FAR Provision 52.212-2, Evaluation -- Commercial Products and Services (Nov 2021), applies to this acquisition. As prescribed in FAR 12.301(c), the following addendum is provided for this solicitation and hereby amends any language therein:
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:
· Price
· Vendors must adhere to requirement in Instructions to Offerors, number 7 Price for the base and options. All CLINs will be evaluated for price realism and ensure prices appear balanced. For purposes of Lowest Price Technically Acceptable, CLINs 0001, 0003, 0004, 0005, and all options will be added together to get to the Total Evaluated Price (TEP). Vendors will then be ranked by their TEP, compared and evaluated. Unrealistic pricing or unbalanced pricing may result in an offer being found unacceptable even if they are the lowest price.
· Technical acceptability
· See Instructions to Offerors, number 6 for what information is necessary to be determined technically acceptable.
(b) A written notice of award or acceptance of a quote mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote’s specified expiration time, the Government may accept a quote (or part of quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(c) Options. The Government will evaluate quotes for award purposes by adding the total evaluated price for all options to the total evaluated price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
