This is Addendum No. 5 to Request for Proposal (RFP) 2025-084 issued by the City of Waco, Texas Financial Services Department for unleaded fuel deliveries. The RFP seeks regular grade unleaded gasoline (87 octane minimum) meeting ASTM D4814 specifications for delivery to a single location at 324 Colcord Avenue, which contains two above-ground storage tanks. Based on fiscal year 2025 usage, the estimated annual requirement is approximately 489,496 gallons, with deliveries required within 24 hours of notification, seven days per week including holidays. The proposal submission deadline is February 9, 2026, at 2:00 P.M. Central Time, with opening at 2:06 P.M. the same day. The contract commences April 6, 2026, for an initial 24-month term with options to renew for three additional one-year periods. Evaluation criteria include price (40 points), supply reliability (15 points), prior experience (10 points), delivery capability (10 points), emergency delivery and off-site fueling options (10 points), and fuel measurement and invoice reconciliation processes (15 points).

Pricing shall be based on the OPIS Constant Daily Average Rack Pricing (10:00 a.m. Contract Average) for PADD 3, referenced to January 9, 2026, with bidders providing a constant markup (profit and overhead) per gallon including freight costs. The Alternate Pricing Option for Firm Price has been removed from the RFP. Bid bonds are not required for this project. The current incumbent vendor is Petroleum Traders Corporation. Payment terms are Net 30, with invoices required for each delivery submitted via email. Proposers must be registered with the Texas Secretary of State and provide proof of insurance including $1,000,000 per occurrence commercial general liability coverage. The City does not have Disadvantaged Business Enterprise (DBE), Minority-Owned Business Enterprise (MBE), or Women-Owned Business Enterprise (WMBE) requirements for this procurement. There are no designated sites for emergency off-site fueling; the City will coordinate logistics with the selected vendor for emergency fueling locations, subject to the vendor's ability to provide service and applicable laws and regulations.

51. The solicitation specifies that deliveries must occur within eight (8) hours after receipt of order.

Could the City please confirm whether this timeframe is firm or if consideration could be given to a 24-hour delivery window, which aligns with standard industry practice? Most suppliers operate on a 24-hour delivery schedule to ensure appropriate routing, safety, and quality control. An 8-hour delivery requirement may unintentionally limit the number of responsive and responsible bidders, thereby reducing competition and potentially affecting overall pricing for the City.

a. The requirement is revised to delivery within 24 hours. Deliveries shall be made within

52. The solicitation references a requirement for emergency off-site fueling services. Could the City please confirm whether the use of fleet fuel cards to facilitate fueling at local retail stations would meet this requirement? Waco, Texas 76702-2570 254 / 750-6640

53. The solicitation requests that subcontractors be listed along with five references and descriptions of major projects. Many fuel suppliers utilize common carriers for the transportation of fuel on an as-needed basis as part of standard industry logistics. Could the City please clarify whether the use of such common carriers for fuel transport is considered “subcontracting” for purposes of this requirement, or whether only entities performing project-specific contractual obligations should be listed as subcontractors?

54. Will a bidder be marked unresponsive if they do not have a site the City can access 24/7 in an emergency?

a. No. However, the vendor should outline in its proposal whether it has this ability.

55. For the pricing page, are you asking for the average low OPIS posting for Waco, TX?

56. Who is the current incumbent?

57. Under the current contract, how many times has the City needed to use Emergency Off-Site Fueling?

a. None to date for the current contract.

58. Under the current contract, what site is used for Emergency Off-Site Fueling?

a. There is no designated City location for emergency off-site fueling. The City of Waco will work with the selected vendor and coordinate logistics for an emergency off-site fueling location, subject to the vendor's ability to provide this service, any applicable laws, regulations, insurance requirements, or other requirements. Examples of off-site fueling locations include retail fuel locations owned by the selected vendor.

59. Page 27 of the solicitation specifies that the successful vendor may submit only one invoice every

30 days. Could the City please confirm whether this invoicing limitation is firm, or if vendors may instead invoice after each delivery, which aligns with standard industry practice for bulk fuel supply?

a. Invoices are required for each delivery, aligning with standard industry practice.

60. Does Form 1295 Need to be billed out by all bidders and submitted with our bid?

a. Form 1295 will be required after vendor has been selected for award. This is not required to be included with your initial submission.

61. How often is the required to make fuel deliveries within 8 hours?

Waco, Texas 76702-2570 254 / 750-6640

62. How often is the required to make fuel deliveries within 8 hours?

63. Can you please provide bidders with a sample OPIS report of the OPIS benchmark you want bidders to use?

64. Which section of the portal should we use to upload our proposal? Currently, the only available upload sections appear to be Pricing Forms, Appendix A, and Appendix B.

a. Forms required for Appendix A & B are listed in the table of contents for the RFP and will are required to be uploaded in their respective sections. Pricing forms and any other proposal pages can be uploaded together in the Pricing Forms section.

65. Hello - I would like to retract my questions titled "Daily Rack Price Date" and Emergency Fuel

Rack Price Date." I misread the price sheet and do not need clarification of either of these items.

Thank you!

a. Noted.

66. On the price sheet, the MFG of the additive package is listed. What type of additive are you looking to add to the unleaded fuel?

a. This section has been removed from this Request for Proposal. All references to this section throughout the document should be disregarded.

67. Will you allow vendors to submit one proposal encompassing all three products currently out to bid?

a. Each RFP requires a separate submission from the interested vendor. Do not combine submitted proposals for the Unleaded (RFP 2025-084), Diesel (RFP 2025-085), and Dyed Diesel (RFP 2025-086) Request for Proposals.

68. Who is your current vendor?

69. Please provide a copy of a gas metered bill of lading from the terminal

a. A copy is attached to this addendum.

70. Please provide a copy of a gas invoice.

Waco, Texas 76702-2570 254 / 750-6640

71. Are options to renew mutual or unilateral?

72. Would you consider allowing vendors 24 hours to make a delivery?

73. Would you accept a metered bill of lading from the terminal in lieu of an invoice within 24 hours?

a. No, bill of lading upon delivery and invoice within 24 hours.

74. Would you like to be priced off the OPIS Daily 10am Gross Contract Average posting?

75. Do you want all applicable taxes listed as a line item on your invoices?

a. Yes.

76. Are vendors permitted to propose a fixed / hedged price proposal as a differential against the

NYMEX? This allows the option to lock in the fixed price on the date / time of your choice with optimal pricing economics.
