ENVIRONMENTAL TECHNICAL SPECIFICATIONS

LAUGHLIN AFB

PART 1 GENERAL ENVIRONMENTAL REQUIREMENTS

1.1 SCOPE: These standards apply to all new construction, demolition, rehabilitation, alteration, modification, repair and maintenance of all facilities and infrastructure on Laughlin Air Force Base (AFB) and its geographically separated units (GSUs) in accordance with Laughlin AFB’s environmental requirements.

1.2 ENVIRONMENTAL COMPLIANCE:

A. Compliance with Laws: The Contractor shall comply, and ensure their Subcontractor(s) comply, with all applicable federal, state and local laws, regulations, ordinances and standards related to environmental regulation. In addition, the Contractor and its Subcontractor(s) shall comply with all specific instructions or directions regarding environmental matters as a condition of their work performance. Fines and penalties or administrative actions for non-compliance levied by regulators as a result of negligence or misconduct may be referred for legal responsibility determination.

B. Environmental Management System (EMS) Policy: The 47 Flight Training Wing is committed to providing a safe and healthful workplace while protecting the natural environment and expect the same of Contractors. To do that, Laughlin AFB has established EMS as the framework for continual program and process improvement through clearly defined environmental roles and responsibilities, planning requirements, budgeting, effective implementation and operation and management review. Laughlin AFB has identified significant aspects of the environmental program discussed in the below section.

1.3 CONTRACTUAL REQUIREMENTS

A. Hazardous Materials:

1. List of all materials: The Contractor shall provide the hazardous materials office (HAZMO) a list of all hazardous materials (HM) that the Contractor will bring onto government property. All HM brought onto Laughlin AFB and its GSUs must be processed for authorization/approval through the HAZMO located in building 75, (830) 298-4351.

2. Safety Data Sheets (SDS) PRIOR TO USE:

a. Contractors shall comply with the Laughlin AFB Form 3952 registration process for all HM. HAZMO approval shall be maintained for each hazardous chemical listed in Occupational Safety and Health Administration (OSHA) Hazard Communication Standard (HCS 2012) 29 CFR 1910.1200 (revised).

b. The Contractor shall provide copies of all SDS’s to the Contracting Officer (CO), Contracting Officer Representative (COR) and/or the Project Manager and to HAZMO.

3. Reporting of Material Usage: The Contractor shall report quantity of the HM used to HAZMO, along with the disposition of the containers. The base will use the information for the reporting requirements for “toxic” chemicals under the Emergency Planning and Community Right to Know Act.

Contractors shall report usage at least quarterly.

4. Storage of HM/Hazardous Waste (HW): All HM, HW and flammable materials must be properly stored in accordance with the SDS. Liquid HM/HW must be stored in an area with proper secondary containment.

B. Hazardous Waste:

1. HW Training: Contractors that plan to generate HW shall provide proof of personnel hazardous waste training to the CO. All hazardous waste generated on Laughlin AFB shall be reported to the Project Manager.

2. Hazardous Waste Satellite Accumulation Point (SAP): Any Contractor who will accumulate and store HW on Laughlin AFB or its GSUs, as defined by the applicable 40 CFR, must establish an SAP.

The Contractor is responsible for providing a safe and restricted HW storage area. Any Contractor who must establish a hazardous waste SAP shall contact 47th Civil Engineer Environmental Element (47 CES/CEIE), for instructions and coordination.

3. Disposal of Hazardous and Special Wastes Generated by the Contractor:

a. Hazardous Waste: The Contractor shall identify, characterize, containerize, store and dispose of hazardous wastes in strict accordance with all applicable federal, state and local laws (including AFI 32-7086). A Uniform Hazardous Waste Manifest shall be used by the Contractor to document all parties and locations involved in the transportation, storage and disposal of all hazardous wastes.

b. Asbestos and Lead Base Paint (LBP) Waste: Asbestos or LBP containing waste shall be identified, characterized, containerized and disposed of by the Contractor in strict accordance with all applicable federal, state and local laws (including AFI 32-1052). A Waste Shipment Record shall be utilized for the shipment of asbestos and LBP wastes. If the Contractor intends to reuse or resell any materials containing LBP, he/she must fully disclose the presence of LBP during the exchange of ownership.

d. Manifests: All manifests shall be provided to the government by the Contractor and signed by the Base Hazardous Waste Program Manager (or individual delegated authority to sign) before the waste is transported from the limits of government property. A copy of the manifest and/or waste shipment record shall be signed by the receiver of the waste and submitted to the CO not later than 45 days from the date of signature of receiving facility. The signed original shall be submitted to 47 CES/ CEIE within the same time frame.

4. Hazardous Waste and Toxics Encountered by the Contractor: The Contractor shall notify the CO upon encountering any material not identified in the contract documents thought to be hazardous that could jeopardize the safety of workers or personnel in the area. The Government shall be responsible for characterization, transportation, storage and disposal of the waste if necessary.

a. Toxics (Asbestos and Lead Based Paint): Use of any asbestos containing materials (ACM) is prohibited. The regulated level for ACM is >1% content. No paint with a lead content of 0.06% or greater will be used in any capacity.

i). Toxics Encountered by the Contractor: All necessary precautions will be taken to avoid disturbing material that may contain friable asbestos. If material is encountered which may contain friable asbestos, all work, which would disturb this material, shall cease and the CO shall be notified immediately. Any disturbed surface, which contains any measurable quantity of lead, requires compliance with regulations. If material is encountered that may contain LBP, all work which would disturb this material shall cease and the CO shall be notified immediately.

ii). Asbestos and LBP Removal: Compliance with the Laughlin AFB Asbestos Operations and Management Plan is required. If abatement and/or removal of ACM is necessary, an Asbestos Hazard Abatement Plan shall be submitted by the Contractor to the CO for review by 47th Medical Operations Squadron Bioenvironmental Engineering Flight (47 MDOS/SGOJ) and 47 CES/CEIE before work. If the Contractor plans on disturbing (sanding, cutting, demo) surface containing LBP or abatement is planned, a Worker/Area Protection Plan shall be submitted by the Contractor to the CO for review by 47 MDOS/SGOJ and 47 CES/CEIE before work. Removal shall be conducted by properly trained personnel as required by regulations. Copies of sampling results shall be provided to 47 MDOS/SGOJ. 47 MDOS/SGOJ has the right to evaluate the acceptability of removal projects, to collect duplicate samples at the government expense and to monitor area containment and sampling to ensure the protection of Air Force personnel, the public and the environment.

vi). State Notification: The Contractor shall notify the Department of State Health Services (DSHS) abatement activities via DSHS 10 day notification form. The Contractor shall notify 47 MDOS/SGOJ and 47 CES/CEIE prior to the start of work. A copy of the state required 10-day-prior-to-start-of-removal-notification shall be used for the notification. The contractor is responsible for the fees associated with the state notification.

C. Spill Reporting: Spills of hazardous waste, hazardous materials or non-regulated materials (such as oils, antifreeze, grease, latex paint, hydraulic fluid, etc.) which contaminate soil, surface waters, ground water, and/or air shall be reported to Base Fire Department, (830) 298-5633, immediately.

D. Nuisance and Polluting Activity Prohibited: Polluting, dumping, or discharging of any harmful, nuisance, or regulated materials (such as concrete truck washout, vehicle maintenance fluids, residue from saw cutting operations, solid waste and hazardous substances, runway rubber removal, etc.,) into building drains, site drains, streams, waterways, holding ponds or to the ground surface shall not be permitted and the Contractor shall be held responsible for any and all damages which may result. Concrete truck washout, procedures shall occur off Laughlin AFB and its GSUs. Further, the Contractor shall conduct activities in such a fashion which avoids creating any legal nuisance. Including but not limited to, suppression of noise and dust, control of erosion and implementation of other measures as necessary to minimize off site impacts of work activities.

1. Laydown Areas: The Contractors and Subcontractors that require a laydown area must submit a request for a designated construction laydown area prior to mobilization. The request will be submitted to the CO and then routed for approval through the Project Manager and the Community Planner. 47 CES/CEIE will be consulted by the Community Planner during the approval process. The request must include size, type of materials to be stored and any other site requirements the Contractor may need. The laydown area must be secured and within the perimeter designated by Laughlin AFB.

2. Contractor Vehicles: Contractor owned vehicles should adhere to established haul routes.

Contractor should minimize driving in areas other than their construction site and for official business only, in order to minimize the disturbance of natural resources. If developed or undeveloped areas are disturbed or damaged, the Contractor shall be responsible for restoring the areas to their original condition. The Project Manager will accept condition of the area during closeout.

E. Digging: Any Contractor that will be digging are required to complete an Air Force Form 103, Base Civil Engineering Work Clearance Request. Any digging at an installation restoration program (IRP) site will be reported to Air Force Civil Engineer Center CZO (AFCEC/CZO) (830) 298-5596 or

AFCEC/CZR, (210) 395-8565.

1. Artifacts and/or Remains: Contractor personnel that make a potential cultural discovery should:

• Immediately notify 47 CES/CEIE, (830) 298-5694 of the nature and location of the discovery

• Establish an appropriate buffer zone around the location

• Immediately cease potentially damaging activities and take efforts to ensure protection of resources until arrival of the CRM or designee.

F. Disposal of Non-Hazardous Solid Waste: All solid waste shall be removed by the Contractor. It will not be placed in base refuse-collection containers. Concentrating on solid waste management, contractors must keep their sites clean, properly contain all waste, recycle to the maximum extent possible all cardboard, paper, metal, aluminum and plastic materials, and transport all solid waste generated to the local landfill, as prescribed in the contract.

The Contractor and its Subcontractor must provide the COR with the weight of waste disposed of off-site.

The weights must be reported with ultimate disposition, i.e. landfilled, recycled, reused, mulched, or composted.

1. Disposal of Construction Debris

a. Non segregated load of construction debris shall be disposed of in a landfill legally permitted by the State of Texas. Landfill profiles if required must be signed by 47 CES/CEIE.

b. Source segregated, non-contaminated (by process knowledge or analysis), concrete, asphalt and soil may be disposed of outside of a Texas permitted landfill with prior approval of the CO.

The Contractor shall be responsible for ensuring source segregated loads contain no contaminants.

c. No construction debris or soil can be disposed of on Laughlin AFB or its GSUs.

G. Water Distribution System: Contractor must notify CO, 47 MDOS/SGOJ and 47 CES/CEIE 10 days prior to any work involving the Public Water System and its distribution system. The contractor must meet compliance with all certifications, testing and reporting requirements outlined in 30 Texas Administrative Code 290 and by Texas Commission on Environmental Quality (TCEQ) for the proposed work. 47 MDOS/SGOJ shall perform or observe all tests for any new or renovated plumbing systems and grant final approval prior to startup. Form TCEQ 20699, Customer Service and Inspection Certificate must be completed and submitted to TCEQ. Contact TCEQ to determine if it is necessary to complete and submit the Form TCEQ 10233, TCEQ Public Water System Plan Review Submittal Form.

H. Clean Water Act

1. Contractors will not dump material down storm drains, into creeks, waterways, etc. without prior coordination with 47 CES/CEIE. Approved disposal methods should be discussed at the pre-work conference.

2. Contractors must restrict the introduction of anything into the liquid waste stream on base.

Protect sanitary drains, sinks and toilets from industrial input. Protect storm water swales and inlets from contaminated water and industrial liquids.

3. The need for a Construction Storm Water (CSW) permit will be based on the most current Texas Commission on Environmental Quality requirements. If a CSW permit is required, a SWPPP, including best management practices to be used, and a Notice of Intent (NOI) will need to be prepared and submitted to the TCEQ by the Contractor in accordance with the latest requirements. The Storm Water Pollution Prevention Plan (SWPPP) and NOI shall be provided to 47 CES/CEIE after being approved by TCEQ. The below diagram can be used to determine if a CSW permit is required.

4. In areas where a CSW permit is not required, the Contractor must abide by the Laughlin AFB SWPPP requirements and is responsible for implementing best management practice to decrease the likelihood of accidental releases of pollutants into unauthorized waterways and pipelines. This would include, but not limited to, the use of temporary erosion and sediment control measures such as silt fences, dikes, berms and mulching, which would be maintained until permanent drainage and erosion controls are completed and operative.

I. Air: No ozone depleting substances (refrigerants or any other compounds) will be released in any capacity during the project without the written approval of the CO endorsed by 47 CES/CEIE. Air emissions, such as dust, construction fumes and products of combustion, must be controlled and in some cases more stringent management and record keeping is required. If a combustion engine is stationary for more than 12 months, records of its usage must be kept and provided to the Air Program Manager monthly.

The Air Program Manager can provide more information regarding the record keeping requirements if necessary. If a stationary fuel tank is brought onto Laughlin AFB to refuel vehicles or equipment, the amount of fuel loaded into the tank and dispensed must be tracked and provided to the Air Program Manager monthly. J. Storage Tanks: No oil (diesel or gasoline) storage tanks should be allowed onto Laughlin AFB or its GSUs without prior approval by the CO who must consult the Tank Manager. The best management practice will be the use of tanker trucks instead of stationary storage tanks.

K. Conservation of Natural Resources: The Contractor should protect all natural resources including animals, plants, water, etc. Laughlin AFB has several species of interest, including endangered species, on site. Please contact 47 CES/CEIE if a species of interest is identified in the construction area. For more information about the species on Laughlin AFB, call 47 CES/CEIE, (830) 298-5694.
