About this file
This document is an Equal Benefits Ordinance (EBO) Disclosure Form issued by the City of Long Beach establishing nondiscrimination requirements for contractors receiving City contracts. The EBO, codified in Long Beach Municipal Code section 2.73 et seq., requires selected contractors to provide equal benefits to employees with spouses and employees with domestic partners during contract performance. Covered benefits include health insurance, bereavement leave, family medical leave, membership and membership discounts, moving expenses, retirement benefits, and travel benefits. The ordinance applies to for-profit employers with City contracts valued at $100,000 or more for goods, services, public works, improvements, or construction projects, and to for-profit entities generating $350,000 or more in annual gross receipts when leasing City property under written agreements exceeding 29 days in any calendar year.
Contractors subject to the EBO must certify compliance before contract execution by completing the provided Certification of Compliance form or obtain a waiver from the City. The ordinance permits cash equivalent payments if employers demonstrate reasonable efforts to secure domestic partner benefits but cannot obtain them from insurance providers. Implementation timelines allow delays under specific circumstances: up to two years if the contractor submits evidence of reasonable compliance efforts; up to three months for administrative infrastructure changes; or until expiration of current collective bargaining agreements. Failure to comply after expiration of the delay period constitutes material breach, exposing contractors to contract cancellation or suspension, three-year disqualification from City contracting, liquidated damages deductions, and other legal remedies. Contractors must also provide the City access to records for compliance verification and may be required to submit employee handbook copies, eligibility statements, and insurance documentation at contract award.
