About this file

This is an Artificial Intelligence Requirements Attachment for a Texas Department of Transportation (TxDOT) solicitation (No. 601330000045576). The document establishes comprehensive requirements for vendors providing technology solutions and services that incorporate AI functionality. Vendors must submit detailed explanations of all AI systems—whether proprietary or publicly available—that will be used in solution delivery. Required disclosures include specific AI actions and outputs, descriptions of AI recommendations and decisions, functionality overview, clarification of whether AI is optional or mandatory, Human-in-the-Loop involvement details, data types utilized, data classification, data handling procedures, bias and hallucination mitigation measures, algorithm reliability assessments, and strategies for handling unexpected inputs and edge cases. Vendors must provide 45 days' advance notice to TxDOT before implementing any new AI functionality or modifications to existing AI, allowing TxDOT to review compliance with its Acceptable Artificial Intelligence policy. TxDOT reserves the right to cancel the contract without penalty if any AI functionality fails to comply with its AI policy.

The document defines key terms including Artificial Intelligence as machine-based systems making predictions, recommendations, or decisions to influence real or virtual environments; AI Systems as any applications containing AI components; Information Resources Technologies as data processing and telecommunications infrastructure; and Human-in-the-Loop decision-making as human-AI collaboration where humans evaluate and approve or reject AI-generated recommendations. TxDOT Data is defined as information written, produced, collected, assembled, or maintained by or for TxDOT, including data where TxDOT owns information, has access rights, or contributes public funds. No pricing, award dates, contract terms, or renewal options are specified in this attachment, indicating it functions as a standalone requirements document applicable to solicitation 601330000045576.

Attachment A - Artificial Intelligence Solicitation No. 601330000045576

1 – 2

1. Artificial Intelligence (AI):

1.1. Vendor must provide a detailed explanation of all AI, whether proprietary or publicly available, that may be used in the delivery of technology solutions and/or services.

This explanation must include, but is not limited to, the following:

1.1.1. The specific actions and outputs generated by the AI (decisions/output).

1.1.2. A description of what the AI functionality recommends, decides, documents, reports, or affects when deployed.

1.1.3. An overview of how the AI functionality is utilized within the solution.

1.1.4. Clarification on whether the AI functionality is optional or mandatory.

1.1.5. Information on the presence of Human-in-the-loop (HITL) involvement.

1.1.6. The types of data being utilized by the AI.

1.1.7. The classification and categorization of the data being used.

1.1.8. Details on the handling of data, including if it is being transferred outside of TxDOT, used to train an AI model, etc.

1.1.9. Measures taken to mitigate biases and hallucinations within the AI model.

1.1.10. An assessment of the reliability of the AI algorithms and models deployed.

1.1.11. Strategies for handling unexpected inputs and edge cases.

1.2. During the term of the contract, if any changes occur where new AI will be introduced, or the AI functionality originally submitted by the vendor will change. The vendor must send notification a minimum of 45 days prior to implementing any changes to existing or new AI functionality to TxDOT for review by TxDOT to ensure compliance with TxDOT’s policy for Acceptable Artificial Intelligence. TxDOT reserves right to cancel the contract without penalty if any AI functionality will not comply with TxDOT’s policy for Acceptable Artificial Intelligence.

1.3. AI is defined as:

1.3.1. Artificial Intelligence (AI) – A machine-based system that can, for a given set of human-defined objectives, make predictions, recommendations, or decisions influencing real or virtual environments.

2 – 2

1.3.2. Artificial Intelligence (AI) System– Any application that contains an AI component regardless of size or usage.

1.3.3. Information Resources Technologies (IRT) – Data processing and telecommunications hardware, software, services, supplies, personnel, facility resources, maintenance, and training. [Source: Texas Government Code, Chapter 2054.003]

1.3.4. Human-in-the-Loop (HITL) decision making - Human-in-the-loop decision making involves a human decision-maker working in tandem with AI to improve decision making outcomes. In HITL systems, the AI system provides input, recommendations, or predictions that the human decision-maker evaluates and approves or rejects.

1.3.5. TxDOT Data – As defined by TxDOT Data Classification Policy, is information that is written, produced, collected, assembled, or maintained under a law or ordinance or in connection with the transaction of official business:

1.3.5.1. by TxDOT;

1.3.5.2. for TxDOT where TxDOT owns the information, has the right of access to the information, or spends or contributes public money for the purpose of writing, producing, collecting assembling, or maintaining the information; or

1.3.5.3. By an officer or employee of TxDOT in the officer or employee’s official capacity and pertains to official business of the government body.

1.3.5.4. has context menu.
