STATEMENT OF WORK
FOR
MULTIPLE AWARD CONSTRUCTION CONTRACT (MACC)
1. DEFINITIONS:
a. 10% Design - When submitted in response to a Fair Opportunity Proposal Request (FOPR), documents shall show the essential components of the proposed design and convey that the contractor fully understands the Task Order (TO) requirements, and that their proposed price includes all required elements of work to complete the project. DRAWINGS: (a) Concept Floor Plan; (b) Conceptual Elevation. DESIGN ANALYSIS: Construction Narrative. The contractor’s Construction Narrative shall be written to outline the work to be performed per the design requirements demonstrating that the contractor understands the government’s scope of work.
b. 35% Design - When submitted in response to a FOPR, documents shall show the essential components of the proposed design and convey that the contractor fully understands the FOPR requirements, and that their proposed price includes all required elements of work to complete the project. Regardless of when this design is provided to the government, i.e., prior to or after award of the TO, the documents will include the following minimum information, as applicable to the project: drawings; a list showing sections to be incorporated in the specifications; design analysis; and any other design components relating to the 35% design as identified in the TO. Major mechanical and electrical equipment items shall be shown on the drawings with single line diagrams. All utilities and structures shall be shown. Drawings shall also include the following, as applicable:
(1). All required controlling dimensions. Site plan showing proposed location of work including benchmarks, access from main roads, surface or sub-surface drainage concepts, any applicable existing/proposed pavement, and grading elevations.
(2). Floor plans with dimensions and functional arrangement of all areas including corridors, exits, stairs, and utility spaces properly related to exterior access, roads, parking, and service areas, etc. Special designs and/or deviations from accepted standards of complex design shall be given adequate consideration to ensure placement and arrangement of applicable standards. Designs shall also include gross floor area for each floor and for the entire building. Floor and roof framing, and loadings shall be indicated. Built-in, installed, and specialized portable equipment shall be indicated to scale. Pertinent information regarding fire prevention and safety requirements shall be shown. Design live and dead loads shall be shown.
(3). Elevations shall include story heights, fenestration, and adaptation to finished grades at the site.
(4). Sections of structures, including framing, partitions, suspended ceilings (if any), ducts, etc., shall be shown.
(5). Typical wall sections shall be shown at a scale of no less than 3/4 inch = 1 foot. Sections shall include material and thicknesses (to include insulation thickness and minimum thermal resistance R-value), methods of attachment, and type of windows with relation thereof to supporting structural columns or walls.
(6). For heating, air conditioning, fire protection, mechanical ventilation, plumbing, and special features such as elevators, hoists, kitchen equipment, etc., indicate the location, capacity, and space requirements for all major items of mechanical equipment. Single line indication and riser diagrams of ducts, pipes, and equipment and their approximate location shall also be shown. The location of fire protection risers shall be shown. Indication shall be made as to whether piping and duct work are exposed or concealed. Functional areas where pipes are exposed shall be delineated. Approximate operating range or capacity for heating, ventilation, air conditioning, and refrigeration equipment shall be clearly stated.
(7). For electrical systems, indicate lighting arrangements, types of fixtures proposed, general light intensities, special electrical requirements of the user, including communications and electronic facilities where applicable, fire alarm/mass notification devices, emergency lighting, light and power service entrance, and distribution arrangement. Conduits, including those to be wired by an independent entity, shall be shown together with indication as to whether conduits are exposed. Functional areas having exposed conduits shall be delineated. Riser diagrams showing service equipment, feeders, and panels, other than branch circuits, shall be shown. Cable sizes, current demand factors, and switch and panel board descriptions are not required at this time. Location capacity and space requirements of all major items of equipment shall be shown including interior substations with service equipment and panels. Power, communication, and electronic features will be indicated in sufficient detail to identify requirements clearly and to indicate the means of satisfying the requirements, to include the brand name of the equipment specifically required by the FOPR.
(8). Provide separate lists of all Government-furnished equipment to be installed by the contractor and equipment furnished and installed by the Government, if applicable.
The contractor will not proceed to the next design state until the Contracting Officer issues a Notice to Proceed (NTP) to the subsequent design milestone.
c. 65% Design - In response to the NTP, documents shall build upon the 35% design, including drawings, and the complete text of the specifications. The drawings will show an additional 30% progress in all disciplines, which may include site plans, floor plans, elevations, wall sections, details, and all other elements as identified in the 35% design. All cut sections and details shall also be shown on the drawings at this time. Any updated or corrected design analysis of architectural, structural, civil, electrical, mechanical, and utility systems shall be included. The contractor will not proceed to the next design stage until the Contracting Officer issue a Notice to Proceed (NTP) to the subsequent design milestone.
d. 95% Design - In response to the NTP, documents shall build upon the prior design submittal of 65%. This will include all drawings: to include for review, final, and complete drawings, and specifications. All project requirements identified in the most current Task Order revision, site visit minutes, solicitation amendments, modifications, or documented review comments must be incorporated. The contractor will not proceed to the next design stage until the Contracting Officer issues a Notice to Proceed (NTP) to the subsequent design milestone.
e. 100% Design - In response to the NTP, documents shall be ready to be used for construction, which includes the required professional certifications and final contractor accomplished corrections based on the Government's review of the prior 95% design requirements.
f. Beneficial Occupancy - FAR 52.236-11, Use and Possession Prior to Completion, allows for the occupation of a building prior to final acceptance. The Contracting Officer must notify the contractor of the intent of the government to take Beneficial Occupancy in writing. If the Air Force occupies the facility, the Contractor must ensure there is no alteration, repair, or change in any way to the facility or any equipment therein prior to the Government taking final acceptance. Changes of this nature could alter the Government’s rights under the contract clauses for warranty and inspection.
g. Best Value - A process used to evaluate proposals based on the quality of the overall design in addition to the other criteria included in the request for proposal. When used, the “best value” evaluation factors will be included in the TO and may vary between projects. Award may be given to an entity other than the low offeror.
(1). Evaluation Factors – Those components of a project design, as identified in the TO, which represent significant importance to the successful execution of the project, used to evaluate the overall quality of the proposed design.
(2). Deficiency – A material failure of a proposal to meet the TO requirements.
(3). Rating – The application of a scale of words, used in conjunction with the narrative, to denote the degree to which the proposal has met the requirements established by the TO.
h. Color Board – A visual presentation consisting of samples of the various finishes, grouped together based on location within the project. Samples shall be of adequate size to show the full pattern, texture, and color of each item.
i. Conventional Design-Build – The process by which the same contractor provides both the design and construction services for a project, completing the design before construction activity begins.
j. Design Costs – Those costs identified by the contractor which represent the portion of the overall project cost attributed to preparation of the design and construction documents (level of design to be determined per TO).
k. Designer of Record (DOR) - The individual accountable for specific portions of the design documents. When professional certification is required for the design, the Designer of Record would be the individual providing certification for that portion of the design. When professional certification is not required, the Designer of Record would typically be the individual who provided the design or specifications for a particular aspect of the project (i.e., architectural, civil, structural, mechanical, or electrical).
l. Fair Opportunity Proposal Request (FOPR) – A FOPR will be issued to solicit all projects under the MACC, subsequent to contract award of the “seed” project. The FOPR will define the project requirements and may require the contractor to produce a full design, partial design, or no design depending on the level of design already available, and provided to the contractor in the FORP.
m. Fast Track Design-Build – The process by which the same contractor provides both the design and construction services for a project, beginning construction at a mutually agreed point prior to completion of the design and construction drawings.
n. Government Furnished Equipment (GFE) / Government Furnished Material (GFM) – Items of equipment or material which the government will supply to the contractor for use in the construction of a project.
o. Investigative Costs – Those costs identified by the contractor which represent the portion of the overall project cost attributed to all investigative services necessary to prepare the design and construction documents (level of design to be determined per TO).
p. Investigative Services – For exterior work / new facilities, the investigative services will typically include but are not limited to performing a survey of the project site including topography, cross sections, drainage survey, and bench level circuit. In addition, it may include verification and documentation of the location and size of all existing utilities and pertinent surface features for inclusion on the topographic survey map. For exterior and interior work, the investigative services should also include verification of all existing conditions affecting the design and execution of the work as described in the FOPR.
q. Professional Certification – The process of affixing a seal or statement to a drawing or design document to indicate that the work to which it is affixed has been performed by a person licensed as a professional, in that area of expertise, in the state of North Dakota, or as otherwise indicated in the FOPR.
r. Statement of Work (SOW) – A document prepared by the Government and issued to the contractor as part of the FOPR which defines the specific technical requirements for the project.
s. Authority to Advertise (ATA) – Under this authorization, the Contracting Officer may issue solicitations for facility project requirements when award of the contract is anticipated in the current fiscal year or early in the next fiscal year. Funds may not be currently available but are expected to be available during the current fiscal year, or early in the next fiscal year. If funds cannot be provided, the solicitation will be cancelled.
t. Task Order (TO) – A document prepared by the government and issued to the contractor which contains the general requirements and parameters of the proposed project. Included in the Task Order is the Statement of Work defining specific technical requirements for the project as well as information such as budget limitations, type of solicitation, design certifications, and drawings required to be prepared by the contractor.
2. DESCRIPTION OF WORK:
a. Contract Scope: The MACC will be utilized to execute a broad range of maintenance, repair, minor construction design, and/or build projects on real property at Minot AFB, North Dakota to include the 8.5K square mile missile field in the areas surrounding Minot AFB. Each project will be further defined in individual task orders (TO). The projects will require work to be performed in the general construction category and includes but is not limited to the following: maintenance, repair, alteration, mechanical, electrical, heating/air conditioning, demolition, painting, site work, earthwork and paving, cast-in-place concrete, masonry, structural steel, fire protection, millwork, and other specialty and general contracting work.
b. Authority To Advertise (ATA) Task Orders: A solicitation issued under ATA is not guaranteed an award, but there is reasonable expectation that funding will be made available. Contractors submitting a proposal/bid must provide an acceptance period as indicated in the solicitation that will allow award of the TO at the end of the fiscal year or early into the next fiscal year. If the project is awarded prior to expiration of the acceptance period, the contractor will be issued a TO to perform the design work and accomplish the construction. If funding to award is not made available, the solicitation will be cancelled, and no award will be made.
3. CONTRACTOR OPERATIONS: The Contractor shall conduct all operations in accordance with this Statement of Work. In addition, each TO will include a Specification Section 01010, Summary of Work, that will detail the work requirements and conduct of operations for that particular TO. TOs that include the performance of design work will also include a Specification Section 01011, Design Requirements, which will detail the necessary elements of design as well as the design submittal requirements.
4. COMMENCEMENT, PROSECUTION AND COMPLETION OF WORK: The contractor shall commence work and complete the project in accordance with the time frames established in the individual TO and respective Notice to Proceed (NTP).
5. DESIGN DOCUMENTS, GENERAL: The design documents developed by the contractor shall comply with the following requirements:
a. Drawings:
(1). The contractor shall receive one copy of the appropriate record drawings (electronic only) if available, with the TO. Record drawings will be available to the contractor for their reproduction. The Government does not guarantee the accuracy or adequacy of the existing as-built drawings. It is the Contractor’s responsibility to field-verify all as-built drawings during preliminary site visits and planning of the project. The Contractor shall be responsible for the reproduction of these drawings as needed.
(2). The TO will identify the sizes of drawings, either Standard D (24” x 36”) or Standard B (12” x 18”), to be submitted with the proposal and each subsequent review milestone (65%, 95%, and 100%). The contractor shall supply all contract drawings prepared using AutoCAD software (version 2014 or previous). Line quality shall not be half-toned or gray scaled below 75%. Drawings produced using another software package will be acceptable provided all drawings are converted to standard AutoCAD drawing file format prior to receipt by the Government and comply with the Minot AFB CAD standards and U.S. Army Corps of Engineers (USACE) CAD Standards v 6.0. Minot AFB CAD standards are presented in the Minot Design Compatibility Guidelines (Minot DCG). In addition, the Contractor shall comply with the following standards:
a. Drawing files shall be delivered in the standard AutoCAD “.dwg” file format for AutoCAD (version 2014 or previous). “Model space” shall be the preferred method for drafting all drawing items such as floorplans, sections, details…. Dimensions, leaders, and notes… specific to the drafted item shall accompany the object drawn in “Model Space” and be scaled accordingly to appear in paper space at the correct text height as specified. Only general notes applicable to the entire drawing shall be drawn in paperspace. Drawing units shall be set according to the requirements for the drawing discipline; i.e., civil drawing units shall be set to the decimal format, and architectural drawings set to the architectural format. Civil site plans shall be in World Geodetic System (WGS) 84, UTM 14N, with all site plans oriented with north at the top of the sheet. Any reorientation of a view for drafting convenience shall be done within the viewport using the “Dview” and “Twist” commands. Objects in model space shall not be rotated. The Contractor shall supply a written explanation as to how externally referenced drawings are used, view-port scales/settings, viewport layer settings, blocks, and any other relevant information necessary for the Technical Support Section at Minot AFB to make changes or updates to the drawings. The Contractor must also be available for phone assistance to clarify any other problems encountered by the Technical Support Section. “Paperspace” shall be used to format the final plotted drawing sheet. Standard plotted paper size shall be a “D” size sheet unless otherwise specified. All drawings shall use the standard Minot AFB project title block. The title block shall not be altered by the contractor. Only TO specific data shall be edited within the title block.
b. All drawings shall be submitted on CD-ROM or DVD-ROM disks. If disks are delivered at various stages of the project, they shall be labeled accordingly, i.e., 65% review, 100% for construction, or As-Built.
c. All External Referenced (XREF) drawings shall be located and linked correctly to ensure the xref will load properly. Multiple xref drawings will be allowed, but nested xref drawings shall not be used. XREF drawings shall be drawing files separate from the drawing files to which they are attached. Xref drawings shall not contain other xref drawings, i.e., nested externally referenced drawings. The Contractor shall provide complete typewritten instructions for reintegrating the drawings and must specify which XREF goes with which drawing.
d. All lettering (text) shall be sized so that finished drawings, prior to half-scale reduction, incorporate text sizes of 1/2-inch for major titles, 1/4-inch for titles, 1/8- inch for notes, and 3/32-inch for dimensions. Larger text sizes may be used as part of the Title Sheets only. Text fonts shall be as determined in the CADD standards identified in the Minot DCG. Only text fonts/styles native to the basic AutoCAD package shall be used. No unique fonts or styles developed by the Contractor or design firm shall be used. All detail notes, leaders, and dimensions must be legible when reproduced at half scale.
e. The Contractor shall be provided a copy of layer standards utilized by the Minot AFB Execution Support Section upon request. All layers shall have narrative descriptions easily identified (i.e., walls, elec., etc.).
f. Use of third party development software is acceptable provided all drawing files submitted are in native AutoCAD format. Any features peculiar to the development software used, such as shape files, menus, blocks, etc. that are not accessible using the basic AutoCAD package are not acceptable and shall be modified to ensure the drawing files may be easily edited or changed by government personnel using the basic AutoCAD software package.
g. Final AutoCAD drawing files should exhibit good drafting practice allowing for minimal storage requirements. Drawings should make use of features to limit drawing size/complexity wherever possible. Over-detailing (drawing features that are not discernible at full or half scale reproduction) is not acceptable and must be avoided.
h. Each drawing file will contain only one final plotted drawing sheet. Drawing files shall have no more than one layout tab.
i. Submitted drawing files shall be accompanied by a complete hard copy list of drawing file names, layers used, etc. The project number and list of drawings contained on each disk will be written on a label affixed to the disk. Drawing file name shall be in accordance with the Minot DCG standards.
j. All contract drawings to be furnished shall be well prepared, complete, and accomplished in accordance with the best professional practice to show clearly and concisely the type and extent of work to be performed. All drawings shall be drawn to appropriate scales and dimensioned completely and accurately. Extensive explanatory notes on the drawings are undesirable and should be placed in the specifications. The use of fractions less than 1/8” for building dimensions will be avoided. Standard building material indications and standard symbols for civil items and for electrical equipment shall be used to the greatest extent possible.
(3). Throughout the design process, each submittal shall be clearly identified as to the level of completion (i.e., 35%, etc.). The “revisions” blocks on the plan sheets shall not be utilized to document changes to the drawings until after the 100% design is completed and accepted by the government.
(4). The Contractor shall prepare drawings, as specified in the TO, for Government approval prior to the start of construction. The drawings developed by the contractor beyond the 35% point shall conform to industry standards relating to good design and drafting practices. All completed drawings shall clearly identify the work being performed under the TO. All project drawing sets shall contain a “key plan” that indicates the location of the work to be performed. The key plan may be shown on the cover sheet with the location indicated within an overall plan of the base site plan. The key plan should indicate the planned route for hauling materials within the base road system. For smaller projects within a larger building/facility, include a plan of the larger facility that shows the location of the specific work within the larger facility. Each sheet shall have an approved title block and border with professional certification when required by the TO. The title block shall contain project information including, but not limited to, Project #, TO #, Project Name, and submitted date. Basic design criteria utilized for each discipline will be included on the appropriate drawings as required by the TO. Examples would include wind and live/dead loads assumed for structural elements, function specific conditions such as lighting levels or future use considerations for electrical systems, site specific climatic design conditions for mechanical systems, and International Building Code analysis (performed to the same level as if being applied to a building permit process). b. Specifications:
(1). For projects requiring design, the technical specifications to be utilized by the contractor shall be the Unified Facilities Guide Specifications (UFGS) as well as the MACC Master Specifications. The TO shall include the minimum specification sections required by the Government to be included in the design package. The specification sections included in the TO will be in draft format, and the Contractor will be required to finalize each section during the course of project design to reflect specific design requirements. In the course of project design, the Contractor may supplement the Government provided specifications with other sections of the UFGS that represent elements of work included in the project. The UFGS sections are available in full at www.wbdg.org. The complete set of project specifications to include those sections provided by the Government as well as any supplemental sections added by the Contractor shall be included in each design submittal as required by the TO.
(2). In addition to the technical specifications described above, the latest version of the following references are to be utilized in the preparation of project designs;

Applicable manufacturer or industry specifications or recommendations associated with material, supplies, or systems shall be incorporated as well. If a discrepancy exists between these documents, the contractor shall bring this to the attention of the Contracting Officer and shall utilize the most stringent requirement(s) in the preparation of the project design.
During the course of a project, in both the design and construction periods, the building codes, Architectural Standards and UFCs will take precedent over the SOW.
(3). A footer shall be placed at the bottom of each page of each section of the project specifications indicating the following information:

(4). At the end of each section of the project specifications, the following statement shall be placed, centered and two lines below the last sentence of the last paragraph:

(5). The use or specification of materials not made in the United States is prohibited. Only American made products shall be used in all work under this contract.
(6). The TO shall include an AF Form 66, Schedule of Material Submittals (Form 66). This Government furnished Form 66 identifies the minimum submittal items that shall be provided by the Contractor for Government review and approval in accordance with Section 01010 and 01011 requirements. During the course of design and specification development, the Contractor shall append the Form 66 to include all items as required by the project specification sections to be submitted by the construction contractor for government review and approval prior to installation. The Government will provide the Form 66 in Microsoft Excel format for this purpose. The complete appended Form 66 generated during the design shall be included with the Contractor’s edited specifications in each design submittal as required by the TO for Government review and approval.
c. Design Analysis:
As specified in the TO, design calculations may be required, to include code references, as applicable for each discipline, to show compliance. The design analysis shall be included in each design submittal as required by the TO. The following is a list of calculations which might typically be required under this contract. The number of copies needed for the design analysis will be annotated in the SOW or TO.
(1). Civil/Site work:

(4). Electrical:

(6). Others as applicable to a specific project and identified in the TO.
d. Perspective Drawing:
(1). When required by the TO, the Contractor shall prepare a black line concept perspective computerized drawing and/or a rendered (color) perspective computerized drawing of the project. The perspective shall be delivered at the design stage as identified in the FOPR.
(2). The final colored rendering (if required) shall be approximately 19” x 28” frame size and shall include frame, 3” matting, non-glare glass, and hanging hardware.
(3). The black-line concept perspective shall be provided with the contractor’s bid/proposal as part of the 35% submittal, if required. The rendered perspective shall be prepared by the successful contractor and delivered with the final design submittal when requested.
e. Sustainable Design:
As specified in the TO, some projects will be required to incorporate sustainable design principles into the function and design. Air Combat Command Headquarters (ACC HQ) developed a consolidated tool - The ACC Sustainable Design & High Performance Green Building Scorecard to help ensure that these principles are being incorporated into projects. The sustainable direction comes from several different mandates such as EISA 007, MOU, EPAct 2005, and the U.S. Green Building Council’s (USGBC) LEED® (Leadership in Energy & Environmental Design) Rating System. The TO will provide specific guidance as to sustainable design requirements.
f. Leadership in Energy & Environmental Design (LEED):
The TO will specify if LEED certification is to be achieved and to which level for that project. The USGBC’s online project management tool, LEED Online (http://www.leedonline.gbci.org/), will be used to manage, compile, and maintain all documentation to support LEED certification.
6. PROGRESS OF WORK: Once awarded Notice to Proceed for Construction, the successful contractor shall submit for approval all work schedules to the Contracting Officer within ten calendar days after start of work unless otherwise specified. The reports contemplated by the clause titled “Schedules for Construction Contracts” shall be accomplished on and in accordance with instructions pertaining to AF Form 3064, Contract Progress Schedule, and AF Form 3065, Contract Progress Report. This requirement is applicable to a TO with a minimum performance period of 60 calendar days and a minimum dollar value of $250K unless specified by the Contracting Officer.
7. MATERIAL APPROVAL SUBMITTALS
a. Technical Data, Samples, and Color Boards:
All equipment, products, material, and articles requiring approval, as indicated on the AF Form 66, shall be submitted by the contractor using AF Form 3000. All wall covering, carpet and other fabric type submittals will show the full pattern of material, as a minimum. When required by the TO, all applicable product samples shall be submitted on a color board grouped to correspond with the anticipated installation, i.e., floor covering, paint, paneling, chair-rail, wall covering and ceiling tile. The contractor shall include technical data with the products presented on the color board so that the items may be approved for technical compliance as well as architectural compatibility. Contractor is responsible for identifying and locating required materials for submittals to include matching any existing materials.
b. Designer of Record Approval:
When required by the TO, the DOR shall review and approve equipment, product, or material submittals and indicate compliance with the design documents prior to the submittal being forwarded to the government for review. Those submittals requiring DOR approval shall be included on the AF Form 66. (Re: Paragraph 5.b. (6) above)
8. AS-BUILT DOCUMENTS:
a. Drawings:
During the progress of the work, the contractor shall keep an accurate record at the job site of all changes and deviations to the layouts shown on the drawings. The contractor shall manually enter such changes and corrections on record drawings promptly. Upon completion of the project, the contractor shall provide the government with draft and final as-built drawings in accordance with the TO requirements.
b. GPS Data:
The contractor shall furnish survey data showing the horizontal/vertical location of all site improvements constructed under the Task Order to include, but not limited to, topography, buildings, pavements, utilities, and all similar construction. Site improvements such as buried utility lines require one survey shot every 50’ of straight line at each turn or bend in the line, hydrants, fittings, valves, valve boxes, curb stops, relocations and crossings of existing utilities, structures, or other appurtenances relocated or affected by the construction. Also provide elevations for the topmost point of visible appurtenances such as fire hydrants and valve boxes, and provide rim and invert elevations for all manholes in the project area. The contractor shall use conventional surveying methods such as total stations, automatic levels, or Global Positioning System (GPS) for field data collection at an accuracy of +/-2cm. A copy of all survey data deliverables shall be a submittal item. All survey work shall be tied to the existing grid through the use of on base monuments as published by World Geodetic System (WGS) 84, UTM 14N. Assumed elevations with temporary benchmarks will not be acceptable. Survey deliverables include field notes, field book data, and/or data collector files compatible with Trimble software. Drawing data shall be delivered in an AutoCAD format (UTM 12N, units set to unitless, one AutoCAD drawing unit = 1.0’, decimal unit format), and ESRI geodatabase that must have an external spatial reference (.prj) file attached that specifies the parameters of the coordinate system in standard ERSI format. All electronic data deliverables shall be a CD-ROM in format that conforms to the latest version of both the CADD/GIS Technology Center’s Spatial Data Standards and A/E/C CAD Standards. These standards can be found at:

All AutoCAD files shall conform to the Minot AFB Cad standards and USACE CAD Standards v 4.0. AutoCAD survey drawings layering conventions shall conform to USACE CAD standard for the “V” survey drawings.
c. Close-out Documents:
The contractor shall provide to the government all project close-out documentation in accordance with the TO. Close-out documentation shall include, but is not limited to, a final copy of all submittals (to included approved AF Form 3000s), shop drawings, AF Form 3064s, AF Form 3065s, the final comprehensive construction inspection record, and the DD 1354.
9. OPERATION AND MAINTENANCE MANUALS: For those projects which include mechanical/electrical/ fire protection/specialty systems requiring periodic or routine maintenance, the contractor shall prepare and submit operation and maintenance manuals in accordance with the TO requirements. As a minimum, the manuals shall contain technical data, diagrams, parts listings, maintenance instructions, and the name, address, and phone number of the manufacturer and servicing/replacement parts source. These manuals shall be submitted prior to the final inspection and in accordance with paragraph 7 above.
10. WARRANTY OF CONSTRUCTION:
a. Listing of Warranty Items:
The contractor shall prepare a listing of all equipment or material subject to a manufacturer’s warranty or extended warranty as required by the TO. The listing shall include a description of the item, the expiration date of the warranty, and the point of contact for warranty service. One (1) copy of this information shall be submitted in hard copy and one (1) copy in electronic format (CD ROM) as a project submittal in accordance with paragraph 7.
b. Scope of Coverage:
In addition to any other warranties in this contract, the contractor warrants that work performed under this contract conforms to the contract requirements and is free of any defect in equipment, material or design furnished, or workmanship performed by the contractor or any subcontractor or supplier at any tier. This warranty shall not limit the Government’s rights under the Inspection and Acceptance clause of this contract with respect to latent defects, gross mistakes, or fraud.
c. Period of Coverage:
This warranty shall continue for a period of one (1) year from the date of final acceptance of the work unless otherwise specified in the individual TO. If the Government takes possession of any part of the work before final acceptance, this warranty shall continue for a period of one year from the date of beneficial occupancy. In the event the contractor’s warranty of this clause has expired, the Government may bring suit, at its expense, to enforce a subcontractor’s, manufacturer’s, or supplier’s warranty.
d. Remedies of Defects:
The contractor shall remedy, at the contractor’s expense, any failure to conform to contract requirements or any equipment/material/workmanship defect. In addition, the contractor shall remedy, at the contractor’s expense, any damage to Government-owned or controlled real or personal property when that damage is the result of:
(1). The contractor’s failure to conform to contract requirements or;
(2). Any defect of equipment, material, workmanship, or design furnished.
The contractor shall restore any work damaged in fulfilling the terms and conditions of this clause. The contractor’s warranty with respect to work repaired or replaced will run for one year from the date of repair or replacement.
e. Notification to Contractor:
The Contracting Officer shall notify the contractor, in writing, within a reasonable time after the discovery of any failure, defect, or damage. If the contractor fails to remedy any failure, defect, or damage within a reasonable time after receipt of notice, the Government shall have the right to replace, repair, or otherwise remedy the failure, defect, or damage at the contractor’s expense.
f. Subcontractor and Supplier Warranties:
With respect to all warranties, express or implied, from subcontractors, manufacturers or suppliers for work performed and materials furnished under this contract, the contractor shall:
(1). Obtain all warranties that would be given in normal commercial practice
(2). Require all warranties to be executed, in writing, for the benefit of the Government if directed by the Contracting Officer, and;
(3). Enforce all warranties for the benefit of the Government if directed by the Contracting Officer. Emergency warranty calls shall not exceed a 4-hour response time, while routine warranty response time shall not exceed 3 workdays. The warranty enumerated herein does not preclude any manufacturer warranties in excess of one year as noted in the individual specifications sections. The contractor should read each section carefully to ensure that he/she is aware of all warranties called for in each project.
g. GFE / GFM:
Unless a defect is caused by the negligence of the contractor, subcontractor, or supplier at any tier, the contractor shall not be liable for the repair of any defects of material or design furnished by the Government or the repair of any damage that results from any defect in Government-furnished material or design.
11. PROGRAM MANAGEMENT: Contractor shall provide a program manager and staff for executing TO’s awarded under this contract. The program management staff shall have project design, quality control, and construction and financial management capability. The program manager shall have a minimum of 5 years experience in those capacities and shall have the authority to negotiate delivery orders and modifications thereto and obligate the company to TOs. The program manager shall have the authority to hire/fire subcontractors and must be experienced in subcontract management. The program manager must be available via local phone service throughout the duration of all ongoing TOs, and his/her phone number shall be provided to the government immediately following award of any TO.
12. QUALITY CONTROL PLAN: Contractor’s Quality Control Plan shall be developed and submitted to the contracting officer within 10 calendar days after Notice to Proceed is issued for acceptance to ensure that work is accomplished and all problems are documented and resolved in accordance with the specifications and drawings. The contractor shall designate on-staff personnel as project superintendents to document and resolve all quality control problems and accomplish daily quality control inspections. The contractor shall establish a method to identify poor performance and specify appropriate corrective action. The quality control plan will become a compliance document. Project personnel will interface with Government personnel to ensure that the quality control plan functions properly.
13. DAILY CONSTRUCTION ACTIVITY REPORTS: Contractor shall monitor all aspects of the work accomplished throughout the construction phase of the project to include work performed by subcontractors and make a documented record of activity and observations. The Construction Inspection Record will be submitted at the completion of work or as specified by Contracting Officer. Under all circumstances, a final and comprehensive Construction Inspection Record with all entries completed shall be included with the project close out documents as required under the paragraph “As-Built Documents”.
14. SUBCONTRACTING SUPPORT CAPABILITY: Contractor shall provide subcontractor management including, but not limited to, surveillance, quality control, and scheduling. Subcontractors must be available to ensure quick response times. The contractor must have the ability to manage and control multiple subcontractors at multiple job locations. The contractor must ensure subcontractors are competent and capable of handling all tasks assigned to them and shall ensure that each subcontractor is not assigned more work than they can accomplish satisfactorily.
15. PROJECT EXECUTION AND TECHNICAL CAPABILITY: Contractor shall have a support staff that includes clerical, quality control, project superintendent, drafting and design personnel as necessary to prepare bids/proposals and execute the construction phase of all TOs.
16. FIELD SURVEY REQUIREMENTS: Contractor shall provide all field survey requirements necessary for the efficient and acceptable planning, execution and completion of all work required under the TO to include but not limited to surveys defined under investigative services, construction staking and as-built verification.
17. GOVERNMENT FURNISHED EQUIPMENT/MATERIALS: The Government reserves the right to provide Government furnished equipment/materials (GFE/GFM) that is on hand if it can be used by the contractor to complete a TO. The GFE/GFM shall be transported by the Contractor, from the Government storage area, to the work site indicated on the TO. The contractor assumes the risk and responsibility for the loss or damage to GFE/GFM once the contractor receives possession of the GFE/GFM. The contractor shall follow the instructions of the Contracting Officer or his/her representative regarding the disposition of all GFE/GFM not consumed in performance of a delivery order.
18. GOVERNMENT EQUIPMENT ON THE SITE: All government equipment and material on each project is the property of the Government unless specifically noted otherwise. Contractor shall relocate all property that the Government retains title to on the installation as specified in the TO or follow the instructions of the Contracting Officer or his/her representative. Contractor is required to cover equipment that is to remain in place within the area of contract operations and protect it against damage or loss and store equipment that is removed in performance of work where directed or reuse in work as required by drawings and specifications. Equipment temporarily removed shall be protected and returned equal to its condition prior to starting work at no additional expense to the Government. Security for equipment or material that is to be reused and is removed for temporary storage shall be the sole responsibility of the contractor.
19. DISPOSAL OF WASTE: Loose debris on trucks leaving the site shall be loaded in a manner that will prevent spillage from the vehicle. Fasten suitable cover, such as a tarpaulin, over the load before entering surrounding streets. The contractor shall be responsible for cleaning up any materials that fall from trucks and held liable for any resulting damages. Contractor shall submit, upon request, all trip tickets from the landfill facility to show all debris is being disposed of in accordance with all Federal requirements and in an approved location.
20. CONSTRUCTION SITE MAINTENANCE: The Contractor shall store all supplies and equipment on project site so as to preclude theft or damage. Maintain site in a neat and orderly manner at all times. Protection and security for materials and equipment on site is the sole responsibility of the contractor.
