A. Project Title: Multiple Aw ard Paving Contract (MAPC) - Indefinite Delivery/Indefinite Quantity (IDIQ).

B. This acquisition is a Total Small Business Set-Aside w ith aw ard of up to four (4) contracts.

C. Contract performance period is for a base year plus four (4) one-year option periods.

D. The guaranteed minimum amount over the life of this contract is $500 payable to all contract aw ardees follow ing attendance at a mandatory orientation conference (minimum guarantee does not apply to seed project aw ardee).

E. The maximum ceiling dollar amount for all MAPC contracts/task orders aw arded shall not exceed $15M.

F. The "seed project" magnitude is betw een $100,000 and $250,000.

G. Reference block 11. below , performance periods w ill be established per task order.

H. A Bid Bond in the amount of 20% w ill be required for the seed project.

I. Reference Section L, "Instruction, Conditions and Notices to Offerors" for proper proposal preparation and Section M - "Evaluation Factors for Aw ard."

J. All questions must be submitted no later than 10 days before RFP closing date.

K. A Pre-proposal conference/site visit is scheduled for 27 July 2011 at 09:00 am at Bldg 56 Training Room. The conference w ill include a visit to the seed project location.

The completion date is based on the assumption that the successful offeror will receive the notice to proceed by (to be determined in individual task orders, as applicable. The completion date will be extended by the number of calendar days after the above date that the Contractor receives the notice to proceed, except to the extent that the delay in issuance of the notice to proceed results from the failure of the Contractor to execute the contract and give the required performance and payment bonds within the time specified in the offer.

Section H - Special Contract Requirements

SPECIAL CONTRACT REQUIREMENTS

1.1 REQUIRED INSURANCE: Reference FAR clause entitled "Insurance -- Work on a Government Installation, 52.228-5 (Jan 1997)" the Contractor shall, at its own expense, procure and thereafter maintain the following kinds of insurance with respect to performance under the contract.

(a) Workmen's Compensation and Employers Liability Insurance as required by law except that if this contract is to be performed in a State which does not require or permit private insurance, then compliance with the statutory or administrative requirements in any such State will be satisfactory. The required Workmen's Compensation insurance shall extend to cover employer's liability for accidental bodily injury or death and for occupational disease with a minimum liability limit of $100,000.

(b) General Liability Insurance. Bodily injury liability insurance, in the minimum limits of $500,000 per occurrence shall be required on the comprehensive form of policy.

(c) Automobile Liability Insurance. This insurance shall be required on the comprehensive form of policy and shall provide bodily injury liability and property damage liability covering the operation of all automobiles used in connection with the performance of the contract. At least the minimum limits of $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage shall be required.

(d) The Certificate of Insurance shall provide for thirty (30) days written notice to the contracting officer by the insurance company prior to cancellation or material change in policy coverage. Other requirements and information are contained in the aforementioned “Insurance” clause.

1.2 TASK ORDER PERFORMANCE PERIOD: Performance periods will be negotiated for each individual task order.

1.3 PREAWARD SITE INSPECTIONS: Contractors shall inspect project job sites with government representatives. Any deficiencies, conflicts, or other areas of concern existing in the scope of work and/or applicable drawings should be brought to the attention of the contracting officer, in writing. The contractor shall also notify the contracting officer, in writing, upon observing any features in the design that appear to be ambiguous, confusing, conflicting or erroneous.

1.4 NOTICE OF CONSTRUCTIVE CHANGES: No order, statement or direction of the contracting officer, an authorized representative of the Contracting Officer whether or not acting within the limits of their authority, or any other representatives of the government, shall constitute a change order under the “Changes” clause of this contract or entitle the contractor to an equitable adjustment of the price or delivery schedule, unless a change is issued in writing and signed by the contracting officer.

1.5 PRE-DESIGN AND/OR PRE-CONSTRUCTION CONFERENCE: Prior to starting work under a task order, contractors shall meet with the contracting officer and designated technical representative to discuss and develop mutual understandings concerning schedule and performance.

1.6 TASK ORDER ISSUANCE PROCEDURES:

(a) Work under this contract will be ordered by written task orders issued on DD Form 1155 (Order for Supplies or Services) to the contractor by the contracting officer.

(b) Task order numbers will consist of the basic contract number followed by a 4-digit supplemental task order number. The task order number must be reflected on all correspondence related to the task order.

(c) The government will not be obligated to reimburse the contractor for work performed, items delivered, or any costs incurred, nor shall the contractor be obligated to perform, deliver, or otherwise incur costs except as authorized by duly executed Task orders.

(d) Task orders will be firm fixed price and clearly define the specific services to be performed or the performance desired. Each task order may contain additional, site or project specific, provisions. Any such additional provisions shall be a part of the task order request for proposal.

(e) Task order projects may be non-complex performance-oriented tasks requiring minimal design, may be complex construction requiring design development for design-build construction, or any combination thereof. Any estimated quantities provided in project documents are considered informational only. Contractors must validate quantities and all features of work necessary to deliver a complete and functional project. The task order may or may not have traditional plans and specifications but may include sketches, and requests for catalog cuts, and other submittals. The following describes the procedures for each type of requirement the task order could present:

(1) Contractor-Provided Design/Design-Build: The government issues a task order solicitation with a performance-oriented design-build statement of work stating project goals and objectives. Contractors provide an initial ‘concept’ design consisting of drawings, sketches, outline specifications, design analysis, and/or other documentation as required by the task order Statement of Work. Contractors provide a price proposal and proposed performance period. The government evaluates proposals according to task order criteria.

(2) Government-Provided Design/Design-Build: The government provides a design-build statement of work with “bridging” documents representing 10-35% design effort with the task order solicitation. Contractors provide a technical narrative demonstrating approach to design completion and construction to meet project goals and objectives. The technical narrative may require drawings, sketches, outline specifications, design analysis and/or other documentation as specified bythe task order statement of work. Contractors provide a price proposal and a proposed performance period. The government evaluates proposals in according to task order criteria.

(3) Construction Only: Contractors shall be provided a statement of work and/or a fully designed project which may include drawings, specifications, design analysis and/or other documents as specified in the task order solicitation. Contractors provide a price proposal and a proposed performance period. The government will evaluate price proposals according to task order criteria.

(f) Task order solicitations will provide contractors with as much information as possible regarding the existing conditions of the site and any pre-existing structures.

(g) Task orders may be modified by the Contracting Officer. Modifications to task orders will be issued on Standard Form (SF) 30 and cite the task order number.

(h) Participation in all task order solicitations is desired; however, the government recognizes that participation in a task order competition is a business decision. As a courtesy, contractors should notify the contracting officer and provide the reasons they will not participate in a pre-bid site visit or submit a proposal. Participation is monitored and a consistent failure to compete may result in the government not exercising a future option to extend the contract.

1.7 COMPETITION:

(a) Only contractors awarded contract as a result of this RFP will compete for subsequent task orders. Contractors are encouraged to participate in all site visits and submit proposals. To execute fiscal year end projects, the government may solicit offers for projects for which funds are not certified or readily available. Submission of proposals for these acquisitions is discretionary and will have no negative impact on the contractor.

Occasionally, (generally during the last quarter of the fiscal year), the government will solicit offers for projects for which funds are not certified nor readily available. Air Mobility Command refers to these acquisitions as “Special Advance Authority” (SAA) or “Normal Straddle Bid” (NSB) projects. Under SAA funds are not available and may not become available. The government makes no promise to award a contract. If funds do not become available for SAA projects, the Request for Quote is cancelled and no award is made. Under NSB funds may be available in the current fiscal year or the next fiscal year. If a contract is not awarded in the currentfiscal year, it will be awarded in the following fiscal year.(See AFFARS MP5332.7, Contract Funding). Submission of proposals for these acquisitions is at the sole discretion of the respective MACC contractors and their declination to participate in any or all such solicitations will not reflect negatively upon them. This includes projects that are in whole or in part “SAA” projects.

(b) Unless the contracting officer applies the exceptions noted below, each task order will be awarded, as a result of competition to the contractor who offers the best value to the Government considering task order evaluation criteria. The contracting Officer’s decision as to the selection for award of a task order is not protestable unless the protest is on the grounds that the order increases the scope, period, or maximum value of the contract program.

(c) The contracting Officer reserves the right to award a task order without competition based upon a determination that:

(1) The agency need for the supplies or services are so urgent that providing a fair opportunity would result in unacceptable delays;

(2) Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services being ordered are unique or highly specialized;

(3) The order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

1.8 DESCRIPTION OF SUBSEQUENT TASK ORDERS

(a) Task orders may range from $2,000 to $3,000,000, with most falling in the range of $50,000 to $500,000. Task order projects may require either a single discipline or multi-disciplined design services. Most projects may require only minimal design.

(b) Technical narratives, if required, may address one or more of the following factors:

- Design

- The contractor’s technical understanding of the work.

- The most efficient and effective plan to accomplish the work.

- Rationale for proposed materials, type and quantities.

- Sustainable design features

1.9 SUBSEQUENT TASK ORDER EVALUATION CRITERIA: Subsequent Task orders may be awarded on best value, either tradeoff process or low price, technically acceptable. If the government decides to issue the Task order as a best value using the trade off process, award factors will vary depending on the unique requirements of each Task order. One or more of the following criteria in addition to Price or Cost may be considered:

(a) Past Performance - Task order past performance or prior past performance on other contracts

(b) Quality of Deliverables

(c) Ability to Meet Schedule Requirements

(d) Relevant Experience

(e) Cost Control

(f) Potential impact on other orders placed with the contractor

(g) Current workload

(h) Design

(j) The contractor’s technical understanding of the work.

(k) The most efficient and effective plan to accomplish the work.

(l) Rationale for proposed materials, type and quantities.

(m) Sustainable design features

1-10 BACKGROUND CHECKS

(a) The contractor and, as applicable, subcontractor shall not employ persons for work on this contract if such employee is identified as a potential threat to the health, safety, security, general well being or operational mission of the installation and its population, nor shall the contractor or subcontractor employ persons under this contract who have an outstanding criminal warrant as identified by the National Crime Information Center (NCIC). NCIC checks will verify if a person is wanted by local, state, and federal agencies. All contractor and subcontractor personnel must consent to NCIC background checks. Contractor and subcontractor personnel who do not consent to an NCIC check will be denied access to the installation. Information required to conduct an NCIC check includes: full name, driver’s license number, and/or social security number, and date of birth of the person entering the installation and completion of a background check questionnaire. Completion of a successful NCIC check does not invalidate the requirement for an escort when contractor or subcontractor personnel are working within controlled or restricted areas.

(b) Contractors shall ensure their employees and those of their subcontracts have the proper credentials allowing them to work in the United States. Persons later found to be undocumented or illegal aliens will be remanded to the proper authorities.

(c) The contractor shall not be entitled to any compensation for delays or expenses associated with complying with the provisions of this clause. Furthermore, nothing in this clause shall excuse the contractor from proceeding with the contract as required.

(d) Vehicles. All contractor or contractor employees’ vehicles used for the performance of this contract shall comply with all local, state and federal regulations.

(e) If work is performed in a controlled area:

(1) Only personnel with proper authority and qualifications may enter controlled areas. Certain facilities require the issuance of AF 1199s for contractor personnel.

(2) Contractors will fulfill/maintain all security requirements.

(3) A list of names along with all required personal data will be provided to the Contracting Officer at least 15 working days prior to commencement of work by individuals.

(4) Any changes to contractor employees shall be provided in writing to the Contracting Officer.

(5) The government at any time may revoke the AF Fm1199CD.

(6) The procedures for the issuance of an AF Fm 1199CD can be found in SAFBI 31-101/Installation Security Instruction.

(7) Contractors cannot escort other contractors within controlled or restricted areas

(f) The following is a listing of such facilities but is not all inclusive when SF does it’s review of the contract we will look if the area is a controlled or restricted area.

Flightline: Must obtain AF Fm 1199CD to flightline to perform services.

Bldg 433: Must obtain AF Fm 1199CD to enter facility to perform services.

1.11 DAVIS BACON WAGE DETERMINATION: Individual task orders will be subject to the applicable Wage Determinations as the work dictates at the time of contract award (see Section J, List of Exhibits, Documents and Other Attachments). Upon exercise of an option period, new wage determinations will be incorporated and contractors will be required to comply with the revised wages on future Task Orders. See Contract Clause No. 52.222-30.

1-12 ENVIRONMENTAL COMPLIANCE: Offerors must comply with all applicable federal state, and local environmental statutes and regulations. In addition to the scrutiny of civil environmental regulatory agencies, environmental compliance incidental to Air Force activities or on Air Force Property is subject to Air Force scrutiny. The Air Force routinely investigates environmental violations and noncompliant activities.

1-13 CONSTRUCTION SPECIFICATION FOR GREEN PROCUREMENT: In order to comply with the affirmative procurement requirements of Section 6007 of the Resource Conservation and Recovery Act (RCRA) and Executive Orders 13101 and 13148 (Green Procurement Program (GPP)), the Contractor shall use recycled and recovered materials and products identified in the USEPA's Comprehensive Procurement Guidelines (CPG).

a. The latest CPG product list, and the specific recycled-content requirements for each product, can be found on the USEPA’s website (www.epa.gov/cpg).

b. The Contractor shall provide EPA-designated products containing recovered material unless the item cannot be acquired:

(1) Competitively within a reasonable time frame.

(2) Meeting the appropriate performance standards.

(3) At a reasonable price.

c. Items identified in the USEPA's CPG shall be viewed as the minimum that can be considered when evaluating recycled/reused materials. Other materials and products not listed, but commonly used in industry outside of the government, shall also be considered.

d. Material and product submittals for all recycled-content items shall list the recycled and recovered materials used and the percentage content listed.

1.14 INSTALLATION RULES AND REGULATIONS: The rules and regulations of the installation where services are performed shall apply to the contractor and his employees while on the premises of such installation. These regulations included, but are not limited to:

presenting valid identification for base access, traffic laws, speed limits, and strict compliance with security police direction. Contractors are also advised that pedestrians in designated http://www.epa.gov/cpg crosswalks have right-of-way and only hands-free cell phone use is permitted while driving on the installation.

1-15 UTILITY SERVICES: The contractor will be required to participate in all Air Force energy conservation programs. Utility services furnished to the contractor from the government’s existing system outlets and supplies will be at no cost to the contractor, but see contract clause titled FAR 52.236-14, “Availability and Use of Utility Services,” in Section I.

1-16 SPECIAL UTILITY PROVISION: The contractor shall be responsible for any and all damages to accurately marked utilities resulting from its operations. Further, the contractor shall be held liable for all costs associated with such damages. Such costs include not only the costs to properly repair the damaged utility, but any direct costs incurred by the government to provide emergency response to the site, as well as for any other monetary losses. Such loss may also include the value of loss of productivity experienced by the government due to loss of power and /or facility evacuation arising from the utility damage.

1-17 DESIGNATION OF GOVERNMENT INSPECTOR: The Base Civil Engineer or his authorized representative is designated as the representative of the Contracting Officer for the purpose of monitoring performance and inspection, which includes performing technical surveillance, including workmanship and compliance with the plans and specification under this contract. This provision in no way authorizes anyone other than the Contracting Officer to commit the Government to changes in the terms of this contract.

1-18 PREPARATION OF MATERIAL APPROVAL SUBMITTAL: The submittals contemplated by the clause "FAR 52.236-5, Material and Workmanship," in Section I shall be accomplished on and in accordance with instructions pertaining to AF Form 3000, “Material Approval Submittal.”

1-19 PREPARATION OF SCHEDULES FOR CONSTRUCTION CONTRACTS: Schedules and reports required by FAR Clause 52.236-15 titled "Schedules for Construction Contracts" may be accomplished using AF Form 3064, “Contract Progress Schedule,” and AF Form 3065, “Contract Progress Report” or a commercial project scheduling and reporting program application.

52.209-9 Updates of Publicly Available Information Regarding Responsibility Matters (JAN 2011)

(a) The Contractor shall update the information in the Federal Awardee Performance and Integrity Information System (FAPIIS) on a semi-annual basis, throughout the life of the contract, by posting the required information in the Central Contractor Registration database at http://www.ccr.gov.

(b)(1) The Contractor will receive notification when the Government posts new information to the Contractor's record.

(2) The Contractor will have an opportunity to post comments regarding information that has been posted by the Government. The comments will be retained as long as the associated information is retained, i.e., for a total period of 6 years. Contractor comments will remain a part of the record unless the Contractor revises them.

(3)(i) Public requests for system information posted prior to April 15, 2011, will be handled under Freedom of Information Act procedures, including, where appropriate, procedures promulgated under E.O. 12600.

(ii) As required by section 3010 of Public Law 111-212, all information posted in FAPIIS on or after April 15, 2011, except past performance reviews, will be publicly available.

52.211-12 LIQUIDATED DAMAGES--CONSTRUCTION (SEP 2000)

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount as specified on individual task order for each calendar day of delay until the work is completed or accepted.

(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

52.216-18 ORDERING. (OCT 1995)

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c) If mailed, a delivery order or task order is considered "issued" when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods authorized.

52.216-19 ORDER LIMITATIONS. (OCT 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $2,000, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor:

(1) Any order for a single item in excess of $3,000,000;

(2) Any order for a combination of items in excess of $3,000,000; or

(3) A series of orders from the same ordering office within 30 days that together call for quantities exceeding the limitation in subparagraph (1) or (2) above.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) above.

(d) Notwithstanding paragraphs (b) and (c) above, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 5 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons.

Upon receiving this notice, the Government may acquire the supplies or services from another source.

52.216-22 INDEFINITE QUANTITY. (OCT 1995)

(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum". The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum".

(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after 28 February 2017.

52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 5 working days.

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 15 days (insert the period of time within which the Contracting Officer may exercise the option); provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least days (60 days unless a different number of days is inserted) before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five

(5) years, six (6) months.

52.223-11 OZONE-DEPLETING SUBSTANCES (MAY 2001)

(a) Definition. Ozone-depleting substance, as used in this clause, means any substance the Environmental Protection Agency designates in 40 CFR part 82 as--

(1) Class I, including, but not limited to, chlorofluorocarbons, halons, carbon tetrachloride, and methyl chloroform;

or

(2) Class II, including, but not limited to, hydrochlorofluorocarbons.

(b) The Contractor shall label products which contain or are manufactured with ozone-depleting substances in the manner and to the extent required by 42 U.S.C. 7671j (b), (c), and (d) and 40 CFR Part 82, Subpart E, as follows:

“WARNING: Contains (or manufactured with, if applicable), a substance(s) which harm(s) public health and environment by destroying ozone in the upper atmosphere.”----------------------------

The Contractor shall insert the name of the substance(s).

52.223-14 TOXIC CHEMICAL RELEASE REPORTING (AUG 2003)

(a) Unless otherwise exempt, the Contractor, as owner or operator of a facility used in the performance of this contract, shall file by July 1 for the prior calendar year an annual Toxic Chemical Release Inventory Form (Form R) as described in sections 313(a) and (g) of the Emergency Planning and Community Right-to-Know Act of 1986 (EPCRA) (42 U.S.C. 11023(a) and (g)), and section 6607 of the Pollution Prevention Act of 1990 (PPA) (42 U.S.C.

13106). The Contractor shall file, for each facility subject to the Form R filing and reporting requirements, the annual Form R throughout the life of the contract.

(b) A Contractor-owned or -operated facility used in the performance of this contract is exempt from the requirement to file an annual Form R if--

(1) The facility does not manufacture, process, or otherwise use any toxic chemicals listed in 40 CFR 372.65;

(2) The facility does not have 10 or more full-time employees as specified in section 313(b)(1)(A) of EPCRA, 42 U.S.C. 11023(b)(1)(A);

(3) The facility does not meet the reporting thresholds of toxic chemicals established under of EPCRA, 42 U.S.C.

11023(f) (including the alternate thresholds at 40 CFR 372.27, provided an appropriate certification form has been filed with EPA);

(4) The facility does not fall within the following Standard Industrial Classification (SIC) codes or their corresponding North American Industry Classification System sectors:

(i) Major group code 10 (except 1011, 1081, and 1094.

(ii) Major group code 12 (except 1241).

(iii) Major group codes 20 through 39.

(iv) Industry code 4911, 4931, or 4939 (limited to facilities that combust coal and/or oil for the purpose of generating power for distribution in commerce).

(v) Industry code 4953 (limited to facilities regulated under the Resource Conservation and Recovery Act, Subtitle C (42 U.S.C. 6921, et seq.)), 5169, 5171, or 7389 (limited to facilities primarily engaged in solvent recovery services on a contract or fee basis); or

(5) The facility is not located in the United States or its outlying areas.

(c) If the Contractor has certified to an exemption in accordance with one or more of the criteria in paragraph (b) of this clause, and after award of the contract circumstances change so that any of its owned or operated facilities used in the performance of this contract is no longer exempt--

(1) The Contractor shall notify the Contracting Officer; and

(2) The Contractor, as owner or operator of a facility used in the performance of this contract that is no longer exempt, shall (i) submit a Toxic Chemical Release Inventory Form (Form R) on or before July 1 for the prior calendar year during which the facility becomes eligible; and (ii) continue to file the annual Form R for the life of the contract for such facility.

(d) The Contracting Officer may terminate this contract or take other action as appropriate, if the Contractor fails to comply accurately and fully with the EPCRA and PPA toxic chemical release filing and reporting requirements.
