About this file
This is a Certificate of Environmental Compliance exhibit required for submission with a proposal to a state and local contracting entity. The document requires offerors to certify that their operations, resources, and facilities proposed for performance under the subcontract, including those of subcontractors and subtiers, are currently in compliance with all applicable Federal, State, and Local laws and regulations. Offerors must check the appropriate certification block and sign the document with the firm name, signatory name, title, and date. The certification is mandatory for proposal responsiveness, and failure to execute it or contact the Contracting Officer as required may render the proposal non-responsive.
The offeror agrees to provide immediate written notice to the Government if, prior to subcontract award or during performance, it learns that its certification was erroneous or if it becomes aware that operations, resources, or facilities are not in compliance with applicable laws and regulations. False, fictitious, or fraudulent certifications or failure to provide required notices constitute material breaches of contract and may result in the Government's refusal to pay for services rendered in a fraudulent or nonconforming manner. The certification carries legal weight under Section 1001, Title 18 of the United States Code, and false certifications may expose the maker to federal prosecution.
