38. Are Offerors required to address all PWS Functional Areas 5-19?

ANSWER: Offeror’s proposals must follow the instructions listed in section M of the RFP and address all evaluation factors and proposal limits.

39. Will Sections L and M be changed to reflect the additional requirements addressed in Question 10?

ANSWER: Section M002 Evaluation Factors, lists all factors that are going to be evaluated by the Government. The answer to question 10 which stated “Offeror must demonstrate knowledge and experience in each area of the PWS” was referring to the areas that are listed in section M of the RFP.

40. If all PWS Functional Areas are required to be addressed, will there be additional pages allocated to cover the requirements?

ANSWER: No, see response to question 39 above.

41. It is noticed that this Clause is missing from the solicitation: Ground and Flight Risk Clause 252.228-7001 (or similar Clause limiting contractor liability) or a similar clause limiting contractor liability associated with handling of aircraft on the ground and in flight.

ANSWER: After reviewing the clause and its prescription, we have determined that this clause is not applicable to the instant acquisition and will not be added.

42. The answer to question 4 conflicts with the Arizona Department of Revenue Pub 603 which states:

Prime contractors are subject to transaction privilege tax under the prime contracting classification. A prime contractor is a person who performs, coordinates or supervises construction work, including contracting with any subcontractors. The prime contractor is the person responsible for the completion of the contract. A prime contractor who only furnishes labor in the performance of contracting work is subject to the tax as well as one who furnishes both labor and materials. Examples of taxable contracting activities include:

o Construction or demolition of a building o Road construction o Construction for government agencies (Federal, state and local), schools, churches, or non-profit o organizations (such as hospitals) o Installation of permanently attached equipment Sales and installation of floor covering, including carpeting o Home remodeling (painting, wiring, plumbing, repairs, etc.)

o Sale of a new manufactured building by a licensed dealer o Land excavation o Landscaping

The PWS requires “construction activities” as defined above, for example road repair, grading of roads, etc. and therefore are subject to the Arizona Privilege Tax. Please confirm the prime contractors performing on this contract are not required to pay the Privilege Tax as indicated by the answer to question 4.

ANSWER: The requirements listed in the PWS are for routine/recurring maintenance services, not construction activities. For additional guidance please go to http://www.azdor.gov/Home.aspx and review pamphlet 603, refer to http://www.azdor.gov/Business/TransactionPrivilegeTax.aspx, or call (602) 255-2060.

43. The answer to question 14 states, “The SCA wage determination prevails.” The current Security workforce is covered by the Security, Police, and Fire Professionals of America (SPFPA) CBA. Based on the answer provided, it is our interpretation that offerors shall not price the Security workforce in accordance with the wage and benefit rates specified in the CBA, but instead should utilize the SCA wage determination thereby subverting the applicable CBA.

Please clarify the Government’s intent.

ANSWER: The SCA wage determination prevails if the labor category is not covered under the CBA’s. If the CBA covers the workforce then the CBA shall be used.

44. The answer to question 15 indicates the duties for the Fire Department for weekend flying days are the same as they are for the regular week. Will the Government please clarify the duty hours for the Fire Department for both the regular work week and the weekend flying days? The PWS states, “The contractor shall provide fire emergency services (operations) 0630 Monday through 2400 Friday and two scheduled weekend flying days per month” which equates to 17.5 hours. Conversely, Section 2.b of the CBA indicates the duty hours are from 0730-2330 which is only 16 hours (2330-0730 are Stand-by hours). Will the government please clarify if the duty hours for the Fire Department for the regular week and weekend flying days is 16 hours or 17.5 hours?

ANSWER: The hours of work listed in the CBA are a breakdown of a normal 24 hour shift for fire department personnel. The hours required by the PWS are 0630 to 2400.

The offeror is responsible for adjusting the schedules of their personnel to meet the requirements of the Government.
