The government may, however, at its option, replace the affected lock or locks or perform re-keying and deduct the cost of such from the monthly payment due the contractor. In the event a master key is lost or duplicated, the government shall replace all locks and keys for that system, and the total cost will be deducted from the monthly payment due the contractor.
4.9.24. Executive Order (EO) 13423 (Strengthening Federal Environmental, Energy, and Transportation Management). The contractor shall assist in compliance with this EO:
(a) Use of products with post-consumer recycled content
(b) Use of products that are recyclable
(c) Use of low toxicity or non-toxic products
(d) Use and installation of low-maintenance products
4.10. SAFETY REQUIREMENTS AND REPORTS. The contractor shall perform work in a safe manner as required by OSHA Safety and Health Requirements. Provide a verbal report to the CO as soon as possible of each occurrence of damage to Government property or an accident resulting in death, injury, occupational disease, or adverse environmental impact. Provide a completed copy of required Accident Investigation Reports to the CO within five calendar days of each occurrence.
4.11. SPECIAL QUALIFICATIONS. (RESERVE)
4.12. CONTRACTING OFFICER AND CONTRACTING OFFICER
REPRESENTATIVE. (QUALITY ASSURANCE PERSONNEL)
The Contracting Officer will appoint a primary and alternate representative for management of the day-to-day activities of the contract. The identity, title, and authority of this representative will be provided in writing to the contractor after contract award.
4.13. MULTI-FUNCTIONAL TEAM. A multi-functional team will be established between the government and the contractor to ensure cooperation between all parties involved in the execution of this contract. This team typically consists of contractor management, the CO, and COR, and can fluctuate based upon contractual needs.
4.14. PARTNERING AGREEMENT
The CO may require a partnering agreement, or multi-functional team, between the Government and Contractor to facilitate joint cooperation and a sound partnership of all parties involved in the execution of this contract. Partnering is the creation of a Government-Contractor relationship that promotes achievement of mutually beneficial goals. It involves an agreement in principle to share the risk involved in completing the project and to establish and promote a nurturing partnership environment. Representatives from each organization are encouraged to participate in developing a partnering agreement. The partnering agreement that results may be formal or informal. If formal, it should be reduced to writing and signed by the parties involved.
4.15. DAMAGES TO GOVERNMENT BUILDINGS, EQUIPMENT, OR VEGETATION
Damages to government buildings, equipment, or vegetation are addressed in FAR 52.237-2, Protection of Government Buildings, Equipment, and Vegetation.
4.16. NON-PERSONAL SERVICES AND/OR INHERENTLY GOVERNMENTAL
SERVICES. The Government will neither supervise contractor employees nor control the method by which the contractor performs the required tasks. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services or give the perception of personal services. If the contractor feels that any actions constitute, or are perceived to constitute personal services, it shall be the contractor’s responsibility to notify the CO immediately. These services shall not be used to perform work of a policy/decision making or management nature, (e.g., inherently governmental functions). All decisions relative to programs supported by the contractor shall be the sole responsibility of the Government.
4.17. ANTI-TERRORISM. As a prelude and during performance of any contract, it is critical that the contractor be supportive of all DOD requirements to protect personnel and; their families, installations, facilities, information, and other resources from terrorist acts. All contractors and sub-contractors are responsible for providing their personnel information on the (JB MDL) Antiterrorism Program. During performance of work, personnel security and protection of resources is critical for the installation to maintain a safe work environment. Contractor personnel will be alert for any suspicious activity observed by their personnel working on the installation. If any situation appears to be suspicious, immediate actions must be taken to properly notify base Security Forces Squadron Law Enforcement Desk at (609) 562-6000/1/2/3 (McGuire/Dix) or (732) 323-4000 (Lakehurst). The contractor must ensure that contractor personnel and vehicles are strictly controlled during performance of duty. For instance, the contractor shall use reasonable efforts to prevent any personnel or equipment from being placed in harm's way or in a position that could aid or abet terrorists. Contractors are encouraged to contact the JB MDL Antiterrorism Office at (609) 754-1397 or (609) 754-1611 for information regarding the installation Antiterrorism Program.
