About this file

Exhibit D is a procurement amendment issued by Northern Wasco County People's Utility District (the District) related to Executive Order 13920 concerning the security of bulk-power system electric equipment. The document outlines new procurement guidelines for transformer and electric equipment purchases, specifically addressing national security concerns around foreign suppliers. The amendment focuses on excluding suppliers from adversary countries as defined by the Department of Energy (DOE) and other federal agencies.

The amendment establishes four key requirements for suppliers: (1) exclusion of bulk-power equipment suppliers from adversary countries, (2) compliance with DOE guidance to minimize risks from foreign-influenced equipment, (3) mandatory comprehensive supply chain disclosure including component origins and foreign affiliations, and (4) the District's right to modify or cancel contracts based on additional DOE directives. The document emphasizes proactive infrastructure protection and alignment with federal guidelines on securing the U.S. electric power system, requiring suppliers to acknowledge and agree to these terms as part of their bid submission.

Text version

Exclusion of Suppliers from Adversary Countries In light of Executive Order 13920 on Securing the United States Bulk-Power System, as well as the recent guidance from the U.S. Department of Energy (DOE) and the Office of Cybersecurity regarding the security of the U.S. electric power system, Northern Wasco County People’s Utility District (the District) is issuing an amendment to the current procurement process for the purchase of new transformers and other bulk-power system electric equipment. Executive Order 13920 “determine[d] that the unrestricted foreign supply of bulk-power system electric equipment constitutes an unusual and extraordinary threat to the national security, foreign policy, and economy of the United States, which has its source in whole or in substantial part outside the United States. This threat exists both in the case of individual acquisitions and when acquisitions are considered as a class.” The Executive order provided that “[t]o address this threat, additional steps are required to protect the security, integrity, and reliability of bulk-power system electric equipment used in the United States.”

Effective immediately:

1. Exclusion of Bulk-Power Equipment Suppliers from Adversary Countries: To ensure the security and integrity of the District’s critical infrastructure, the District will not consider proposals or purchase transformers from suppliers that are owned, controlled, or influenced by adversary countries as defined by the Department of Energy (DOE) and other relevant federal agencies.

2. Compliance with DOE Guidance: Suppliers must comply with the DOE’s expectation that utilities act in a way to minimize the risk of installing electric equipment and programmable components that are subject to foreign adversaries’ ownership, control, or influence. This includes adhering to the requirements of Executive Order 13920 and DOE’s recommendations regarding ensuring the security of the U.S. electric infrastructure.

3. Supplier Disclosure Requirements: All suppliers must provide comprehensive disclosure of their supply chain, including the origin of all major components and any affiliations with entities from adversary countries.

4. Right to Modify or Cancel Contracts: The District reserves the right to modify or cancel contracts should additional clarifications or directives from the DOE necessitate further action to protect the District’s infrastructure.

By implementing these measures, the District aims to proactively safeguard its bulk-power system from potential risks and align with federal guidelines on securing the nation’s electric power system.

Please review the attached amendment details and provide your acknowledgment and agreement to these terms as part of your bid submission.
