About this file

This document is a Special Contract Conditions exhibit issued by the Colorado Department of Public Health and Environment (CDPHE) Hazardous Materials and Waste Management Division Remediation Programs Unit on January 21, 2014. It establishes operational and behavioral requirements for construction projects conducted on state-wide brownfields, methamphetamine sites, and Leadville, Colorado LCCHP sites. The conditions are mandatory because projects involve construction within residential homes and require contractors, workers, subcontractors, and site visitors to respect homeowners' and tenants' property while minimizing disruption and inconvenience. Work must include advance notice to occupants, and communications regarding the project are restricted to CDPHE-designated personnel only.

The document specifies six general rules governing contractor conduct: smoking is prohibited on the work site and interior or exterior of homes; eating and drinking are restricted to outside the home with all waste removed daily; home furnishings cannot be used and must be returned to original locations if moved; noise prior to the official 8:00 A.M. start time is prohibited, with standard working hours Monday through Friday from 8:00 A.M. to 5:00 P.M., though extended hours may be permitted with 72-hour advance notice and Project Manager approval; contractors cannot access the site or begin work until the Oversight Contractor from Gobbell Hays Partners, Inc. and/or the CDPHE Project Manager is present and initiates work; and the Project Manager retains authority to remove workers for contract violations, with the worker having the right to a meeting to address allegations before a final decision. The document requires contractor acknowledgment and signature confirming receipt and understanding of these conditions.

Special Contract Conditions For Construction Projects On State-Wide Brownfields and, Methamphetamine Sites, and Leadville, CO LCCHP Sites

Purpose

These Special Contract Conditions are required because this project may involve construction within residential homes. As such, the Contractor, all workers, subcontractors, deliverymen and anyone else coming on to the work site must be informed of the requirements to respect the homeowners’/tenants’ property. The work must be done in a manner that limits the inconvenience to the homeowner(s)/tenant(s) of the property, provides advance notice to the homeowner(s)/tenant(s) of any work that will be conducted at the home, and limits communications about the project to those persons designated by CDPHE.

General Rules

1. No smoking at any work site. This includes no smoking on the interior or exterior of the home (i.e., yard). Any smoking is to be done outside the building (outside of the property boundary) and far enough away that smoke cannot enter windows or ventilation systems.

2. No eating and drinking is allowed inside the home/work site. Meal and coffee breaks are to be designated outside the interior of the home. Wrappers, cups, and other trash shall be properly disposed of and removed from the work site at the end of each day. No trash is to be left onsite.

3. The Contractor is not to use any of the home furnishings at any time for any reason. In the event furniture has to be moved for access, the Contractor must notify the CDPHE Project Manager and return the furniture in the same condition to its original location immediately after the work is completed.

4. The Contractor is required to ensure that noise prior to the daily official start of work does not disrupt homeowners or adjacent homeowners. These noise concerns may include, but are not limited to, equipment warm up, radios and voice noise within the construction site that can be heard within the home or adjacent homes, and the arrival of early morning deliveries of equipment, concrete, supplies, etc.

Working hours for construction adjacent to or in occupied-building construction are 8:00 A.M. to 5:00 P.M. Monday through Friday. CDPHE may stipulate per bid and Request For Proposal (RFP) documents, the opportunity to work for extended periods of time.

The hours established in the RFP/bid supersede this document. This will be standard

Exhibit D unless specifically stated otherwise in the contract. Any request to work during additional hours must be made at least 72 hours in advance of the work and is subject to approval of the Project Manager.

5. The Contractor will not step foot onto the work site and/or start work until the Oversight Contractor from Gobbell Hays Partners, Inc. and/or the CDPHE Project Manager is present and initiates work.

6. The Project Manager retains the right to require the Contractor to remove a worker from the project, if the Project Manager determines, in his/her sole discretion, that the worker violated a provision of the Agreement. The worker has the right to a meeting with the Project Manager and the Contractor at which time the Project Manager will inform the worker of the allegations made against him/her. The worker will be given the opportunity to present his/her response before a final decision is made.

THESE GENERAL RULES ARE SUBJECT TO REVISION AND CHANGE WITHOUT

QUALIFICATION. CHANGES AND REVISIONS WILL BE COMMUNICATED TO

CONTRACTORS WHEN THEY ARE MADE.
