COLLECTION OF CONTRACTOR QUESTIONS & RESPONSES

Question 1: Will the government please provide current copies of any operating permits?

Response 1: See Appendix E for the New Mexico Environmental Department Discharge Permit; Appendix F for the Air Quality Program; Appendix G for the General Duty Clause; and Appendix H for the Sludge Disposal.

Question 2: Is the facility currently meeting its permit limitations?

Response 2: Yes, the facility currently meets its permit limitations.

Question 3: Have there been any complaints, Notices of Violations (NOVs), or Consent Orders within the past two years? If so, please elaborate.

Response 3: No, there has not been any complaints, NOVs or Consent Orders within the past two years.

Question 4: Is the facility currently being manned 24 hours per day, 7 days per week?

Response 4: No, the facility currently is not being manned 24 hours per day, 7 days per week.

Question 5: Is the contractor responsible for the purchase of all chemicals?

Response 5: Yes, the contractor is responsible for the purchase of all chemicals.

Question 6: Will the government please provide a list of all chemicals currently utilized at the facility and each chemical’s approximate annual usage for the past 3 years?

Response 6: Chlorine Gas with an average of 10 pounds per day and caustic soda for the chlorine scrubber and any laboratory reagents the contractor needs to run tests..

Question 7: Is the facility currently under any kind of consent orders? Or have there been any in the last 5 years?

Response 7: No, the facility is not currently under any kind of consent orders and there has not been any in the last 5 years.

Question 8: It was stated in the site visit that it is the contractor’s responsibility to supply all of the laboratory equipment (such as incubators, refrigerator, B.O.D meters, etc). Does this include all of the glass ware, process tools, sampling containers, etc. as well?

Response 8: Yes, reference PWS section 4.12, Laboratory Equipment.

Question 9: Are testing reagents, disposable gloves, and other consumable items considered as pass through materials for reimbursement or is this the contractor’s responsibility?

Response 9: Testing reagents, disposable gloves, and other consumable items are not considered as pass through materials for reimbursement; it is the contractor’s responsibility as they are considered laboratory equipment. Reference PWS section 4.12, Laboratory Equipment.

Question 10: Who’s responsibility is the disposal of the grit from the influent area. If this is the contractors responsibility, can you give us the name of the company that is currently handling this service? How often is disposal needed?

Response 10: Read PWS section 3.3.2., Refuse Containers and Collection, which answers your question.

Question 11: Can you give a general idea of the required grounds maintenance inside and outside of the fence line? Is there any specialty equipment required?

Response 11: Read PWS section 3.3.1., Grounds and Building Maintenance as well as Appendix A, Item 6 – Grounds Maintenance; these sections will answer this question.

Question 12: Do you know how much diesel fuel is purchased annually for the emergency generator? Is this considered a billable item?

Response 12: No, it is the contractor’s responsibility to maintain proper fuel level. No, it is not a billable item, falls under operational costs.

Question 13: How much maintenance has been required for the emergency generator over the last 3 years?

Response 13: The oil and filters have been changed on a yearly basis for the past 2 years due to the recently implemented Air Quality Program. Before the Program, maintenance was done on an as needed basis.

Question 14: How often does sodium hypochlorite need to be added to the Cl2 scrubber?

Response 14: Sodium hypochlorite should never be added to the Cl2 scrubber, because the scrubber uses distilled water and caustic soda to properly operate the scrubber. Caustic soda is added when the level gets below operating level due to monthly test operations.

Question 15: Is there a minimum time of coverage for the weekend “plant checks”?

Response 15: This is a performance-based contract and is an arrangement agreed upon between the plant employees and prime contractor.

Question 16: Are the plant chemicals such as the Cl2 gas considered reimbursable items? Besides the Cl2 what other chemicals are needed?

Response 16: No, the Cl2 gas is not a reimbursable items Other chemicals that are needed, reference Response #s 6 and 9 and PWS section 1.5, Sampling and Laboratory Analysis.

Question 17: The current staff size and wages were discussed at the site visit. Can we get this information for the current employees?

Response 17: The current staff size and wages were not discussed at the site visit. No, you cannot get this information for the current employees and this is proprietary information. Note: If this information is requested via a FOIA, it most likely will be denied/not releasable.

Question 18: What positions are the current staff providing?

Response 18: As stated in Response # 15, this is a performance-based contract and it is up to the contractor to decide how many positions are required to fulfill the Government's need based on the solicitation and its attachments.

Question 19: It would be helpful for the successful bidder to know current rates to allow the ability to bring on existing employees at their current rates?

Response 19: Due to the one CLIN, this is considered proprietary information and will not be disclosed. Names of the current employees will be given to the successful bidder.

Question 20: What is the current contract amount for these services?

Response 20: The current contract amount for these services will not be provided.

Question 21: Is the current contract amount for a 12 month period?

Response 21: The current Wastewater Treatment Plant contract (FA4801-14-C-0001) was awarded 1 Oct 2013 and will expire 30 Sep 2018. The contract was for one base year and up to four options.

Question 22: Does the current contract amount include any additional allowances for such things as reimbursable items, sludge hauling, or maintenance items?

Response 22: The current contract (FA4801-14-C-0001) amount does include additional allowances for reimbursable items, sludge hauling, or maintenance items.

Question 23: Is New Mexico Gross Receipts Tax applicable to this Federal procurement and if so, does it apply to all amounts paid to the contractor under all CLINS?

Response 23: New Mexico Gross Receipts Tax is applicable to this Federal Procurement and applies to all CLINs. Visit New Mexico Taxation & Revenue site at http://www.tax.newmexico.gov/gross-receipts-tax-historic-rates.aspx for Holloman AFB rate, which is "Other" under Otero County. It is the Contractor’s responsibility to include this tax into their proposal/bid pricing.

Question 24: Is it true that all equipment, furniture, tools, vehicles and lab equipment is owned by the current contractor except for the laboratory microscope?

Response 24: Yes, all equipment, furniture, tools, vehicles and lab equipment is owned by the current contractor except for the laboratory microscope.
