MEMORANDUM FOR: RESPONDENTS TO SOLICITATION FA4528-20-R-0008
FROM: 5 CONS/PKA
SUBJECT: Fair Opportunity Proposal Request (FOPR) to Renovate Offices Bldg. 527 at Minot AFB, ND
1. This is a FOPR for subject project to be awarded on a fair opportunity basis pursuant to Federal Acquisition Regulation (FAR) 16.505 ordering procedures, the terms and conditions of the Paving MACC Contracts, and the specific requirements outlined in this request with attachments. This project consists of the all work associated with Renovate Offices Bldg. 527 on Minot AFB, ND.
2. The selection methodology for award of this Task Order will be made to the responsive Awardee proposal with the overall lowest price (competition consisting only of those offers awarded an initial contract). The Government may determine that an offer is unacceptable if the construction cost is unreasonable. The Government intends to award a single FFP Task Order for the subject project. The Government reserves the right to conduct interchanges (see Attachment 3 – MACC Provisions).
3. A site visit will be held Wednesday, 7 January 2020, at 10:00 AM CST. We will initially meet in the 5 CONS Conference Room, Bldg 165, Minot AFB, ND, and then after sign in of all attendees and an overview of the project all attendees will depart for the project site. Please provide all requests for base access no later than Friday, 2 January 2020 at 2:00 PM CST.
4. Wage Determination: Use contract Attachment 12 – DBA Wage Determination in performance of this Task Order.
5. The following clauses, in addition to the IDIQ clauses, will be included in this Task Order:
No additional clauses
6. Questions and Answers/Assumptions and Exceptions: Contractors are cautioned that all communications are to be channeled through the Contracting Officer. Any questions whether technical or contractual in nature shall be submitted in writing. Questions and Answers may be submitted in writing to the Contract Administrator, SSgt Cain, via e-mail teante.cain@us.af.mil by 14 January 2020, at 2:00 PM CST. Questions will be consolidated and responses will be forwarded to all contractors through an amendment to solicitation FA4528-20-R-0008. No further questions will be addressed on this project after this date. Contractors shall address any assumptions and proposed exceptions to the Contracting Officer in their proposal.
7. This FOPR is not authorization to begin performance, and in no way obligates the Government for any costs incurred by the offeror associated with developing a proposal. The Government reserves the right not to award an order in response to this FOPR. Prior to commencement of any activities associated with performance of this requirement, the Government will issue a written directive or a contractual document signed by the Contracting Officer with appropriate consideration established.
8. All proposals must be received by the 5th Contracting Squadron in response to solicitation FA4528- 20-R-0008.

9. Payment and Performance Bonds:
a. Payment and Performance Bonds are required for construction contracts greater than $150,000.
b. For construction contracts greater than $35,000 but not greater than $150,000, a payment bond or an irrevocable letter of credit (ILC) are required.
c. The FOPR awardee must submit the appropriate bonding within 10 days after TO Award.
10. Project Magnitude: Between $25,000 and $100,000.
11. Liquidated Damages for this project in accordance with contract clause 52.211-12 in the amount of $346.99 for the first day and $306.61 for each additional day _X_ are applicable ______ are not applicable.
12. Performance Period: The performance period for this Task Order will be 150 days after issuance of the Notice to Proceed.
13. For either the site visit or submission of proposals all personnel requesting access to Minot Air Force Base must possess a valid State or Government picture identification card. Furthermore, individuals presenting identification cards from a state that is non-compliant with the REAL ID Act will require additional documentation to gain unescorted base access. Additional documentation include a valid U.S.
or foreign government issued passport, an employment authorization document that contains a photograph, or identification cards issued by federal state or local government agencies that include a photo and biographic information. 14. Offer Schedule: Provide the proposal for the seed project – Renovate Offices Bldg. 527 in the table below.
