About this file
This is a Liquidated Damages Statement issued by the Texas Department of Motor Vehicles (TxDMV) for RFP No. 608-25-57034 regarding Digital License Plate (DLP) Services, categorized under NIGP Class/Item Code 570-34.
The document specifically addresses the absence of liquidated damages in this contract, explaining that TxDMV will not suffer financial damages from project delays. The DLP program's implementation or absence has no fiscal impact on TxDMV, as the only financial component is the State's DLP Administrative Fee, which is mandated under Title 43, Texas Administrative Code, Section 217.63. This fee is paid directly by customers to the State through an approved online payment system, separate from any fees paid to the Contractor for DLP services.

RFP NO. 608-25-57034

Liquidated Damages
Due to the nature of Digital License Plate (DLP) Services, there is not a potential for the Texas Department of Motor Vehicles (TxDMV) to suffer damages for delayed completion of the project as described in the Solicitation. The implementation or absence of the DLP program has no fiscal impact to the TxDMV.
The sole cost/fee for the DLP program as it relates to TxDMV is the State’s DLP Administrative Fee, required under Title 43, Texas Administrative Code, Section 217.63 (Digital License Plate Fees and Payment). It is required that the Customer pays this fee directly to the State via the State’s approved online payment system, wholly separate from the cost and fees the customer pays the Contractor for the DLP.
