About this file

This is an Execution of Offer form for a Request for Offer (RFO No. 601330000045576) issued by the Texas Department of Transportation (TxDOT). The document serves as a certification and binding agreement form that respondents must complete and submit with their bids or proposals. The form requires the respondent's authorized representative to certify that all submitted information is current, complete, and accurate, and to confirm compliance with various state and federal requirements including anti-trust laws, conflict-of-interest provisions, and debarment status. The respondent must provide company information, contact details, employer identification number (EIN), and authorized signing authority, with failure to return this completed form resulting in the response being deemed non-responsive.

The form includes critical compliance certifications covering terrorism financing restrictions under Executive Order 13224, state auditor audit authority, hurricane relief contract restrictions, and eligibility determinations. Additionally, the form allows respondents to claim preferences under Texas Administrative Code Rule 34TAC 20.306 across multiple categories, including supplies produced in Texas, agricultural products, service-disabled veteran-owned businesses, products from economically depressed areas, environmentally sensitive materials, energy-efficient products, and other specification preferences. The form also permits payment authorization to alternative entities if invoicing or payment will be made to a different company name or EIN than the primary respondent, ensuring flexibility in payment arrangements while maintaining accountability.
