Construction General Permit (CGP)

d. Discharges from your project are not:

i. Already covered by a different NPDES permit for the same discharge; or

ii. In the process of having coverage under a different NPDES permit for the same discharge denied, terminated, or revoked. L 2

e. You are able to demonstrate that you meet one of the criteria listed in Appendix D with respect to the protection of species that are federally-listed as endangered or threatened under the Endangered Species Act (ESA) or federally-designated critical habitat;

f. You have completed the screening process in Appendix E relating to the protection of historic properties and places; and

g. You have complied with all requirements in Part 9 imposed by the applicable state, Indian tribe, or territory in which your construction activities will occur.

1.2. ELIGIBILITY CONDITIONS THAT APPLY DEPENDING ON TYPE OF PROJECT.

You must also satisfy, if applicable, the conditions in Parts 1.2.1 through 1.2.4 in order to obtain coverage under this permit.

1.2.1. Eligibility for Emergency-Related Construction Activities.

If you are conducting earth-disturbing activities in response to a public emergency (e.g., natural disaster, widespread disruption in essential public services), and the related work requires immediate authorization to avoid imminent endangerment to human health, public safety, or the environment, or to reestablish essential public services, you are authorized to discharge on the condition that a complete and accurate NOi is submitted within 30 calendar days after commencing earth-disturbing activities (see Table 1) establishing that you are eligible under this permit. You are also required to provide documentation in your SWPPP to substantiate the occurrence of the public emergency.

1.2.2. Water Quality Standards - Eligibility for New Sources.

If you are a "new source" (as defined in Appendix A), you are not eligible for coverage under this permit for discharges that EPA, prior to authorization under this permit, determines will cause, have the reasonable potential to cause, or contribute to an excursion above any applicable water quality standard. Where such a determination is made prior to authorization, EPA may notify you that an individual permit application is necessary in accordance with Part 1.4.5. However, EPA may authorize your coverage under this permit after you have included appropriate controls and implementation procedures designed to bring your discharge into compliance with water quality standards. In the absence of information demonstrating otherwise, EPA expects that compliance with the stormwater control requirements of this permit, including the requirements applicable to such discharges in Part 3.2, will result in discharges that will not cause, have the reasonable potential to cause, or contribute to an excursion above any applicable water quality standard.

1 Parts l. l .d.i and l. l .d.ii do not include sites currently covered under the 2003 or 2008 CGPs, which are in the process of obtaining coverage under this permit, and sites covered under this permit, which are transferring coverage to a different operator.

2 Notwithstanding a project being made ineligible for coverage under this permit because it falls under the description of Parts 1.1 .d.i or l. l .d.ii, above, EPA may waive the applicable requirement after specific review if it determines that coverage under this permit is appropriate.

Inspection Rcquir~ments for NPDES Compliance

EPA Construction General Permit Part 4 inspection requirements for NPDES complia·nce:

Inspection Frequency: You must conduct inspections in accordance with one of the two schedules listed below.

You must specify in your SWPPP which schedule you will be following.

1. At least once every 7 calendar days, OR

2. At least once every 14 calendar days and within 24 hours of the end ofa storm event of0.5 inches or greater. (If this option is chosen, a rain gauge is required to be on-site: The SWPPP should also include a daily rainfall log.)

Case-by-Case Reduction.s ill Inspection Frequency: You may reduce your inspection frequency to at least once every month if: ·

1. The entire site is temporarily stabilized, 2: Runoff is unlikely due to winter _conditions (e.g., site is covered with snow, ice, or the ground is frozen), or

3. Construction is occurring during seasonal arid periods in arid areas and semi-arid areas.

Inspection Waiver for Frozeii Conditions: A waiver of the inspection requirements is av~ilable until one month before thawing conditions are e;xpected to result in a discharge if all of the following requirements are met:

· 1. The project is located in an area where frozen conditions are anticipated to continue for extended periods of time (i.e., more than one month);

2. Land disturbance activities have been suspended; and

3. The beginning and ending dates of the waiver period are documented in the SWPPP.

Qualified Personnel: Inspections must be .conducted by qualified personnel (provided by the operator or cooperatively by multiple operators). "Qualified personnel" means a person knowledgeable in the principles and practice of erosion and sediment controls who possesses the skills to assess conditions at the construction site that could impact stormwater· quality and to assess the effectiveness of any sediment and erosion control measures · selected to control the quality of storm water discharges from the construction activity. ·

Scope of Inspections: Inspections must include all areas of the site disturbed by construction activity and areas used for storage of m!lterials that are exposed to precipitation. Inspectors niust look for evidence of, or the. potential for, pollutants entering the stormwater conveyance system. Sedimentation and erosion control measu·res must be observed to ensure proper operation. Discharge .locations must be inspected to .aseertain whether erosion control measures are effective in preventing significant impacts to waters of the United States, where accessible. Where discharge locations are inaccessible, nearby downstream lqcations must be inspected to the extent that such inspections are practicable. Locations where vehicles enter or exit the site must be inspected for evidence of off-site sediment tracking.

All reports required by this permit, iiicluding th'e SWPPP, S.WPPP amendments, and inspection reports must be signed by a person described in Appendix G, Subsection 11.A (below) or by a duly authorized representative of that person.

1. For a corporation: By a responsible corporate officer. For the purpose of this Part, a responsible corporate officer ineans: (i) a president, secretary, treasurer, or vice-president of the corporation in charge .of a principal business function, or any other person who performs similar policy- or decision-making functions for the corporation, or (ii) the manager of one or more manufacturing, production, or operating facilities, provided, the manager is authorized to make management decisions which govern the operation of the regulated facility including having the explicit or implicit duty ofmakirig major capital investment rei;:ommendations, and initiating and directing other comprehensive measures to assure long term environmental compliance with environmental laws and regulations; the manager can ensure that the necessary systems are established or actions taken to gather complete and accurate information for permit application requirements; and where authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures.

2. For a partnership or sole proprietorship: By a general partner or the proprietor, respectiv~ly; or

· 3. For a municipality, state, federal, or other public agency: By either a principal executiv~ officer or ranking elected official. For purposes of this Part, a principal executive officer of a federal agency includes (i) the chief executive officer of the agency, or (ii) a senior executive officer having responsibility for the overall operations of a principal geographic unit 9fthe agency (e.g., Regional Administrator of EPA). · ·

A person is a duly authorized representative only if:

The authorization, is made in writing by a.person described in Appendix G, Subsection 11.A;

The authorization specifies either an individual or a position having responsibility for the overall operation of the regulated facility or activity such as the position of plant manager, operator of a well or a well field, superintendent, positfon of equivalent respon.sibility, or an individual or position having overall responsibility for environmental matters for the company. (A duly authorized representative may thus be either a named individual or any individual occupying a named position); and ·
