About this file

This is Addendum No. 2 to Solicitation 405 26R0019669, issued by the Texas Department of Public Safety Procurement and Contract Services for Independent Financial Viability Assessment services for Compassionate Use Program Providers. The addendum provides agency responses to vendor questions and clarifies eligibility requirements for potential respondents. The original solicitation deadline was June 12, 2026, with anticipated award on the same date. The scope of work includes four phases of financial assessment applied to conditional licensees: document review of approximately 40,000 financial records (audited and unaudited statements, bank statements, capital commitments, debt agreements, revenue projections, operational budgets, and tax returns); financial analysis covering liquidity, working capital, cash flow, debt ratios, capital adequacy, burn rate, and growth-funding assessments; risk assessment with financial risk ratings and operational sustainability evaluations; and reporting deliverables including individual assessment reports, executive summaries, comparative risk rankings, and recommendations for monitoring and mitigation. The contract term is five years from the effective date, with DPS retaining the right to extend for up to an additional six-month period on an as-needed basis with no guaranteed compensation.

Respondents must hold current CPA licensure, though Certified Fraud Examiner (CFE) credentials are preferred. The addendum clarifies that firms may utilize subcontracting to meet requirements and that DPS will consider any respondent capable of meeting all outlined qualifications, including those with experience in gaming regulatory assessments, financial integrity evaluations, and anti-money laundering investigations. Contractors must demonstrate relevant experience in the cannabis industry or similarly regulated industries with at least one completed engagement within the past five years, and must disclose any past or current involvement with cannabis organizations, conflicts of interest, and disciplinary actions within the past five years. Pricing is not a factor in selection and will be negotiated following DPS's identification of the preferred provider. A mandatory pricing schedule covers three engagement tiers (small: 1-10 providers; medium: 11-20 providers; large: 21-30 providers) across the five-year term. All work products, data, and intellectual property become exclusive property of DPS.

Question

Vendor Question DPS Response to Vendor Question

1 Although our company is not a qualified public accounting firm, we have significant experience of performing heavy financial analysis through our work in corporate investment banking, valuations, and financial planning & analysis. We also have relationships with qualified accounting firms in the cannabis space and could potentially team with one if that would be helpful.

Give the June 22nd deadline, would you be open to us exploring a response to this RFD? If so would you prefer we respond independently or through a partnership with a CPA firm?

Respondents may utilize subcontracting to ensure all RFQ requirements are met (i.e.

having a qualified certified public accountant).

2 Will DPS consider a firm that has been retained consistently by government agencies in the United States (multiple states) and internationally to conduct financial integrity and financial stability assessments of casino gaming license applicants and special investigations in the gaming and financial services industry? Our staff includes certified public accountants (many of whom are former financial investigators for gaming regulatory agencies in New Jersey and Nevada) with law enforcement, regulatory and anti-money laundering (AML) experience in conducting highly sensitive and complex financial investigations and assessments

DPS will consider any respondent capable of meeting all the requirements outlined within the RFQ.
