GENERAL PROJECT REQUIREMENTS
1.0 Required Insurance (IAW FAR 28.306(b))
Reference FAR clause 52.228-5 -- Insurance -- Work on a Government Installation, "the contractor shall, at its own expense, procure and thereafter maintain the following kinds of insurance with respect to performance under the contract.
(a) Workmen's Compensation and Employers Liability Insurance as required by law except that if this contract is to be performed in a State which does not require or permit private insurance, then compliance with the statutory or administrative requirements in any such State will be satisfactory. The required Workmen's Compensation insurance shall extend to cover employer's liability for accidental bodily injury or death and for occupational disease with a minimum liability limit of $100,000.
(b) General Liability Insurance. Bodily injury liability insurance, in the minimum limits of $500,000 per occurrence shall be required on the comprehensive form of policy.
(c) Automobile Liability Insurance. This insurance shall be required on the comprehensive form of policy and shall provide bodily injury liability and property damage liability covering the operation of all automobiles used in connection with the performance of the contract. At least the minimum limits of $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage shall be required.
(d) The Certificate of Insurance shall provide for thirty (30) days written notice to the contracting officer by the insurance company prior to cancellation or material change in policy coverage. Other requirements and information are contained in the aforementioned “Insurance” clause.
1.1 Subcontracting Responsibilities
The contractor shall be responsible for the management and performance of all subcontractors. The contractor shall ensure that all work elements are completed within the stated requirements.
1.2 Performance and Payment Bonds
Contractor shall furnish Performance and Payment Bonds (Standard Form 25/25A) from authorized sureties only;
the list can be obtained at http://fms.treas.gov/c570/c570_a-z.html#i. A notice to proceed shall not be issued and no work shall begin until good and sufficient surety has been received and accepted by the contracting officer.
Contractors shall refer to 52.228-13 Alternative Payment Protections and 52-228-15 Performance and Payment Bonds – Construction for further guidance.
1.3 Proposal Guarantee (BID BOND)
Individual proposal guarantees (bid bonds) of at least 20% of the proposed price shall be required from all offerors competing for award.
1.6 Installation Rules and Regulations
The rules and regulations of the installation where services are performed shall apply to the contractor and his employees while on the premises of such installation. These regulations included but are not limited to: presenting valid identification for base entrances, state registration and covered insurance for contractor-owned and/or privately owned vehicles, obeying all posted directives, and providing strict adherence to security police direction in instances where security police have been dispatched to a particular location.
1.7 Utility Services (IAW FAR 36.514)
The contractor will be required to participate in Air Force energy and water conservation programs. Utility services are normally furnished to the contractor at no cost; however, see contract clause titled FAR 52.236-14, “Availability and Use of Utility Services.” All connections are the responsibility of the contractor. At construction sites where utilities are not available, the contractor is responsible for furnishing temporary utilities (portable generators, etc.).
1.8 Designation of Government Inspector
The Base Civil Engineer or his authorized representative is designated as the representative of the contracting officer for the purpose of performing construction contract quality assurance for the government, which includes performing technical surveillance, monitoring workmanship, verifying compliance with plans and specifications, and tracking progress. This provision in no way authorizes anyone other than the contracting officer to commit the government to changes in the terms of this contract.
1.9 Contractor Consent to Background Checks
The contractor and, as applicable, subcontractor shall not employ persons for work on this contract if such employee is identified as a potential threat to the health, safety, security, general well-being or operational mission of the installation and its population, nor shall the contractor or subcontractor employ persons under this contract who have an outstanding criminal warrant as identified by Law Enforcement Agency Data System (LEADS) through the National Crime Information Center. LEADS checks will verify if a person is wanted by local, state, and federal agencies. All contractor and subcontractor personnel must consent to LEADS background checks. Contractor and subcontractor personnel who do not consent to an LEADS check will be denied access to the installation.
Information required to conduct an LEADS check includes: full name, driver’s license number, and/or social security number, date of birth of the person entering the installation, and completion of a background check questionnaire. The contractor shall provide this information using the Scott AFB Form 21, Contractors Consent for Background Check, and shall submit it in conjunction with the contractor’s request for either base or vehicle passes.
Completion of a successful LEADS check does not invalidate the requirement for an escort when contractor or subcontractor personnel are working within controlled or restricted areas.
Contractors shall ensure their employees and those of their subcontracts have the proper credentials allowing them to work in the United States. Persons later found to be undocumented or illegal aliens will be remanded to the proper authorities. The contractor shall not be entitled to any compensation for delays or expenses associated with complying with the provisions of this clause. Furthermore, nothing in this clause shall excuse the contractor from proceeding with the contract as required.
1.10 Contractor Registration of Vehicles on Scott AFB
All contractor or contractor employees’ vehicles used for the performance of this contract shall comply with all local, state and federal regulations. Additionally any pass shall be surrendered to Security Forces upon demand to positively identify a person’s need to be on Scott AFB.
1.11 Access to Installation during Force Protection Conditions (FPCONs) Contractors will be assigned a mission essential designation IAW requirements contained in SAFBI 31- 101/Installation Security Instruction. Only the installation commander or the unit commander requesting contract support will assign the mission essential designation.
1.12 Property Protection
Property protection for facility where the contractors’ primary work center is located will be the responsibility of the local facility manager and local Government Security Manager, or their duly authorized representative IAW AFI 31- 401, Security Program Management and command/local directives. The contractor shall safeguard all government-owned equipment and materials in his/her possession or use.
1.13 Safeguarding Classified or Unclassified Information
The contractor shall meet Air Force standards for storing, processing, and handling classified information and systems. Additionally, all resources (e.g. maps, publication/instructions, photos) provided by the government to assist the contractor in the performance of their contract will be surrendered upon termination of employment or the end of the contract performance period.
1.14 Non-Disclosure Agreements
To safeguard information, the contractor shall enter into non-disclosure agreements with the responsible local security manager.
1.15 Privacy Act
Work on this project requires that personnel may have access to Privacy Information. Personnel shall adhere to the Privacy Act, Title 5 of the U.S. Code, Section 552a and applicable agency rules and regulations.
1.16 Base Passes
In accordance with (IAW) FAR 52.232-5(e) and AFFARS 5352.242-9000, all issued base passes shall be returned upon contract completion to the Contracting Officer. Questions regarding payment and base pass collection may be directed to the Contract Specialist. Failure to comply with incorporated clauses, as well as local policy pass collection procedures, may result in withholding of final payment.
1.17 Contractors Working in Controlled or Restricted Areas
The unit requesting contract support will provide escort (s) for contractors’ at all times when within a controlled area. Contractors shall not escort other contractor employees within controlled or restricted areas. In addition, contractors shall fulfill, maintain, and comply with all security requirements IAW AFI 31-401, Security Program Management, and command/local directives.
1.18 Contractors Responsibilities while Working within Controlled or Restricted Areas Only contractor personnel with proper authority and qualifications shall enter a controlled or restricted area. Certain facilities require the issuance of an AF Form 1199. The government, at any time, may revoke the AF Form 1199.
Contractors shall not escort other contractor employees within controlled or restricted areas. In addition, contractors shall fulfill, maintain, and comply with all security requirements contained in AFI 31-401, Security Program Management.
1.19 Access to Government Facilities with Controlled or Restricted Areas The contractor shall comply with security regulations imposed by the installation commander and/or the agency responsible for the project location. Due to specific mission requirements inherent in the nature of controlled or restricted areas on Scott AFB, the government may direct the contractor to leave the controlled or restricted areas at any given time.
1.20 Access to Government Facilities with Controlled or Restricted Areas for Replacement Contractors The unit requesting contract support will continuously escort replacement contractors, not initially possessing the proper clearances and requiring entry to controlled or restricted areas. Replacement contractors shall submit paperwork within 30 days of being assigned to obtain an approved security clearance or favorable review.
Replacement contractor personnel shall obtain a security clearance prior to working with, or having direct access to, classified material. In addition, replacement contractor personnel shall obtain a “Favorable review” prior to having access to a Controlled Area. The above information shall be submitted to 375 SFS/SFA.
1.21 Green Procurement Program (GPP)
Green Procurement is a federal acquisition policy that promotes preferred purchasing of environmentally sound products and services that have a reduced effect on human health and the environment. In order to comply with the affirmative procurement requirements of Section 6007 of the Resource Conservation and Recovery Act (RCRA) and Executive Orders 13101 and 13148 (Green Procurement Program (GPP)), the Contractor shall use recycled and recovered materials and products identified in the USEPA's Comprehensive Procurement Guidelines (CPG).
1. The latest CPG product list, and the specific recycled-content requirements for each product, can be found on the USEPA’s website (www.epa.gov/cpg).
2. The Contractor shall provide EPA-designated products containing recovered material unless the item cannot be acquired:
a. Competitively within a reasonable time frame.
b. Meeting the appropriate performance standards.
c. At a reasonable price.
3. Items identified in the USEPA's CPG shall be viewed as the minimum that can be considered when evaluating recycled/reused materials. Other materials and products not listed, but commonly used in industry outside of the government, shall also be considered.
4. Material and product submittals for all recycled-content items shall list the recycled and recovered materials used and the percentage content listed.
5. Additional program elements include:
a. Energy Star products and energy-efficient standby power devices
b. Bio-based products as defined by USDA
c. Non-ozone-depleting substances
d. EPA priority chemicals
