Has WFL applied for the Montana Sage Grouse Habitat Conservation Program Permit? Is the contractor responsible for the costs and implimentation of the permit? This may have a impact the project as to where a Gravel Pit may be placed and other restrictions related to the permit. Unless you apply for the permit you have no idea what may be involved.
Yes; WFL has the permit. No; the contractor is not responsible for the cost of the actual permit but is responsible for the cost of the implementation of the permit.
