This document is a Request for Qualifications (RFQ) issued by The University of Texas at Austin, Campus Construction ("Owner" or "University") for selection of professional services firms to provide Architectural Professional Services, including Landscape Architects, for projects at the University's main campus, remote facilities, and other locations. This RFQ is the first step in a possible two-step process to establish indefinite delivery/indefinite quantity (IDIQ) master agreements with qualified firms. Responses are due by October 16, 2023, and a pre-submittal conference will be held on September 27, 2023. The initial term of any awarded master agreements will be one year, with four one-year renewal options.
The scope of work includes various architectural services such as program evaluation, feasibility analysis, conceptual design, design development, and construction administration for projects up to $10 million in total cost. There is no guaranteed minimum amount of work. Proposed fees will be negotiated on a per-project basis, subject to the University of Texas System Board of Regents fee schedule. The University has determined that subcontracting opportunities are probable, and Historically Underutilized Business (HUB) subcontracting plans will be required for projects valued at $100,000 or more.

ATTENDANCE AT THE PRE-SUBMITTAL CONFERENCE IS HIGHLY RECOMMENDED. The pre-submittal meeting with representatives of the Owner will be held to discuss procedures, project examples, and HUB participation. At this meeting, Respondents will have an opportunity to ask any questions regarding this RFQ.
1.12 ELIGIBLE RESPONDENTS: Only individual firms or lawfully formed business organizations may apply. Owner will contract only with the individual firm or formal organization that submits a Qualification.
1.13 HISTORICALLY UNDERUTILIZED BUSINESSES SUBMITTAL REQUIREMENTS: The policy of the University of Texas System, and each of its component institutions, is to promote and encourage contracting and subcontracting opportunities for Historically Underutilized Businesses (“HUBs”) in all contracts. Accordingly, CC has adopted Exhibit H, Policy on Utilization of Historically Underutilized Businesses (“Policy”) (See Attachment 2). The Policy applies to all contracts with an expected value of $100,000 or more. All required HSP documents must be submitted electronically by the due date/time as a part of the
Submission No. 2 package.
1.14 CERTAIN PROPOSALS AND CONTRACTS PROHIBITED: Under Section 2155.004, Texas Government Code, a state agency may not accept a proposal or award a contract that includes proposed financial participation by a person who received compensation from the agency to participate in preparing the specifications or request for proposals on which the proposal or contract is based. All vendors must certify their eligibility by acknowledging the following statement, "Under Section 2155.004, Texas Government Code, the vendor certifies that the individual or business entity named in this bid or contract is not ineligible to receive the specified contract and acknowledges that this contract may be terminated and payment withheld if this certification is inaccurate." If a state agency determines that an individual or business entity holding a state contract was ineligible to have the contract accepted or awarded as described above, the state agency may immediately terminate the contract without further obligation to the vendor.
This section does not create a cause of action to contest a proposal or award of a state contract.
1.15 SALES AND USE TAXES: Section 151.311, Texas Tax Code, as amended effective October 1, 1993, permits the purchase free of state sales and use taxes of tangible personal property to be incorporated into realty in the performance of a contract for an improvement to realty for certain exempt entities including The University of Texas at Austin. The section further permits the purchase tax-free of tangible personal property (other than machinery or equipment and its accessories and repair and replacement parts) for use in the performance of such a contract if the property is "necessary and essential for the performance of the contract" and "completely consumed at the job site." In addition, the section permits the purchase tax-free of a tangible service for use in the performance of such a contract if the service is performed at the job site and if "the contract expressly requires the specific service to be provided or purchased by the person performing the contract" or "the service is integral to the performance of the contract."

Workers' Compensation Commission has adopted a new rule, 28 TAC, sec. 110.110, relating to
REPORTING REQUIREMENTS FOR BUILDING OR CONSTRUCTION PROJECTS FOR
GOVERNMENTAL ENTITIES. The rule applies to all building or construction contracts advertised for bid on or after September 1, 1994. The rule implements sec. 406.096, Texas Labor Code, which requires workers' compensation insurance coverage for all persons providing services on a building or construction project for a governmental entity. The requirements of the rule are set forth in the Uniform General Conditions (“UGCs”) and Additional General Conditions (“AGCs”) applicable to University of Texas at Austin Construction Contracts.
1.18 DELINQUENCY IN PAYING CHILD SUPPORT: Under Section 231.006, Texas Family Code, the vendor or applicant certifies that the individual or business entity named in this contract, bid, or application is not ineligible to receive the specified grant, loan, or payment and acknowledges that this contract may be terminated and payment may be withheld if this certification is inaccurate.
1.19 STATE REGISTRATION OF ENGINEERING FIRMS: Respondents are advised that the Texas Board of Professional Engineers requires that any entity providing engineering services to the public must register with the Texas Board of Professional Engineers. SECTION 2 – EXECUTIVE SUMMARY
RFQ 24PSP001 solicits submission of Statements of Qualifications for firms wishing to be considered to provide Architectural professional services, including Landscape Architecture, using in-house resources only. A separate RFQ will be issued over the coming months soliciting Statements of Qualifications for specialty professional services. Firms should submit under the RFQ most appropriate for their expertise; a firm receiving award of a master agreement under any IDIQ RFQ (Ae/Ea, Engineering, Architecture or Specialty) may provide all types of professional services under that master agreement and need not resubmit under other RFQs. Only one master agreement for professional services will be issue to each firm receiving award.
The final round of the RFQs, covering specialty professional services, is scheduled for late in 2023 or early in 2024.
The University has not set a minimum or maximum number of awards under each round of the RFQs, overall or for any particular discipline. The number of firms receiving awards will be determined by the quantity and quality of responses received, and the expected number and scopes of projects over the coming five years.

The University, through CC, provides design and construction administration services for University administrative and academic units / Colleges which submit service requests to undertake construction and renovation projects as well as Facilities Services maintenance and deferred maintenance projects. CC is authorized by the University of Texas System Board of Regents to provide project management design and construction services for projects for all UT Austin projects.
2.2 MISSION STATEMENT:
The mission of the University is to achieve excellence in the interrelated areas of undergraduate education, graduate education, research and public service. The University provides superior and comprehensive educational opportunities at the baccalaureate through doctoral and special professional educational levels.
The University contributes to the advancement of society through research, creative activity, scholarly inquiry and the development of new knowledge. The University preserves and promotes the arts, benefits the state’s economy, serves the citizens through public programs and provides other public services.
2.3 DESCRIPTION, SCOPE AND BUDGET:
In order to provide timely and cost-effective design and other specialized services, CC proposes to enter into Master Agreements for Miscellaneous Professional Services for Projects of Limited Scope (“Master Agreement”) with various firms who can provide these services. Individual projects will be assigned by executing individual “Project Assignments”. There is no guarantee that any SPECIFIC MINIMUM DOLLAR amount of fees will be awarded. The initial term of the Master Agreements will be one year.
Upon mutual consent, the Master Agreements may be extended for up to four (4) additional calendar year renewals under the same general terms and conditions with any added modifications due to codes, software versions, firms revised hourly rate schedule as may be approved, new UT and/or CC policies, etc.
CAM 24PSP001 09192023 Page 9 of 68
The award of individual Project Assignments shall be based on the expertise of the Professional Service Provider (“PSP”), their successful performance on prior assignments, the number of projects requiring design, and the availability of funding for projects. Professional Services fees for individual Project Assignments will be negotiated based on the governing rules of the University of Texas System Board of Regents. These fees will vary depending upon the types of services required and the project types.
The successful Respondent(s) shall provide hourly rates for additional services or hourly not to exceed tasks as a part of executing the awarded Master Agreement. These rates shall be based on performance tasks (principal, senior engineer, drafting technician, clerical, etc., not individual names) and be submitted during the contracting process and negotiations. Initial hourly rates shall be for the base year of the Master Agreement. These rates may be negotiated for each of the subsequent renewal periods, as applicable.
The successful Respondent(s) shall not proceed in providing services without written authorization from the University. Services provided without a Project Assignment agreement may be considered a gift to the University and the University will not be obligated to provide compensation.
NOTE, no hourly rates schedule shall be submitted in the response to this RFQ.
The University will evaluate qualifications based on Respondent’s in-house capability to provide the necessary architectural and landscape architectural services. Awarded Respondent(s) may contract as needed with sub-consultants for other disciplines may be included on individual Project Assignments as the sub-consultant specialty is warranted. Respondent’s must base their Qualifications solely on in-house capabilities and not include sub-consultants.
The scope of work will vary from Project Assignment to Project Assignment in complexity and the scope of services to be provided by the PSP. Required services may include, but is not limited to, one or more of the items of service listed below:
• program evaluation
• project planning
• facilities space management
• feasibility analysis
• testing
• studies/reports
• conceptual design
• cost estimates
• schematic design
• design development
• bidding construction documents
• bidding and contractor selection services
• basic construction administration
• as-constructed drawings
• extensive construction phase quality control and monitoring.
All awarded Respondents shall comply with all necessary / applicable codes (Life Safety, NFPA 101, etc.), other regulations, TDLR and “UT Design and Construction Standards” as may be additionally stated in the Master Agreement, subsequent renewals and specific Project Assignments.
In 2018, the University of Texas System Board of Regents delegated authority to the University of Texas at Austin to manage all of its design and construction projects. Master Agreements resulting from this RFQ are generally available for minor projects only, those with a total project cost (“TPC”) of $10 million or less. However, services for planning, feasibility studies and other predesign studies, or other small professional services scopes (not actual design) that are a part of major projects (TPC $10 million or greater), may be requested under any Master Agreement resulting from this RFQ. Providing services under a Master Agreement for a major project does not guarantee award for the design portion of the project as design services for major projects are generally procured under a separate RFQ process.
The project data below is provided for the Respondent’s information and does not guarantee any awarded Respondent’s Project Assignments.
