AMENDMENT 1 MFR

FA4819-13-T-0003

18 June 2013 Amendment #1 This purpose of this amendment is to revise provision 52.212-2. Previously it had the wrong information under technical acceptibility. The wrong information has been removed. It was corrected and updated to meet the PWS standards. This current RFQ will be uploaded to FBO as of 18 June 2013.

SECTION SF 1449 - CONTINUATION SHEET

The following have been modified:

52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Evaluation Criteria: The Government shall evaluate proposals using the following criteria:

i. Technical Acceptability

ii. Price

2. Basis for Contract Award: The Government shall use the Lowest Price Technically Acceptable (LPTA) method to determine the awardee. The Government intends to award a contract without discussions with respective quoters.

The Government, however, reserves the right to conduct discussions if deemed in its best interest. In order to be eligible for award, the offeror must have been assigned a pass rating for technical acceptability. If the offeror is assigned a fail rating under any technical factor, the offeror shall automatically be assigned an overall fail rating for technical. The Government shall award to the lowest priced offeror whose quote was deemed to be technically acceptable.

3. Relative Importance of Criteria: Once a quote has been deemed technically acceptable (PASS/FAIL), the award decision will be based on price.

i. Pass/Fail: Technical offeror must clearly demonstrate the ability to perform the services/tasks intended for lead clean-up in accordance with (IAW) the Performance Work Statement (PWS).

FA4819-13-T-0003

ii. Offeror must provide documentation that individuals are certified by appropriate federal and state regulatory agencies to meet federal and local certification requirements for enivronmental remediation in accordance with (IAW) the Performance Work Statement (PWS).

4. Pricing Evaluation:

i. The Government will proceed to award the contract to the contractor who provided the lowest priced technically acceptable quote.

ii. Quotes presented that have a price significantly lower than the Independent Government Estimate may be considered non-responsive by the Contracting Officer. The next lowest technically acceptable quote may then be reviewed for pricing responsiveness and contract award. The process may be repeated until a technically acceptable quote is determined to have responsive pricing.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
