About this file
This document is an Addendum for Solicitation No. 405-24R0020771 issued by the Texas Department of Public Safety (DPS) for a Statewide Tower Replacement project. DPS is seeking a contractor to provide turnkey radio communication tower services, including decommissioning, design, construction, maintenance, and expansion of its infrastructure across various sites in Texas. The addendum provides additional information about the Scope of Work, answers questions from bidders, and includes a sign-in roster from a mandatory site visit. The project requires certified tower climbers, adherence to specific technical standards, and a 13-month warranty on the work performed. New towers must meet specified height, type, loading, and other requirements. The contract has an undefined term and sites will be added as funding becomes available.
The addendum clarifies that DPS is exempt from certain permitting requirements, will file for FCC and FAA approvals, and will provide power within 100 feet of the shelter. Contractors are responsible for surveys, site preparation, and removal/disposal of decommissioned equipment. DPS will consider milestone payments during construction. Pricing should account for fluctuating material costs, as each site will be quoted individually based on a site visit.

Solicitation 405-24R0020771 Statewide Tower Replacement Questions and Answers
1. Is it possible to extend the due date of responses for this RFP?
Answer: No, time allowed is adequate.
Based on what was said at the site walk yesterday, we wanted to confirm this pricing will be applied to approximately 100 sites for similar type installations and decommissions. To accurately provide a quote for this and future similar projects the following information would be helpful:
2. Could the coordinates or address for the other 100 sites be provided?
Answer: Coordinates for the other sites can be provided once they are confirmed, however site pricing will differ depending on the site.
3. Will all the sites have the same scope of work as this site?
Answer: Generally. Yes.
4. The specification calls for the vendor to handle permitting, however at the site walk we were informed that DPS was excluded from NEPA/SHPO studies, the contractor would still need to have the tower registered with the FCC and FAA. Would this be the case the other 100 sites mentioned?
Answer: DPS will work with the vendor for the FAA/FCC licensing aspect. At the site visit it was said that TXDOT is exempt from NEPA.
5. Will the state provide a Geotechnical Study at all other sites?
Answer: No, only at State owned sites.
6. Do we account (on this quote) for sites that will require a crane or Gin pole for tower removal since this site does not require a crane to remove the tower?
Answer: Each site will need to be quoted separately after each site visit.
7. What will be the ordering cycle and timeline for future sites?
Answer: As soon as the contract is awarded, and depending on cost, we will start working on sites as funding is available.
8. Do we factor the fluctuating steel and materials prices into this quote or will be there be an option to adjust pricing on materials on future sites?
Answer: See answer to question #6.
9. Will grading and clearing be provided by the State on all future sites?
Answer: No, only on TXDOT owned sites.
10. The Statement of Work states that the tower loading sheet should be attached but we cannot locate
it. Can you please provide?
Answer: Tower loading sheet is included in the SOW.
11. The Statement of Work states that a drawing sample for rack configuration inside the shelter should be attached but we cannot locate it. Can you please provide?
Answer: SOW updated.
12. Can you confirm that the tower loading has not changed since this was previously bid (405- 24R0000548)?
Answer: Yes, it has not changed.
13. Can you confirm the tower should be designed for Risk Category III?
Answer: Yes.
14. Can you confirm that it is the contractor's responsibility to conduct applicable surveys?
Answer: Please specify which surveys.
15. Can you confirm that this project should be exempt from sales tax as the purchaser is a government entity?
Answer: Yes, as a state entity, DPS is exempt from sales taxes.
16. Can you confirm that the Department of Public Safety will file for FCC Antenna Structure Registration with related notifications and NEPA/NHPA/ESA compliance?
Answer: Yes.
17. Can you confirm that DPS will be responsible for filing a NOTAM with the FAA to alert aircraft of an unlit tower from the time the tower height passes 200' elevation and when the tower is both powered and lit by contractor-supplied obstruction lighting? We understand the contractor is responsible for coordinating this schedule with DPS.
Answer: Yes, if NOTAMS are required DPS will file them.
18. Can you confirm that the contractor is not responsible for making any improvements to the existing access road?
Answer: Correct, unless specified per site.
19. Can you confirm the dimensions requested for the fenced compound are 100' x 100'?
Answer: Correct, Max fencing area should be 100’ x 100’.
20. Can you confirm the gravel footprint should extend 3' past the fence exterior on all sides?
Answer: Yes.
21. Can you confirm power will be supplied by DPS within 100' feet of the shelter?
Answer: Yes. Additionally, power from the pole to the building will be underground.
22. Can you confirm contractor does not need to provide for telco conduits to the site?
Answer: Please refer to building specifications.
23. Should the contractor provide an H-Frame and/or meter pedestal for primary power?
Answer: Yes.
24. Do you have a preference for size and rock type for the gravel in the compound? On the previous bid for this project, I believe it was listed as 1" to 1.5" washed stone.
Answer: It has not changed, SOW updated.
25. Can you please provide any applicable construction drawings, as-builts, redlines, and designs for the site that is to be decommissioned?
Answer: Due to the age of these towers some records are non-existent.
26. Can you confirm we do not need to return any of the decommissioned equipment to DPS? This is relevant to removal methods.
Answer: Confirmed, DPS does not want anything from the decommissioned site and everything should be removed and disposed of in a proper manner.
27. Can DPS make milestone payments after delivery of key items during the course of the build?
Answer: DPS will submit payments based on the PO line that was received and completed.
28. What is the power draw of the DPS-provided equipment that will be installed in the shelter (this will help us appropriately size the UPS)?
Answer: The SOW states the model and size of the UPS.
