply with the spill prevention and response requirements of Luke AFB. Copies of the Spill Prevention, Containment and Countermeasures Plan (OPLAN 19-8) will be provided to the Contractor by the Contracting Officer upon request.
2. All containers will be labeled and the Contractor will provide the Environmental Coordinator, the Fire Department, and Readiness Flight with a listing of all Extremely Hazardous Substances (as defined in 40 CFR Part 355, Appendix A), approximate volumes of petroleum based substances (i.e., lubricants, fuels, etc.) and hazardous materials as defined in 40 CFR Part 302.4. This information will be updated any time different materials are brought on base.
3. Organic Solvents: The Contractor shall limit emissions of organic solvents into the atmosphere. This rule applies to use, clean-up, and disposal of organic, photo chemically reactive and non-photo chemically reactive solvents and materials containing these solvents.
4. Architectural Coatings: The Contractor shall limit the quantity of volatile organic compounds in architectural coatings. This applies to any coatings applied to stationary structures and their appurtenances, mobile homes, pavements and curbs.
5. Hazardous material encountered by the Contractor during work: The Contractor shall notify the Contracting Officer upon encountering any material thought to be hazardous that was not generated by the Contractor during the work. The Government shall be responsible for characterization, transportation, storage and disposal of the material if it is determine to be hazardous.
G. Covered Chutes: All chutes for refuse, and the like, shall be covered or of such a design to fully confine the material to prevent the dissemination of dust.
H. Burning: burning of any type of materials will not be permitted to accomplish the work.
I. Electrical equipment containing PCB’s: It is imperative that electrical equipment containing PCB’s removed from service are properly disposed of.
J. Materials Containing Lead:
1. The Contractor or subContractor performing lead paint removal must be licensed/certified, show proof of acceptable Federal/State approved dump site and must have access to qualified crews for work with lead paint removal. Contractor must perform in strict compliance with all applicable State, Local and Federal regulations. The Contractor must provide three (3) sets, copies of documentation and invoices for removal and disposal of lead base paint to 56th CES/CECS, prior to final project inspection.
2. The Contractor shall not use paints or coatings containing lead in excess of 0.06 percent by weight of total non-volatile content in accordance with Title 16 of the Code of Federal Regulations, Part 1303. Paints or coatings within reach of children in housing, recreation, and public areas shall have zero lead content.
K. Asbestos Containing Materials:
1. The Contractor or subContractor performing asbestos removal must be licensed/certified by the State of Arizona, show proof of acceptable Federal/State approved dump site, and must have access to qualified crews for work with asbestos removal. Contractor must perform in strict compliance with all applicable State, Local, and Federal regulations. The Contractor must provide three (3) sets, copies of documentation and invoices for removal and disposal of asbestos containing materials to 56th CES/CECS, prior to final project inspection. Separate asbestos disposal sites will not be provided.
2. With respect to asbestos removal projects:
i. The Contracting Officer, in coordination with Civil Engineering and the Legal Office, reserves the right to pre-qualify any subContractors.
ii. The Contracting Officer, in coordination with Civil Engineering and the Legal Office, reserves the right to require Contractor insurance and review the policy before any work is started.
iii. The Contracting Officer, in coordination with Civil Engineering and the Legal Office, reserves the right to require a work plan and review the plan before any asbestos abatement or removal work is started.
3. The Contractor and/or sub-Contractor are prohibited from using any asbestos containing materials (ACM) on any assigned project. In the event the Contractor encounters previously unidentified ACM or suspected ACM during work, the Contractor shall take all necessary precautions to ensure the ACM is not disrupted. The Contractor shall immediately notify the Pavement IDIQ Project Manager and Contracting Officer and await further guidance. The Government will take steps, as necessary, to ascertain the material's composition and determine any necessary remedial action.
25. Security Requirements:
A. The Contractor shall comply with security regulations imposed by the Installation Commander and/or the agency occupying the space where the Work is to be performed, including adhering to or obtaining any security clearances.
B. The Contractor shall obtain the following pass and identification items:
1. The Contractor shall sign an agreement stipulating the security requirements of this contract as provided for in DOD 5200.22-R/AFR 205-4, Section 1, part 3, paragraph 1-108a. The following provisions of DOD 5220.22-M, Industrial Security Manual, for safeguarding classified information shall apply to this contract.
C. The Contractor shall obtain favorable national agency check investigations for its employees for entrance to restricted areas.
D. Upon termination of any employee the Contractor shall notify the Contracting Officer of the action by next duty day and shall return all government identification for that person to the Contracting Officer by no later than one additional duty day.
E. The Contractor shall ensure that all vehicles used in the course of this contract shall have a valid state inspection sticker correctly posted on the vehicle and comply with base and state insurance requirements.
