About this file
This document is Exhibit K: Data Security Requirements from the Texas Department of Agriculture, establishing mandatory security standards for contractors handling sensitive personal information and agency data. The exhibit outlines comprehensive security protocols that contractors must implement and maintain throughout the contract term and any renewal periods. Contractors are required to comply with NIST SP 800-53 standards or meet all TX-RAMP requirements for protecting Personally Identifying Information (PII), conduct quarterly security updates and vulnerability scanning, report system breaches within 24 hours with resolution within 72 hours, and adhere to Payment Card Industry Data Security Standards for payment processing. Additionally, contractors must implement encryption for all PII during storage and transmission, establish password standards requiring a minimum of 10 characters with uppercase, lowercase, numeric, and special character requirements with optional multi-factor authentication, and utilize TLS 1.2 or above for HTTPS connections on port 443 or other secure ports.
Contractors must ensure hardware infrastructure is TX-RAMP compliant and web applications are OWASP compliant, provide quarterly security reports to TDA's Information Security Officer detailing vulnerability testing and remediation efforts aligned with TX-RAMP guidelines, submit proof of background checks for all personnel with PII access including subcontractors, implement AES 128-bit encryption minimum for applications, and provide network diagrams and disaster recovery plans upon request. All contractors must submit vulnerability reports to the Contract Manager and TDA's Information Security Officer by the first business day of each quarter. Annual Service Organization Controls Reports (SOC 2 - Type 2) or Bridge Letters must be provided by the first business day after September 1st each contract year. Contractors must also certify compliance with the state's cloud computing risk and authorization management program and maintain those certifications throughout the contract term.
