About this file

This is a Build America, Buy America (BABA) Information and Forms document prepared by the County of Volusia Community Assistance for the Deland Regional Library Play Yard Walkway project, a federally funded infrastructure initiative located in DeLand, Florida. The document provides guidance and certification forms required for BABA compliance, which mandates that all iron, steel, manufactured products, and construction materials used in federally funded infrastructure projects must be produced in the United States unless exempt or subject to an approved waiver. The project qualifies as an infrastructure project under BABA because it involves the rehabilitation and construction of public facilities. Contractors are required to complete two BABA certification forms: a pre-certification form to be submitted following the pre-construction meeting before work begins, and a final certification form to be submitted upon completion of all on-site work prior to final payment disbursement.

The BABA requirements are implemented in phases based on the fiscal year funds were obligated. For FY 2023/24, contractors must ensure iron and steel are U.S.-produced; FY 2024/25 adds non-ferrous metals, lumber, and plastic- and polymer-based composite materials; and FY 2025/26 expands requirements to include all plastic- and polymer-based products, glass, fiber optic cable, optical fiber, engineered wood, and drywall. Contractors and subcontractors must document U.S. manufacturing origin through invoices, receipts, and supporting documentation for all required materials. The project is funded through Community Development Block Grant (CDBG) and Volusia ECHO Grant sources, and contractors should contact the City of DeLand or CDBG@volusia.org to confirm the applicable obligated fiscal year for their project. All contractors remain responsible for BABA compliance and providing certification documentation before payment is released.

Build America, Buy America (BABA) Information

What is Build America, Buy America (BABA)?

The Build America, Buy America Act (BABA) requires that all iron, steel, manufactured products, and construction materials used for federally funded infrastructure projects are produced in the United States, unless otherwise exempt or subject to an approved waiver. This requirement is known as the “Buy America Preference (BAP)”.

When does BABA apply to projects?

The Build America, Buy America Act (BABA) applies to all federally funded infrastructure projects. The Community Development Block Grant (CDBG) is a federal funding source and BABA would apply for all infrastructure project funded with CDBG. If additional funding sources are being used, the entire project must meet BABA requirements if any federal funding source is being utilized.

What is considered an infrastructure project?

The following are considered infrastructure projects according to BABA:

• Rehabilitation, maintenance, and reconstruction of buildings and real property, including housing

• Construction and repair of public facilities and improvements, such as water, sewer, or other utilities, parks, roads, bridges, sidewalks, homeless shelters, or broadband infrastructure

Do all materials have to be manufactured in the United States?

The U.S. Department of Housing and Urban Development (HUD) is requiring that BABA be met in phases to assist with the current transition. The phases are based on the year the funds were obligated. If you are unsure which fiscal year the funds were obligated for your project, reach out to the city you were awarded by or CDBG@volusia.org.

Obligated Fiscal Year Materials that must follow BABA

FY 2023/24 • Iron

• Steel

FY 2024/25

• Plastic- and polymer-based composite building materials, pipes, and tubes

FY 2025/26

• All other plastic- and polymer-based products

What information is required for BABA reporting?

For Community Development funded infrastructure projects, the following is required:

• BABA Certification form

• Supporting documentation to show that all required materials were produced in the United States o Invoices, receipts, etc.

The form to be completed by the contractor is subject to change as additional information is provided by HUD.
