About this file

This file is an exhibit from the Texas Department of Agriculture (TDA) regarding the handling of confidential or proprietary information submissions under the Texas Public Information Act (PIA). The exhibit serves as a required component of proposal responses and outlines the framework for protecting sensitive information from public disclosure. Respondents are required to declare whether their proposals contain confidential or proprietary information by selecting one of three checkbox options provided in the exhibit. The first option indicates that the entire submitted proposal is exempt from PIA disclosure and is clearly marked as containing confidential or proprietary information. The second option states that the proposal contains confidential or proprietary information and that a separate "Public Information Act Copy" has been submitted as required by the solicitation documents. The third option indicates that the proposal contains no confidential or proprietary information and no separate copy is being submitted.

The exhibit emphasizes that TDA is obligated under the PIA to notify third parties if a public information request is received that seeks their information, thereby providing an opportunity for affected parties to protect their sensitive data. The document cautions respondents against submitting blanket assertions of confidentiality, warning that such broad claims may result in an adverse ruling from the Office of the Texas Attorney General. Respondents must provide their printed name, authorized company representation, signature, and date when completing this exhibit, which was revised on March 7, 2024. This exhibit is a standard administrative requirement designed to establish clear procedures for managing proprietary information within the procurement process while maintaining compliance with Texas public disclosure laws.
