About this file

This document is Section M of a solicitation, detailing the evaluation factors for award of a firm fixed-price contract for facility pavement repair work. The procurement involves two Contract Line Items (CLINs): CLIN 0001 for facility pavement repair and CLIN 0002 as an optional CLIN for 12.5' x 12.5' x 6.5" concrete slab replacement. The price evaluation will calculate the Total Evaluated Price by adding the unit price for CLIN 0001 and multiplying the unit price for CLIN 0002 by 10. Bidders must provide pricing for both CLINs, with failure to price the optional CLIN rendering the bid non-responsive. The contract will be awarded to the responsible and responsive bidder with the technically acceptable bid and lowest Total Evaluated Price, with the government intending to award a single contract.

SECTION M - EVALUATION FACTORS FOR AWARD

M-1 BASIS FOR AWARD

M-1.1 The Government will evaluate bids in the following order:

a. Responsibility Determination: An initial determination will be made to ensure the bidder is responsible. This includes verifying that the bidder has adequate financial resources, the ability to comply with the delivery schedule, a satisfactory performance record, a satisfactory record of integrity and business ethics, and the necessary organization, experience, accounting and operational controls, and technical skills to perform the contract. If a bidder is deemed non-responsible, their bid will be rejected. (See M-1.3. below)

b. Responsiveness Determination: Each bid will be reviewed to determine if it is responsive to all the mandatory requirements of this IFB. Bids that do not conform to the solicitation requirements or fail to include all required information may be deemed non-responsive and rejected without further evaluation.

c. Price Evaluation: Evaluation to be conducted per section M-2.

The Government intends to award (1) one firm fixed-price contract as a result of this solicitation.

M-1.2 Rejection of Unreasonable Offers: The Government may reject any proposal from an unresponsive offeror, an unresponsible offeror, or a proposal that is evaluated to be unreasonable in terms of price, program commitments, contract terms and conditions, such that the proposal is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and risks of the program.

M-1.3 Contractor Responsibility: In accordance with FAR subpart 9.1, the Contracting Officer shall award contracts only to responsible vendors. No purchase or award shall be made unless the Contracting Officer makes an affirmative determination of responsibility. To be determined responsible, a prospective contractor must:

a. Have adequate financial resources to perform the contract, or the ability to obtain them (FAR 9.104-3(a);

b. Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments;

c. Have a satisfactory performance record (FAR 9.104-3(b) and FAR subpart 42.15).

A prospective contractor shall not be determined responsible or nonresponsible solely on the basis of a lack of relevant performance history, except as provided in

FAR 9.104-2;

d. Have a satisfactory record of integrity and business ethics (for example, see FAR subpart 42.15);

e. Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them (FAR 9.104-3(a)); and

f. Be otherwise qualified and eligible to receive an award under applicable laws and regulations (see also inverted domestic corporation prohibition at FAR 9.108).

M-2 PRICE EVALUATION

The total evaluated price will be calculated as follows:

Total Evaluated Price = (Unit Price for CLIN 0001 + (Unit Price for CLIN 0002 (Optional) * 10)

• CLIN 0001: All work, materials, labor required to repair facility pavement as indicated in the statement of work. EEIC 52495.

• CLIN 0002: Option CLIN for 12.5' x 12.5' x 6.5" concrete slabs - (1) 157 SF per slab All work, materials, labor required to remove and replace per the SOW. This option may be exercised up to 10 times.

• The unit prices submitted for each CLIN must be inclusive of all applicable costs, including but not limited to labor, materials, overhead, profit, and transportation.

• Bidders must provide a price for the optional CLIN (0002). Failure to provide a price for this item will render the bid non-responsive.

The Total Evaluated Price will be used only for evaluation purposes and does not obligate the Government to purchase this option.
