Exhibit E - Design Criteria Package Progressive Design-Build

Marina Redevelopment City Of St. Petersburg, Florida

Project No. 25204-130

INTENT

The City of St. Petersburg (“City”) invites qualified Firms to submit qualifications to provide Design- Build (“DB”) services at a Guaranteed Maximum Price (“GMP”) for the design and construction of the scope items provided below for the Marina Redevelopment (“Project”), including any additional work necessary for the completion of the Project

The DB Firm should have experience in the development of coastal marine facilities (saltwater environment), including seawalls, accessory buildings with experienced design professionals specializing in bridge replacement and design of facilities within coastal high hazard zones. The City will utilize a progressive DB delivery method.

The project is multi-phased within the North, Central, and South Marina Basins:

NORTH

BASIN

CENTRAL

BASIN

SOUTH

BASIN

BACKGROUND

This Project involves the design and construction of floating docks, dock houses, the renovation or replacement of the ship store, fueling facilities, seawalls adjacent to each of the marina basins, and bridge connecting to Demens Landing and associated infrastructure. Work will also include routinely inspecting the existing facilities for safe operations, and sequencing the replacement or selective rehabilitation of elements.

This is a capital project under a progressive DB delivery method to realize synergies between all components, minimize disruptions, and assign a single point of contractual responsibility for the redevelopment of the Marina.

Separately, the City is issuing an RFQ for the commercial development of the southeast corner of 2nd Avenue and Bayshore Drive NE. The DB will be required to coordinate with the selected developer.

SCOPE

The DB Firm shall participate in the design process, perform construction cost estimating, provide value engineering, constructability review and risk analysis, obtain permits, manage the schedule, maintain operations, and perform construction services and commissioning. All DB Firms must be licensed to practice as general contractors in the State of Florida pursuant to Chapter 489 Florida Statutes by the submittal date for proposals.

The contract for DB services shall consist of the pre-construction phase and the construction phase. The Pre-construction Services Phase, for which the DB Firm will be paid a fixed fee, will include design, cost estimating, value engineering, constructability review, risk analysis, and preparing the GMP during the design development. The pre-construction Services will include multiple GMPs dependent upon design components, construction sequencing, long-lead, and owner-direct purchase items. It may be possible to have multiple critical paths.

If the GMPs are accepted by City staff and approved by City Council, the Construction Services Phase will be authorized following execution of the agreement for construction services. In all aspects of the contract, the DB Firm serves as the single point of responsibility for the successful performance of the pre-construction and construction of the project and shall publicly bid trade contracts. The self‑performed work shall be competitively bid along with the subcontractors in accordance with the contract.

Comprehensive Pre-construction and Construction Service Phases shall include, but not be limited to, the following components:

Coordination:

• The DB team will coordinate with the commercial developer of the SE corner of 2nd Ave and Bayshore Dr NE, the St Pete Pier, Special Events, and other City Departments as needed. This may include, but not limited to:

o Phasing o Architectural cohesion of the dock houses, operational facilities, and fueling station.

o Coordination with the City and other local stakeholders.

South Side of Demens Landing to include, but not limited to, bathrooms, showers, seating, laundry facilities, and amenities.

o Dock houses shall be designed and constructed to be resilient and include flood protection measures.

o As part of the Pre-Construction Phase, the DB shall develop alternatives for either replacement of the Ship Store and associated fuel station with a new building and associated fuel station, or combining the operation building with the dock house located on the south side of Demens Landing and a separate fueling station with a smaller building.

Maintenance Facilities and Fueling Station:

• Design and construction for the replacement of existing operational facilities and fueling station.

• Operational facilities shall include adequate space for operational staff and equipment as identified in the table above.

• Fuel station shall include replacement of the existing fuel tank and pumps.

Utilities:

• Design and construction for the replacement of existing utilities to ensure the Level of Service can be maintained.

o Stormwater:

Stormwater treatment and attenuation consistent with current State and

Federal regulations.

Implement stormwater improvements which improve water quality and are nature-based.

Design as-needed repairs and in-kind infrastructure replacements. All design work will conform to the City’s Standard Specifications.

o Water/Wastewater:

Consolidate/rehabilitate/replace existing and extend new infrastructure to ensure the level of service is maintained based on the reconfigured site, docks, and other facilities.

This will include providing service to the site, docks, or other facilities improved within this scope of services.

Replace existing utilities up to their respective point of connection along Bayshore Drive.

o Other utilities Coordinate with other service providers to install services to the site, docks, and other facilities improved within this scope of services. These may include, but are not limited to, cable, fiber optic, etc.

Roadway:

• Design and construction for the replacement of existing utilities to ensure the Level of Service can be maintained.

o Aging infrastructure, utility repairs, and increased traffic have caused advanced degradation of the roadway surface within Demens Landing. Conduct a boring analysis of the roadway and develop a plan to repair or reconstruct the roadway.

o Design and construction of, but not limited to, roadway, parking, curb, signage, and striping o Survey and evaluate all sidewalks and ramps within the Project limits for ADA compliance. Design and construct new ramps, curb & gutter, and appurtenances as needed to obtain ADA compliance.

Bridge Replacement:

• Design and replace the existing bridge connecting to Demens Landing.

• Bridge shall replicate the existing aesthetics and include design elements consistent with current City standards for railing design.

Seawall Replacement:

• Design and replace seawalls adjacent to new docks or as identified by the City Engineer during Pre-Construction.

Resilience:

• Conduct a wave action study to confirm minimum requirements for all floating structures.

• Design and construct facilities consistent with current sea level rise projects and consistent with the Tampa Bay Regional Planning Council recommendations.

• Design and construct all seawalls and bridges for a minimum 75-year service life.

Budget and Guaranteed Maximum Price Development:

• Develop a design consistent with the City Construction Budget of $148,000,000.

• Develop an overall schedule and multiple Guaranteed Maximum Price packages to align with City budget phasing.

Schedule:

• Develop a project sequence which minimizes the timeframe for overall shutdown of the Marina, allowing for phased opening of sections such that the City can obtain beneficial use.

• Substantial completion shall be completed within 60 months from Notice to Proceed.
