About this file
This is a Payment and Performance Bond document for the Van Avenue Seawall Project, a construction contract with Volusia County, Florida. The project involves replacing a damaged concrete seawall with UC-95 composite seawall panels at the Van Avenue Beach Approach Park located at 3101 S. Atlantic Avenue, Daytona Beach, Florida. The seawall was damaged during the 2022 hurricane season, and this restoration project will protect the upland park and facilities from future storm events while reestablishing safe public access to the park. The work includes installing new composite seawall panels along the eastern edge, protecting and capping the existing concrete return wall at the southern vehicular ramp, installing a new return wall on the northern property edge, and preserving existing facilities throughout construction. The County Contract Number is C2034.
The bond is executed in compliance with Florida Statutes Section 255.05 and requires the contractor and surety to guarantee performance and payment of all labor, materials, and supplies. The bond amount is to be filled in by the contractor and surety, with the specific dollar amount left blank in this template document. The surety must comply with all contractual obligations, indemnify and hold harmless Volusia County from liabilities caused by contractor negligence or misconduct, and guarantee all work and materials for the time specified in the contract. Any claims under the bond must follow notice and time limitation provisions outlined in Florida Statutes Section 255.05(2) and (10), and the surety waives notice of any contract changes, extensions, or modifications.
