About this file

This is a Special Terms and Conditions document for an insurance requirement associated with a state and local contract opportunity with the Texas Commission on Environmental Quality (TCEQ). The document establishes mandatory insurance coverage provisions that vendors must maintain when entering premises occupied or controlled by TCEQ during contract performance. Vendors are required to maintain commercial general liability insurance in reasonable limits and worker's compensation coverage for all employees performing work on TCEQ premises, either through traditional insurance policies or qualified self-insurance programs if permitted by law.

The insurance policies must include specific provisions naming TCEQ and its officers and employees as additional insureds on the Commercial General Liability Insurance policy. Additionally, vendors must agree to waiver of subrogation in favor of TCEQ, its officers, and employees for bodily injury (including death), property damage, or any other loss arising from the contract. These requirements establish the baseline risk management expectations that the vendor must satisfy as a condition of contract performance.
