FAR 52.216-4 ADDENDUM

FAR 52.216-4 Economic Price Adjustment – Labor and Material (JAN 1997) is hereby incorporated by reference and supplemented as follows:

FUEL COST

1. Applicability: All priced Subcontract Line Item Numbers (SLINs) (SLINs 0001 – 0014 and corresponding option SLINs) listed on the Price List (Attachment 1), are subject to economic price adjustments as prescribed in FAR 16.203, Fixed Price Contracts with Economic Price Adjustment. The Starting Price Value (SPV) for non-mid-grade/non-premium gasoline used in conjunction with this contract is considered $2.14 per gallon; $2.31 per gallon for diesel. Each of these figures have been computed using the following methodology:

a. On 15 February 2017, the Contracting Officer searched for non-mid-grade/non-premium gasoline (and diesel) prices in “Wichita – East” on http://www.wichitagasprices.com.

b. The Contracting Officer found the average of all prices reported for non-mid-grade/non-premium gasoline (and then diesel) in “Wichita – East” on http://www.wichitagasprices.com.

c. The Contracting Officer, hereby implements the resultant values as the SPVs for non-mid-grade/non-premium gasoline and diesel, respectively, against which all future economic price adjustments shall be calculated.

d. The SPV shall not be used to enact an economic price adjustment prior to exercising the first option fiscal year regardless of fuel price changes between solicitation and award.

2. Process: On the 1st day (excluding Saturdays, Sundays) of each base and option years (normally 1 May) during any performance period subsequent to the award of a contract hereto, the awardee is tasked to notify the Contracting Officer in writing if the contractor desires the Contracting Officer to consider establishing a Future Fiscal Year Economic Price Adjustment Value (FFYEPAV) for fuels used in prosecution of this contract for the upcoming fiscal year. The contractor is required to employ the following methodology:

a. Query non-mid-grade/non-premium gasoline prices and diesel prices for “Wichita – East” at http://www.wichitagasprices.com and print the results with a computer-generated date stamp.

b. Find the average of all prices reported for non-mid-grade/non-premium gasoline (and then diesel) prices in “Wichita – East” on http://www.wichitagasprices.com. Each of these figures becomes the Potential Economic Price Adjustment Value (PEPAV) for their respective fuel type.

c. Find the difference (plus or minus) between the SPV and the PEPAV, rounded to the nearest full cent.

i. Averages with a result of cents between $0.xx0 and $0.xx4 shall be rounded down to the nearest full cent.

ii. Averages with a result of cents between $0.xx5 and $0.xx9 shall be rounded up to the nearest full cent.

iii. If the difference between the SPV and the PEPAV is less than twenty-five cents ($0.25) per gallon, then no economic price adjustment shall be considered for the future fiscal year.

iv. If the difference between the SPV and the PEPAV is twenty-six cents ($0.26) per gallon or greater, then this figure becomes the FFYEPAV for the future fiscal year.

d. If an economical price adjustment is required, then a new SLIN shall be bi-laterally modified into the option year of the basic contract vehicle to allow for funding the FFYEPAV on delivery orders issued against that fiscal year.

3. Adjustment Valuation: If the product of the annual query and subsequent calculations result in an economic price adjustment, then the FFYEPAV shall be applied to the work to be completed during the future fiscal year in accordance with the following method:

a. The Government shall audit the contractor’s fuel receipts from the previous fiscal year to calculate fuel consumption rates for no more than the last twelve (12) consecutive calendar months. Only receipts for operations satisfying the Performance Work Statement shall be considered for audit.

b. The Government shall sum the quantity of non-mid-grade/non-premium gasoline (and then diesel) fuel gallons receipted to calculate the Previous Year Fuel Consumption (PYFC).

c. The Government shall multiply each PYFC from para 3.b. of this addendum by the associated FFYEPAV.

LANDFILL TIPPING FEES

Subcontract Line Item Numbers (SLINs) 0018AA, 0018AB, 0018AC, 1018AA, 1018AB, 1018AC, 2018AA, 2018AB, 2018AC, 3018AA, 3018AB, 3018AC, and 4018AA, 4018AB, 4018AC listed on the Price List (Attachment 1) are subject to price adjustments as prescribed in FAR 16.203 – Fixed-Price Contracts with Economic Price Adjustment. The starting index for the contract shall be proposed by the contractor. The proposed fees must be verifiable by reciept. The current local fees are $60 per ton for Municipal Solid Waste as charged by Waste Disposal LLC, Wichita KS and Construction & Demolition Waste is $34.50 per ton as charged by CDR, Wichita KS. The contractor shall notify the Contracting Officer if at any time during the contract performance, the per ton rate for disposal of either waste increases or decreases. The contractor shall furnish this notice within 30 calendar days after the increase or decrease, or within any additional period that the Contracting Officer may approve in writing, but not later than the final payment under this contract. The aggregate of the increases in any contract unit price under this clause shall not exceed 10% of the original contract unit price.

(End of addendum)

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(1) Technical

(2) Past Performance

(3) Price

Past performance and technical when combined is significantly more important than Price when being evaluated.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014) ADDENDUM

BASIS FOR CONTRACT AWARD: This is a competitive selection in which competing offeror’s present and past performance history, & technical will be evaluated on a basis significantly more important than price. By submission of its offer in accordance with the instructions provided in clause 52.212-1, Instructions to Offerors, the offeror accedes to the terms of this model contract and all such offers shall be treated equally except for their prices, technical proposal, and performance records. The evaluation process shall proceed as follows:

A. Initially, the government technical evaluation team shall evaluate the technical proposals on a pass/fail basis, assigning ratings of Acceptable or Unacceptable. The proposals shall be evaluated against the following:

Mission-Essential Contractor Services Plan

Description: The Mission-Essential Contractor Services Plan must meet the requirements established in DFARS Provision 252.237-7024, Notice of Continuation of Essential Contractor Services.

Measure of Merit: This requirement is met when the offeror’s proposal contains a Mission- Essential Contractor Services Plan that meets the requirements established in DFARS Provision 252.237-7024.

TABLE 1 - TECHNICAL RATINGS

Rating Description

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

B. Next, offers shall be ranked according to price, including any option prices. An offeror’s proposed prices will be determined by multiplying the quantities identified in the Pricing Schedule by the proposed unit price for each Sub Contract Line Item Number (SubCLIN) to confirm the extended amount for each. The offerors will be evaluated for balance, completeness, and reasonableness of the proposed evaluated price.

C. Using questionnaires, the contracting officer shall seek relevant past performance information based on the references provided by the offeror and data independently obtained from other government and commercial sources. Relevant past performance includes efforts involving the performance of the services described in the PWS that are similar or greater in scope, magnitude and complexity than the effort described in this solicitation. The government reserves the right to seek information on higher priced offerors if none of the lower priced offerors receives a “Substantial Confidence” past performance assessment rating.

D. The purpose of the past performance evaluation is to allow the Government to assess the offeror’s ability to perform the effort described in this solicitation based on the offeror’s demonstrated present and past performance. The assessment process will result in an overall past performance confidence assessment rating of Substantial Confidence, Satisfactory Confidence, Limited Confidence, No Confidence, or Neutral Confidence, as defined herein. Past performance regarding predecessor companies, key personnel who have relevant experience, or sub-contractors that will perform major or critical aspects of the requirement will not be considered as highly as past performance information for the principal offeror. All past performance information for the individual entities that comprise a joint venture will be considered as the principal offeror’s past performance for evaluation purposes. Additionally, the past performance evaluation may take into consideration the proposed distribution of effort between the parties for teaming arrangements, including joint ventures, in determining the weight of each participant’s individual past performance records in the overall performance confidence assessment rating. When no recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the rating will be “Neutral Confidence”, meaning the rating is evaluated neither favorably nor unfavorably.

E. Performance Confidence Assessment Rating: Past performance will be used as a measure of the Government’s confidence in the offeror’s ability to successfully perform based on previous and current contracts and support agreements. Past performance information may be obtained through the Past performance Information Retrieval System (PPIRS), questionnaires provided by the offeror (see Part 3 of Addendum to 52.212-1 – Instructions to Offerors), through Defense Contract Management Agency channels, through interviews with program managers and contracting officers, or other sources known to the Government. Data from previous source selections or contractor capability assessments will be used if the data is recent and relevant. A confidence assessment rating will be assigned to each offeror as follows:

Substantial Confidence - Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence – Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Limited Confidence – Based on the offeror’s recent/relevant performance record, the government has a low expectation that the offeror will successfully perform the required effort.

No Confidence – Based on the offeror’s recent/relevant performance record, the government has no expectation that the offeror will be able to successfully perform the required effort.

Neutral Confidence – No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The offeror may not be evaluated favorably or unfavorably on the factor of past performance.

F. Performance Evaluation - Relevancy Ratings

To assist the Government’s evaluation, each offeror’s supporting past performance will be evaluated for relevancy as follows:

Very Relevant – Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant – Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant – Present/past performance contractual effort involved some of the scope and magnitude of effort and complexities than this solicitation requires.

Not Relevant – Present/past performance effort involved little or none any of the scope and magnitude of effort and complexities this solicitation requires.

G. Past Performance Evaluation – Recency:

Only past performance occurring or ending within the last (5) five years of offer/proposal due date will be considered for recency. Any past performance occurring more than five years from offer/proposal due date shall be considered Not Recent.

H. In evaluating past performance, the Government reserves the right to give greater consideration to information on those contracts deemed most relevant to the effort described in this solicitation.

I. If the lowest priced technically acceptable evaluated offer is judged to have a “Substantial Confidence” performance rating and the offeror is determined to be responsible, that offer represents the best value for the Government and the evaluation process stops at this point. Award shall be made to that offeror without further consideration of any other offers.

J. If the lowest priced technically acceptable offeror is not judged to have a “Substantial Confidence” performance assessment, the next lowest priced technically acceptable offeror will be evaluated and the process will continue (in order by price) until an offeror is judged to have a “Substantial Confidence” performance assessment or until all offerors are evaluated. The Source Selection Authority shall then make an integrated assessment best value award decision.

K. The Government reserves the right to award a contract to the other than lowest priced technically acceptable offer if that offeror is judged to have a past performance risk rating of “Satisfactory Confidence” or lower. In that event, the Source Selection Authority shall make an integrated assessment best value award decision.

L. Offerors are cautioned to submit sufficient information and in the format specified in FAR 52.212-1, Instruction to Offerors – Commercial Item to permit a meaningful arrangement of past performance. Offeror’s may be asked to clarify certain aspects of their proposal (for example, the relevance of past performance information) or respond to adverse past performance information to which the offeror has not previously had an opportunity to respond. Communication conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for proposal revision.

M. The Government reserves the right to award a contract without discussions with respective offerors. The Government, however, reserves the right to conduct discussions if deemed in their best interest.

Joint Venture Agreements – Joint Ventures are allowable on competitive 8(a) set-asides;

however, the joint venture agreement must be received by SBA prior to proposal due date and approved before award of any resulting contract. If you are contemplating a joint venture on this project, you must advise your assigned SBA Business Development Specialist (BDS) as soon as possible. It is also recommended that the agreement be submitted as soon as practicable to ensure compliance with established regulations. Any corrections and/or changes needed can be made only when our BDS has adequate time for a thorough review before the proposal due date. NO

CORRECTIONS AND/OR CHANGES ARE ALLOWED AFTER TIME OF SUBMISSION OF

PROPOSAL OR BIDS.
