About this file
This document is a 2024 Child Support Data User and Confidentiality Agreement issued by the New Jersey Department of Human Services, Division of Family Development, Office of Child Support Services (OCSS) for the NJKiDS Application Maintenance and Support contract. The agreement establishes mandatory confidentiality and data security requirements for all personnel granted access to child support program data, personally identifying information (PII), Federal Tax Information (FTI), and Federal Parent Locator Service (FPLS) classified data through NJKiDS, CLEAR, the IV-D portal, or comparable systems. Personnel are required to acknowledge understanding of federal and state statutes governing data protection, including 42 U.S.C. 654a, Internal Revenue Code sections 6103, 7213A, and 7431, and New Jersey Administrative Code 10:110 et seq. The agreement is binding for one year from the date of signing and indefinitely thereafter, extending beyond employment termination.
The agreement contains comprehensive restrictions on data handling and access, prohibiting unauthorized disclosure of child support information, transmission of FTI via fax or email, sharing of login credentials, offshore access to systems, and access to cases involving personal relationships or relatives. Users must report conflicts of interest to managers and request system restrictions accordingly. Personnel are prohibited from removing data from the workplace, duplicating or reproducing information by any means, or uploading data to internet databases or artificial intelligence tools. Violations constitute data breaches subject to immediate reporting to OCSS and the IRS Office of Safeguards, with potential consequences including disciplinary action, employment termination, and civil or criminal penalties under Internal Revenue Code sections 7213, 7213a, 7431, and 18 USC 1030.
