MEMORANDUM FOR RESPONDENTS TO SOLICITATION FA469019RA003

SUBJECT: Fair Opportunity Proposal Request (FOPR) to Construct Bath Houses at Outdoor Running Track on Ellsworth AFB, SD

1. This is a FOPR for subject project to be awarded on a fair opportunity basis pursuant to Federal Acquisition Regulation (FAR) 16.505 ordering procedures, the terms and conditions of the Ellsworth MACC Contracts, and the specific requirements outlined in this request with attachments. This project consists of the all work associated with Construct Bath Houses at Outdoor Running Track on Ellsworth AFB, SD. TRIRIGA 1070287

2. The selection methodology for award of this Task Order will be made to the responsive Awardee proposal with the overall lowest price purusant to Section M-I, paragraph 1.2 of solicitation FA469019FA003. The Government may determine that an offer is unacceptable if the construction cost estimate break down prices are significantly unbalanced, unreasonable, or unrealistic. The Government intends to award a single FFP Task Order (TO) for the subject project. The award method, evaluation criteria, and proposal submission instructions are included in the attached GIPR.

3. A site visit will be held Wednesday, 28 November 2018, at 9:00 AM Mountain Standard Time. A second site visit will be held Wednesday, 12 December 2018 at 9:00 AM Mountain Standard Time. We will initially meet in the 28 CONS Conference Room, Building 2500, Suite 1200, Ellsworth AFB, SD, and then after sign in of all attendees and an overview of the project all attendees will depart for the project site. Please provide all requests for base access no later than Friday, 23 November 2018, 5:00 PM Mountain Standard Time.

4. Applicable Wage Determinations are required for this effort. Use Wage Determination identified in the attached GIPR. Performance under the resulting task order will require compliance with this wage decision.

5. Identify any conflict of interest or appearance issues which may be a potential Organizational Conflict of Interest (OCI) in accordance with FAR 9.5, as supplemented, and any basic contract clause(s) that govern the IDIQ. OCI mitigation plans or a statement that no OCI exists should accompany your proposal. Contractors are responsible for immediately notifying the Contracting Officer should any potential conflict of interest arise at any time prior to and/or after contract award.

6. The following clauses, in addition to the IDIQ clauses, will be included in this order:

7. Your proposal must include a cover letter stating a proposal acceptance period in accordance with the attached GIPR. Proposals offering a shorter acceptance period will be deemed unacceptable. The cover letter shall be submitted on company letter head that includes the company name, address, and a specific point of contact (POC).

8. Questions and Answers/Assumptions and Exceptions: Contractors are cautioned that all communications are to be channeled through the Contracting Officer. Any questions whether technical or contractual in nature shall be submitted in writing. Questions and Answers may be submitted in writing to the Contract Administrator Samantha Hough via e-mail samantha.hough.2@us.af.mil by 5:00 PM Mountain Standard Time, Tuesday, 4 December 2018. Questions will be consolidated and responses will be forwarded to all contractors through an amendment to solicitation FA469019RA003. No further questions will be addressed on this project after this date. Contractors shall address any assumptions and proposed exceptions to the Contracting Officer in their proposal.

9. This FOPR is not authorization to begin performance, and in no way obligates the Government for any costs incurred by the offeror associated with developing a proposal. The Government reserves the right not to award an order in response to this FOPR. Prior to commencement of any activities associated with performance of this requirement, the Government will issue a written directive or contractual document signed by the Contracting Officer with appropriate consideration established.

10. Funds are presently not available for this effort. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation either before or after the closing date. In the event the Government cancels this solicitation the Government has no obligation to reimburse an offeror for any costs.

11. All proposals must be received by the 28th Contracting Squadron in response to solicitation FA469019RA003.

12. Performance and payment bonds are required.

13. For either the site visit or submission of proposals all personnel requesting access to Ellsworth Air Force Base must possess a valid State or Government picture identification card. Furthermore, individuals presenting identification cards from a state that is non-compliant with the REAL ID Act will require additional documentation to gain unescorted base access. Additional documentation include a valid U.S. or foreign government issued passport, an employment authorization document that contains a photograph, or identification cards issued by federal state or local government agencies that include a photo and biographic information.
