PERFORMANCE AND PAYMENT BONDS-CONSTRUCTION (JUN 2020)

As used in this clause-(a) Definitions means the award price of the contract; or, for requirements contracts, the price payable for the estimated total quantity; Original contract price or, for indefinite-quantity contracts, the price payable for the specified minimum quantity. Original contract price does not include the price of any options, except those options exercised at the time of contract award.

Unless the resulting contract price is valued at or below the threshold specified in Federal Acquisition (b) Amount of required bonds Regulation 28.102-1(a) on the date of award of this contract, the successful offeror shall furnish performance and payment bonds to the Contracting Officer as follows:

Alternative Payment Protections (July 2000)

The Contractor shall submit one of the following payment protections:(a)

The amount of the payment protection shall be 100 percent of the contract price.(b)

The submission of the payment protection is required within 10 days of contract award.(c)

The payment protection shall provide protection for the full contract performance period plus a one-year period.(d)

Except for escrow agreements and payment bonds, which provide their own protection procedures, the Contracting Officer is authorized to (e) access funds under the payment protection when it has been alleged in writing by a supplier of labor or material that a nonpayment has occurred, and to withhold such funds pending resolution by administrative or judicial proceedings or mutual agreement of the parties.

Bid Guarantee (Sept 1996)

Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.(a)

The bidder shall furnish a bid guarantee in the form of a firm commitment, bid bond supported by good and sufficient surety or sureties (b) e.g., acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds-

To unsuccessful bidders as soon as practicable after the opening of bids; and(1)

To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance (2) agreements), as required by the bid as accepted.

The amount of the bid guarantee shall be 20 percent of the bid price or $1,000,000.00, whichever is less.(c)

Section M - Evaluation Factors for Award

Evaluation Criteria

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government. The following factors shall be used to evaluate offers:

Factor 1: Price The offeror's price quote will be evaluated for award purposes based on the total price quote for all Contract Line Item Numbers (CLINs). The Government will first conduct a review of the overall quoted pricing and place the offerors in order from lowest to highest based on Total Evaluated Price (TEP). TEP will be calculated by totaling all CLINs. Then the price will be evaluated based on the Lowest Price Technically Acceptable.

Factor 2: Technical Technical will be evaluated using the technical criteria in Table 3.1. Each item will receive a YES or NO rating indicating the quote is or is not technically acceptable. YES, meaning the quote clearly meets the minimum requirements of the solicitation, and NO, meaning the quote does not clearly meet the minimum requirements of the solicitation. Failing to meet the criteria will deem the entire quote as not technically acceptable.
