Parts, materials, and processes shall be substituted when the Contractor has upgraded or altered for product improvement, convenience, or for standardization, with the following considerations at the discretion of the COR:
a) Such defects as nicks or scratches shall be appropriately dressed and coated, if necessary, with a preservation intended to increase the chance that the useful life of the item will not be reduced by rust or corrosion.
b) Structural parts requiring replacement may be replaced with material having strength and corrosion resistance characteristics equal to or better than the material being replaced.
Contractor documentation of such changes shall be approved by the COR in accordance with the Configuration Management Plan (CMP) and maintained via the System Technical Data Package (TDP).
c) Cracks in non-metallic parts may be patched using commercial bonding materials providing such repairs do not result in the degradation of the designed functional characteristics of the piece. Contractor documentation of the identity of the material used shall be maintained.
3.5 Beyond Economical Repair of Assets (CLINs 0002 thru 0029)
Contractor is responsible for determining when an asset is Beyond Economical Repair (BER) with Defense Contract Management Agency (DCMA) concurrence. BER is defined as 75% of the purchase price of an identical new asset. The Contractor will obtain concurrence from the COR prior to scrapping any assets which are BER. Any residual scrap material will be forwarded to the Contractor’s Property Management and then submitted to the DCMA Plant Clearance Officer for disposition instructions.
Contractor, at their option, may choose to repair an asset that would otherwise be defined as BER if the item is obsolete or diminishing manufacturing sourced. The Contractor shall notify the COR prior to the repair.
Contractor, at its discretion, may repair and/or cannibalize an asset defined as BER if a replacement cannot be reasonably obtained. The Contractor shall notify the COR prior to the repair.
Once an item is determined to be BER, the Contractor shall make provisions to purchase replacement assets, if an assets are available. The Contractor shall provide a List of Scrapped Assets to the Government IAW Contract Data Requirements List (CDRL) A001.

Classification disagreements shall be referred to the PMA260 Configuration Manager for a decision and the Procuring Contracting Officer (PCO) will document and disseminate the decision in writing via a contract letter. Variances are a temporary departure from requirements and granted on a case-by-case basis. Variances do not constitute a permanent change to the CASS, RTCASS, or eCASS baselines as defined by the TDP, prime and critical item fabrication and development specifications, and Acceptance Test Plans. If the Contractor intends to temporarily depart from the requirements, the Contractor shall submit a RFV and obtain Government approval prior to repairing or refurnishing the item.

Planned and Unplanned Initial Outfitting retail stock requisitions (QZ/QU fund code) shall be filled by the Contractor on a best effort basis utilizing Navy retail/GFM stock*, contractor owned stock**, or stock procured via AVCAL CLIN*** provided that the PBL performance metric and Fleet support are not adversely impacted. In the event that the filling of any stock requisition would adversely impact PBL performance, the Contractor will contact the NAVSUP WSS Inventory Manager for a determination of one of the following:
1) The requisition will be returned to NAVSUP WSS or
2) The requisition will be filled using Navy retail stock* and the Contractor may request exemption of that requisition from the availability metric in accordance with paragraph (a) below.
a. The Contractor may request an exemption of a specific requisition from the base requisition count used for the availability metric. If it is determined by the PCO that the exemption is warranted, that requisition shall be excluded from the base count. Instances where such an exemption may be granted include:
i. The Contractor filling projected/planned QZ/QU Fund Code outfitting requisitions when the Government has not procured Retail Spares in a timely manner; in accordance with paragraph 6.
ii. The Contractor filling unplanned QZ/QU Fund Code outfitting requisitions, which results in a deficiency in the required support quantity** or has been identified as an obsolete and/or end of life issue; in accordance with paragraph 6.
* Note: It is assumed that the Government will procure all assets (if applicable) associated with the filling of requisitions for paragraph 6.
** Note: The required support quantity may consist of both Contractor (when excess is identified) and Government material; or only Government material. If filled with Contractor stock, it is understood that the government will eventually replace Contractor stock that was used to fill the outstanding QZ requisition.
*** Note: AVCAL CLIN funding permitting is to obtain spares when Navy retail/GFM stock or contractor owned stock levels are inadequate to meet the stock requisition. In the case the contractor uses a contractor owned asset dropping their level or ability to meet contract metrics, the CLIN is meant for them to re-purchase the asset(s) to maintain proper metric/wholesale levels.

At the inception of any service requirements under this PSOW, if the CASS, RTCASS, eCASS stations and Ancillary equipment are not at the current U.S. Navy configuration level, the Contractor may request additional costs to support a station not at the current configuration level. Any changes needed to bring the station to the current configuration level shall be negotiated and incorporated via a contract modification.
5.0 OPERATIONAL SURGE VARIATION (CLINs 0002 thru 0029 )
It is recognized that due to unforeseen circumstances affecting the usage of CASS FoT stations during the contract period of performance, the requisition rate may fluctuate. The unforeseen circumstances include such activities as international conflict and operations tempo of Naval activities that cannot be reasonably predicted during the establishment of the expected contract.
Accordingly, the parties agree to enter into negotiations to establish an equitable adjustment should the actual 7R requisition rate, caused by these circumstances, exceed or fall below the parameters established in the paragraph below. Requisition rate increases caused by Contractor lack of diligence shall not be recognized.
The 7R requisition rate will be established by the Contractor for Fleet and Non-Fleet activities for CASS FoT. Should the aggregate average number of requisitions, during any continuous six-month period, exceed or fall below a variation of 15% of the established requisition rate, the parties shall enter into negotiations for an equitable adjustment. The negotiations shall be initiated by a proposal from the Contractor for the amount of cost above or below the 15% allowable variation. During any continuous six-month operational surge period, when the aggregate average number of requisitions exceeds or falls below 15% of the established requisition rate as identified using the CDRL A009 report, penalties for all service levels will be waived. The contractor shall be responsible for all penalties accrued outside of an established operational surge period.

The Contractor shall be required to provide supporting information on spares pools and usage/demand rates to support the request for use of reclamation assets. Requests in excess of the cumulative quantity of available assets/stations may be provided at the sole option of the Government and shall not constitute justification to avoid penalty clauses outlined in the appropriate appendix. Reclamation assets are Repairables (7R COG) and Consumables (1R COG). The Government plans to make available the following configuration of stations to the Contractor for use of reclamation each year is as follows:
Table 3 - Expected Reclamations
