About this file
This document is a Build America, Buy America (BABA) information and certification exhibit provided by the County of Volusia Community Assistance for the Deland Regional Library Play Yard Walkway project (ITB No. 26-B-55JS). The BABA requirements apply to all federally funded infrastructure projects, including those funded through Community Development Block Grant (CDBG) sources. The document defines infrastructure projects as rehabilitation, maintenance, and reconstruction of buildings and real property, as well as construction and repair of public facilities such as water, sewer, utilities, parks, roads, and sidewalks. The file includes a pre-construction BABA Pre-Certification form that must be completed by the primary contractor following the pre-construction meeting before work begins, and a post-completion BABA Certification form that must be submitted before final payment is dispersed. Both forms may be required from all subcontractors as well.
The phased implementation of BABA requirements is based on the fiscal year in which funds were obligated. For FY 2023/24, contractors must verify that iron and steel are U.S.-manufactured. For FY 2024/25, non-ferrous metals, lumber, and plastic- and polymer-based composite building materials, pipes, and tubes must also be U.S.-produced. For FY 2025/26, additional materials including all other plastic- and polymer-based products, glass, fiber optic cable, optical fiber, engineered wood, and drywall must meet U.S. manufacturing requirements. Supporting documentation such as invoices and receipts must be provided with each certification to verify that all required materials were produced in the United States. The certification forms require contractors to identify all materials to be purchased for the project, whether those materials will be obtained, whether they will be U.S.-manufactured, and to list all planned or actual manufacturers used.

Build America, Buy America (BABA) Information
What is Build America, Buy America (BABA)?
The Build America, Buy America Act (BABA) requires that all iron, steel, manufactured products, and construction materials used for federally funded infrastructure projects are produced in the United States, unless otherwise exempt or subject to an approved waiver. This requirement is known as the “Buy America Preference (BAP)”.
When does BABA apply to projects?
The Build America, Buy America Act (BABA) applies to all federally funded infrastructure projects. The Community Development Block Grant (CDBG) is a federal funding source and BABA would apply for all infrastructure project funded with CDBG. If additional funding sources are being used, the entire project must meet BABA requirements if any federal funding source is being utilized.
What is considered an infrastructure project?
The following are considered infrastructure projects according to BABA:
• Rehabilitation, maintenance, and reconstruction of buildings and real property, including housing
• Construction and repair of public facilities and improvements, such as water, sewer, or other utilities, parks, roads, bridges, sidewalks, homeless shelters, or broadband infrastructure
Do all materials have to be manufactured in the United States?
The U.S. Department of Housing and Urban Development (HUD) is requiring that BABA be met in phases to assist with the current transition. The phases are based on the year the funds were obligated. If you are unsure which fiscal year the funds were obligated for your project, reach out to the city you were awarded by or CDBG@volusia.org.
