SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
The following have been modified:

Section L - Instructions, Conditions and Notices to Bidders
INSTRUCTIONS TO OFFERORS
L-1 Instructions to Offerors This is an all-electronic solicitation release. Hard copies are not available. The Government will post all information pertaining to the solicitation and award of this requirement to the Electronic Posting System, also known as FedBizOpps (www.fbo.gov). It is the responsibility of each offeror to review the web page for postings of amendments, updates or changes to current information.
L-1.1 Pre-Proposal Conference: A pre-proposal conference will be held on 18 July 2011. All prospective offerors are highly encouraged to attend this conference. In order to make the conference as productive as possible, offerors should submit, on or before 12 July 2011, any questions they may have in writing to patrick.butler.2@us.af.mil. The submission of written questions will not preclude anyone from posing questions during the conference. Failure of a prospective offeror to submit any questions or attend the conference will be construed to mean that the prospective offeror fully understands all requirements of the solicitation. Prospective offerors are advised that the pre-proposal conference will be held solely for the purpose of explaining the seed project and terms and conditions of this solicitation. Answers to questions will be periodically posted to FedBizOpps. If an amendment to this solicitation is issued, normal procedures relating to the acknowledgment and receipt of any such amendment as described in contract clause 52.215-1, Instructions to Offerors-Competitive Acquisition, of this RFP shall apply.
Notice to Offerors: Offerors are encouraged to submit all questions and requests for clarifications no less than ten
(10) days prior to the RFP closing date. The decision whether to respond to questions and requests for clarification made less than ten (10) days prior to the RFP closing shall be at the sole discretion of the contracting officer.

L-1.2 Incurred Expenses: The Government is not responsible for any costs incurred or associated with preparation and submission of a proposal in response to this solicitation.
L-1.3 In compliance with FAR Subpart 4.8, the Government will retain one copy of all unsuccessful proposals and will destroy all extra copies. No destruction certificate will be provided.
L-1.4 All proposals must be complete, self-sufficient, and respond directly to the requirements of this solicitation.
Any commitments made in the proposal shall become a part of the resultant contract. In no case shall words like "we will comply with the requirements of the contract," or equivalent statements, be acceptable to meet the requirements of this RFP. Failure to comply with these instructions may result in the Government summarily rejecting the offeror's proposal.

PROPOSAL PREPARATION
L-2 PROPOSAL PREPARATION INSTRUCTIONS
L-2.1 The Government intends to award up to ten (10) contracts as part of the Multiple Award Construction Contract (MACC) program. The competition for receiving an award under the MACC shall be based upon the evaluation of proposals for the seed project. The ten offers representing the best value to the Government shall be awarded a contract under the MACC. The offer representing the best value to the Government shall be awarded a Task Order for the seed project. The IDIQ minimum order requirement for the remaining awards shall be satisfied by issuing task orders in the amount of $500.00 in consideration of attendance at a mandatory partnership meeting.
This award shall not apply to the seed project awardees.
L-2.2 To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. Proposals shall consist of two (2) separately bound parts: Part I – Price Proposal (Seed Project Pricing and Contract Documents); and, Part II - Past/Present Performance information.
L-2.3 The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Therefore, only a limited amount of pricing information is required in the initial proposals. Upon examination of the initial proposals (offers), the contracting officer will review this determination. If, in the contracting officer's opinion, there is adequate price competition, no additional price information, except for final proposal revisions as warranted, will be elicited and certification under FAR 15.406-2 will not be required.
However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists, offerors may be required to prepare, submit, and certify cost or pricing data in accordance with
FAR 15.403-4.
L-2.4 Specific Instructions:
PART I – PRICE PROPOSAL/CONTRACT DOCUMENTS
- Submit original and one (1) copy.
(a) Complete blocks 14, 15, 16, 17, 19, 20A, 20B, and 20C of the RFP Section A, (SF1442) In doing so, the offeror accedes to the contract terms and conditions as written in RFP Sections A through K. These sections constitute the model contract.
(b) Insert proposed prices for the seed project on the Pricing Schedule (Attachment 13 to this solicitation).
(c) Complete the necessary fill-ins and certifications in Sections I through K. Section K shall be returned in their entirety. For other Sections in C through I, the offeror shall submit only those pages that require a “fill-in”.
PART II – PAST AND PRESENT PERFORMANCE INFORMATION
- Submit original and two (2) copies.
(a) Quality and Satisfaction Rating for Contracts Completed in the Past Three Years: Provide information currently available (letters, metrics, customer surveys, independent surveys, etc.) which demonstrates customer satisfaction with overall job performance and quality of completed product for same or similar type contract, limited to no more than three (3) pages per contract referenced plus five (5) additional pages. In addition, explain corrective actions taken in the past, if any, for substandard performance and any current performance problems such as cost overruns, extended performance periods, numerous warranty calls, etc.
(b) The Government will evaluate the quality and extent of offeror’s performance deemed relevant to the requirements of this solicitation. The Government will use information submitted by the offeror and other sources such as other Federal, State and local Government offices and commercial sources, to assess performance. Provide a list of no less than three (3) and no more than five (5) of the most relevant contracts performed for Federal agencies and commercial customers within the last three (3) years. The contracts that the government will deem relevant shall be of a similar scope and magnitude as this effort and include a minimum of two design-build construction projects with a project magnitude between $200K and $5M. Complexity is defined as the ability to perform and manage several large design-build project task orders at the same time and/or ability to successfully perform and manage multi-disciplined task orders of a similar or higher magnitude than described by this solicitation.
(c) The following relevancy definitions apply:
VERY RELEVANT- Present/past performance effort involved essentially the same magnitude of effort and complexities this solicitation requires.
RELEVANT- Present/past performance effort involved much of the magnitude of effort and complexities this solicitation requires.
SOMEWHAT RELEVANT- Present/past performance contractual effort involved some of the magnitude of effort and complexities than this solicitation requires.”
NOT RELEVANT- Present/past performance effort did not involve any of the magnitude of effort and complexities this solicitation requires.
The evaluation of past performance information will take into account past performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the instant acquisition. Furnish the following information for each contract referenced:
(i) Company/Division name (Include a point of contact for this offer.)
(ii) Product/Service (Include a summary of the Statement of Work and the methods used to monitor performance.)
(iii) Contracting Agency/Customer
(iv) Contract Number
(v) Contract Dollar Value (Include both annual and base plus options.)
(vi) Period of Performance
(vii) Verified, up-to-date name, address, FAX and telephone number of the Contracting Officer, the
Contract Administrator and the Quality Assurance Evaluator.
(viii) Comments regarding compliance with contract terms and conditions
(ix) Comments regarding any known performance deemed unacceptable to the customer, or not in accordance with the contract terms and conditions.
c. Past Performance Surveys: It is the offeror’s responsibility to send the performance questionnaire (Attachment No. 6) to the three (3) to five (5), relevant projects performed for Federal, State and local Government agencies and commercial customers within the last 3 years, described above, and ensure that the completed questionnaires are submitted to this contracting office no later than the time and date specified in the solicitation for receipt of proposals. The Government will conduct a good faith effort to follow-up to obtain performance surveys but performance questionnaires referred by the offeror and not received by the Contracting Officer will not be evaluated for award. To insure timely delivery of the performance questionnaire the following non-directive guidance is provided.
(i) Contact the individual who will be conducting the evaluation and confirm that this individual will be completing the questionnaire.
(ii) Forward the cover letter and questionnaire to the individual completing the questionnaire along with a summary of examples of noteworthy performance.
(iii) Follow-up to ensure that the individual conducting the evaluation received the questionnaire and obtain a suspense for completion and delivery of the questionnaire.
(iv) Contact the points of contact named in the FBO notice herein and confirm receipt of the questionnaire.
L-2.5 Joint Venture Offerors: If the offeror is a joint venture, the offeror shall provide all required solicitation information for all parties including a copy of the joint venture agreement with proposal. The agreement shall include information, which identifies the responsibilities for each entity under this contract. The agreement shall demonstrate the relationship between firms and identify contractual relationships and authorities to bind each entity of the joint venture. If the joint venture is comprised of 8(a) firms, the Small Business Administration (SBA) must approve the joint venture agreement prior to award. Past performance information may be submitted on behalf of the joint venture by either party to the joint venture. Joint venture past performance will be evaluated and rated on the basis of either party’s past performance. Joint Venture Agreements must be received by the Small Business Administration (SBA) prior to proposal due date and approved before award of a resulting contract. If a joint venture is contemplated, then the assigned SBA Business Opportunity Specialist (BOS) must be advised as soon as possible. Ensure the agreement is submitted to the BOS in sufficient time to permit a regulatory compliance review.
Any corrections and/or changes requested must allow for review time by the BOS before the proposal due date. No corrections and/or changes are permitted after the time for submission of offers.
L-2.6 Teaming/Partnering Offerors: If the offer is based on a teaming/partnering relationship, the offeror shall provide all required solicitation information for all parties including a copy of the teaming/partnership agreement.
The agreement shall include information, which identifies the responsibilities for each entity under this contract.
The agreement shall demonstrate the relationship between firms and identify contractual relationships and authorities to bind each entity of the teaming/partnering relationship. If this is a first time joint effort, each party to the arrangement must provide a list of past and present relevant contracts.

(e) Subcontractor Consent: Past performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor’s consent. Provide with the proposal a letter from all subcontractors that will perform major or critical aspects of the requirement, consenting to the release of their past performance information to the prime contractor.
INFORMATION REGARDING SUBMISSION OF PROPOSAL: Electronic submissions of facsimile and/or electronic mail proposals are not authorized and shall not be considered for evaluation. Hand carried proposals must be delivered to 22 CONS/LGCA, 53384 Kansas Street Ste K, Bldg 840, McConnell AFB, Kansas 67221-3606, ATTN: Patrick Butler. The sealed envelope or package used to submit your proposal must show the time and date specified for receipt, the Solicitation Number, and the name and address of the offeror.
Offerors are cautioned that McConnell AFB, KS has visitor control procedures requiring individuals not affiliated with the installation to obtain a visitor pass prior to entrance. SOME DELAY SHOULD BE ANTICIPATED WHEN HANDCARRYING PROPOSALS. Offerors should allow sufficient time to obtain a visitor pass and arrive at the bid depository PRIOR to the time specified for receipt. Late proposals will be processed in accordance with FAR 15.208 “Submission, Modification, Revision and Withdrawal of Proposals” “Late submission, modifications, revisions, and withdrawals of offers.”
