****This document is a draft of anticipated evaluation criteria for the solicitation associated with RFP 47PL0123R0035. All references to other attachments are not being provided with this Pre-Solicitation notice, whether they are highlighted or not.***

SECTION L – Instructions, Conditions and Notices to Offerors

L-1. GENERAL INFORMATION

This solicitation is set aside for eligible Small Business Concerns Only.

L-1.1. General Description of Work General Services Administration (GSA) Region 10 intends to conduct this acquisition by use of Competitive Source Selection Procedures in accordance with the provisions set forth in the Request for Proposal (RFP), FAR Part 15. The Government intends to award 4-7 Indefinite Delivery/Indefinite Quantity contracts as part of a Multiple Award Task Order Contract (IDIQ) pool forWestern MATOC for GSA Region 10, to the offeror(s) submitting proposals determined to be most advantageous to the Government; price, and other factors considered. Task orders awarded under this IDIQ shall be firm fixed price (FFP). The intent is to award 4-7 contracts; however, if the Contracting Officer determines during the source selection process that fewer or more than that number of contracts should be awarded, the Contracting Officer has the discretion of adjusting that number (higher or lower), or awarding none at all. In any case, the Government may not award any contract if the resulting contract would not represent a "best value" to the Government using trade-off selection procedures as required by the Federal Acquisition Regulation (FAR). It is strongly suggested that the provisions stated in section L and M be fully studied prior to assembly of the proposal.

L-1.2. Copies of Solicitation Documents and Amendments

Copies of the solicitation are available by INTERNET ACCESS ONLY. All solicitation documents will be posted to the System for Award Management (SAM) website at: http://www.sam.gov under solicitation number 47PL0123R0035 titled Western Multiple Award Task Order Contract MATOC Replacement.

It shall be the contractor’s responsibility to check the website for any amendments. The offeror shall submit in the proposal all requested information specified in this solicitation. There will be no public opening of the proposals received as a result of this solicitation.

Offerors are encouraged to form teaming arrangements, joint ventures, or consortiums involving two or more small businesses. For consolidated acquisitions, the size standard is applied to the individual http://www.fbo.gov/ person or concerns, not to the combined assets of the joint venture. Note: This type of strategy allows members of the Small Business Community to leverage their capabilities to participate at the prime level without invalidating their status as small businesses.

A list of interested vendors (potential offerors and subcontractors) is available on the sam.gov website.

L-1.3. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. The offeror shall submit in the proposal all requested information specified in this section of the Request for Proposal RFP) solicitation at or before the exact time specified. Failure to meet a requirement may result in an offer being ineligible for award.

L-1.4. The Contracting Officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the Contracting Officer will review this determination and if, in the Contracting Officer's opinion, adequate price competition exists, no additional cost information will be requested. However, if at any time during this competition, the Contracting Officer determines that adequate price competition no longer exists; offerors may be required to submit information to the extent necessary for the Contracting Officer to determine the reasonableness and affordability of the price.

L-1.5. Exceptions / Assumptions (if required)

Identification and explanation of any exceptions or deviations. Any assumptions used in the proposal preparation must be fully explained. Offerors must clearly identify any exceptions to the solicitation terms and conditions and provide complete accompanying rationale. Exceptions taken to terms and conditions of the TORFP, to any of its formal attachments, or to other parts of the solicitation shall be identified. Each exception shall be specifically related to each paragraph and/or specific part of the solicitation to which the exception is taken. Provide rationale in support of the exception and fully explain its impact, if any, on the performance, schedule, cost and specific requirements of the solicitation. This information shall be provided in the format and content of Table 1 listed below. Failure to comply with the terms and conditions of the solicitation may result in the offeror being removed from consideration for award.

L-1.6. North American Industry Classification System (NAICS) code and Small Business Size Standard. The NAICS code for this acquisition is 236220. The small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture is $45 million.

L-1.7. Government Point(s) of Contact. The Contracting Point(s) of Contact (POC) are the sole point of contact for this acquisition. Address any questions (including technical questions) or concerns you may have to the Contracting POC(s). This may be done via email.

Task Order: The Contracting Point(s) of Contact (POC) will be provided at the Task Order level.

L-1.8. Errors and Omissions. If an offeror believes that the requirements in these instructions contain an error, omission, or are otherwise unsound, the offeror shall immediately notify the Contracting POC in writing (email is the preferred method) with supporting rationale. The offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussions.

L-1.9. Other Information Required: Provide the name, title and telephone number of the company/division point of contact regarding decisions made with respect to your Proposal and who can obligate your company contractually. Also, identify those individuals authorized to negotiate with the Government.

L-2. SPECIFIC INSTRUCTIONS (Organization/Distribution/Number of Copies/Page Limits)

L-2.1. This Request for Proposal (RFP) does not commit the Government to any costs incurred in the preparation and submission of a proposal or for any other costs incurred by any firm submitting a proposal in response to this solicitation. Note specifically that the offeror will not be participating in a sealed bid procurement process under this acquisition method.

Issuance of this RFP does not constitute an award commitment on the part of the Government.

L-2.2. The Government reserves the right to discuss aspects of proposals with offerors in the competitive range, if a competitive range is determined to be necessary, upon completion of the evaluation, and to award a contract. Offerors are advised that the Government may make an award without discussions, clarifications, or any contact concerning the proposals received.

Therefore, proposals should be submitted initially on the most favorable terms from a price and technical standpoint. Do not assume that offerors will be contacted or afforded an opportunity to clarify, discuss or revise their proposals.

L-2.3. Proposals must set forth full, accurate, and complete information as required by this RFP, (including attachments), if applicable. The penalty for making false statements is prescribed in 18 U.S.C. 1001.

L-2.4. Each offeror shall submit a proposal that consists of four (4) Volumes:

Volume I - Administrative Matters Volume II - Experience and Approach

Volume III - Past Performance Information

Volume IV - Price Proposal

L-2.5. Binding and Labeling: Volumes I, II, III and IV may not be submitted together within the same binding (separate volume submissions are required). Each volume shall include, as a minimum, the following:

● Volume number on proposal cover.

● The prime, consortium, or joint venture’s name, address, telephone number, and e-mail address shall appear in the lower left corner of the Proposal cover, title page and table of contents of any document/volume to be evaluated.

● Signature of the official that can bind the firm shall appear on the title page.

● Proposal volume cover format is at the offeror’s discretion so long as the information required by this paragraph and subsequent paragraphs are met.

● Table of contents and a cross-reference to the solicitation paragraphs. Offerors shall include a cross reference table showing where RFP requirements can be found in their proposal.

● List of tables/figures/acronyms.

● Volume number, factor and date submitted shall appear in the bottom right corner of each page (along with the revision number for the amended page, if necessary).

L-2.6. Proposals shall be submitted in (4) four volumes as indicated in M-1.. Each volume shall include one attachment with all supporting documents.

*NOTE: In accordance with FAR Subpart 4.8, "Government Contract Files," the government will retain one copy of all unsuccessful Proposals. The government will destroy extra copies of such unsuccessful Proposals.

L-2.7. Proposals shall be received No Later Than: TBD One electronic copy in a text searchable unlocked/unprotected portable document format (pdf) for each volume as indicated in M-1, and an unlocked/unprotected Excel document for all pricing (seed project), which includes all attachments of each volume to the following:

The Packaging that contains the Proposal shall be marked: Proposal for Solicitation 47PL0123R0035 titled Region 10 Western Multiple Award Task Order Contract MATOC Replacement.

Be sure to apply all appropriate markings including those prescribed in accordance with FAR 52.215-1(e), "Restriction on Disclosure and Use of Data."

Offers shall be submitted at the location stated and by the time and date as specified in Section A, Page 1 (SF1442) Attachment D.

L-2.8. Page Format Restrictions and Limitations

L-2.8.1. Page Limitations: Page limitations shall include typewritten text pages, charts, graphs, figures, diagrams, schematics, etc., aside from those items specifically stated as exempt from the page count.

Outlines and other similar information documents shall be included as numbered pages - no exceptions. The number of pages per factor shown in Table L-1 below may be varied by the offeror to suit its needs for certain identified factors, however, the total number of pages for the Proposal submitted shall not exceed seventy-five (75) pages for Volume II, fifty (50) pages for factors 1-2 and twenty-five (25) pages for Volume II, Factor 3, Technical Approach for the Seed project. Compliance with page count limits shall be verified via the electronic copy. If exceeded, the excess pages will not be read or considered in the evaluation of the Proposal.

L-2.8.2. Pages Counted: Each page shall be counted except the following: cover pages, executive summary, table of contents, title page, list of tables/figures/acronyms, glossaries, separator tabs, dividers, blank pages, Past Performance Questionnaires, Volume III in its entirety, and Volume IV Price. NOTE: Proposals that exceed the page limits will have only those pages that are within the page count limits evaluated. All information appearing thereafter will not be evaluated.

L-2.8.3. Page Size: Unless otherwise stated, a “page” is defined as being one side of an 8.5” x 11” sheet of paper. Pages shall be typewritten, except for the reproduced sections of the solicitation document, which should be readable, and the font size shall be Times New Roman, 12 point (no exceptions)., this includes, but is not limited to all charts, graphs, figures, diagrams, and schematics. All text shall be legible and easily read. Margins on all four edges of each sheet will be at least one-half (0.5) inch. Proprietary statements, security markings, and page numbers can fall within the defined margin area. Pages shall be numbered sequentially by volume.

L-2.8.4. Indexing: Each volume shall contain a more detailed table of contents to delineate the subparagraphs within that volume. Tab indexing shall be used to identify factors.

L-2.8.5. Foldouts: Legible tables, charts, graphs and figures shall be used wherever practical to depict organizations, systems and layout, implementation schedules, plans, etc. For Offeror-created tables, charts, graphs and figures, the font shall be Times New Roman, 12 point (no exceptions). All information (except documentation identification, solicitation number, and page numbers) shall be contained within an electronic image area of 10” x 16”.

L-2.8.6. Format: The offeror shall submit (1) one electronic copy in a text searchable unlocked/unprotected portable document format (pdf) for each volume as indicated in M-1, and an unlocked/unprotected Excel document for all pricing (seed project), Table L-1 - Format

Tab 1: SF 1442 - Solicitation, Offer, and Award (Section A) Offerors shall submit a lump sum price proposal on the SF1442 with a separate cost breakdown with Factor 5. The cost breakdown shall be in CSI Level IV format and shall include copies of all subcontractor quotes.

L-3. VOLUME I - ADMINISTRATIVE MATTERS

L-3.1. Executive Summary. Volume I of the Proposal shall include an Executive Summary which should include an introduction of the Project team. The Executive Summary shall not exceed three (3) pages in length.

L-3.2. Proof of Bonding Capacity. The offeror shall submit a letter of bonding ability on the Surety’s letterhead stating the Offeror has the bonding capacity for projects up to $3.75M.

L-3.3. Representations, Certifications, and Other Statements of Offerors (Section K) The offeror shall fill out in its entirety all of Section K that applies to the offeror. The offeror’s responsibility will be reviewed in accordance with FAR Part 9. Offeror shall complete electronic Annual Representations and Certifications (formerly in ORCA) in conjunction with required Entity

(formerly contractor registration in the Central Contractor Registration (CCR) database) accessed via https://www.sam.gov.

L-3.4. Joint Venture Agreement (as applicable)

All offers submitted by joint ventures must include a copy of an executed joint venture agreement (with original signatures) which fully discloses the legal identity of each member of the joint venture, the relationship between the members, the form of ownership of each member, and any limitations on liability or authority for each member. If the joint venture establishes a Bona Fide Office as described in Factor 2, Subfactor 2, Resource Management that is located within the described area of responsibility, please note that in the agreement submitted with proposal.

An authorized representative of each member of the joint venture must sign the SF 1442 accompanying an offer regardless of any agency relationship established between the members.

In the case of corporations that are joint venture members, the corporation secretary must certify that the corporation is authorized to participate in the joint venture, either by so certifying in the joint venture agreement, or by submitting a separate certification to the Government. The joint venture must also provide a certificate that identifies a principal representative of the joint venture with full authority to bind the joint venture.

Representations and certifications, financial information, and past performance information must be submitted for each member of the joint venture.

L-3.5. VOLUME II - EXPERIENCE AND APPROACH

L-3.6. Tab 1, Factor 1 - Relevant Experience (Examples of Previous Relevant Experience

- Construction and Design Projects)

“Relevant” is defined as projects similar to the projects described in the Statement of Work for this solicitation in scope, magnitude and complexity and that have a logical connection with the requirements of this RFP. For each project listed, the offeror shall provide, at a minimum, the information shown on Attachment 2 – Relevant Construction Experience Information Sheet and Attachment 3 – SF 330 Architect-Engineer Qualifications located at the end of this document.

Standard for Evaluation: This factor will be evaluated for the quality of experience demonstrated.

Offerors that demonstrate a higher degree of experience in the areas of relevant experience identified; occupied federal facilities, work in historic facilities (including those on the National http://www.sam.gov/

Register of Historical Places), and projects of similar scope and complexity, may be evaluated more favorably.

Submission Requirements: The Proposal shall include up to, but not more than; five (5) construction projects and include up to, but not more than; five (5) project examples demonstrating relevant design experience that have been executed by the offeror and its team members as either a prime contractor or a subcontractor within the last six (5) years. Examples of experience areas that are considered especially relevant include:

1) work completed for federal government agencies while facilities are occupied; ideally in the geographic areas covered by this RFP

2) work in historical facilities to include facilities that are on the National Register of Historical Places,

3) work demonstrating a broad range of scope and complexity, to include but not limited to:

a. Tenant Improvements

b. Minor repair and alteration projects, to include but not limited to:

i. Building envelopes,

ii. Conveyance systems,

iii. Roofing,

iv. Mechanical/Electrical/Plumbing systems, and

v. Exterior improvements and site/civil work.

c. Variety of delivery methods as identified in the solicitation Statement of Work:

i. Non-Complex Construction

ii. Design-Bid-Build

iii. Design-Build

iv. Bridging Design-Build

For each project listed, the offeror shall provide, at a minimum, the information shown on Attachment 2 – Relevant Construction Experience Information Sheet and Attachment 3 – SF 330 Architect-Engineer Qualifications located at the end of this document. Each project submitted must be at least 75% complete within the last five years from the Proposal closing date.

L-3.7. Tab 2, Factor 2 - ORGANIZATION & TECHNICAL APPROACH

L-3.7.1. Factor 2, Subfactor 1 - Organization History and Key Personnel

Submit an introduction and brief history of the firm as it relates to commercial construction and the goals and objectives of this contract. This section should include the following, at a minimum:

1) Firm History - Provide an overview of the firm’s history and experience with commercial construction, specifically address the firm’s history regarding the four project delivery methods, growth objectives and any other pertinent information regarding how the firm aligns with this GSA MATOC IDIQ contract.

2) Project Team/Key Personnel – Provide, either in narrative and/or by chart, information regarding the project team and its relative structure that will be assigned to this IDIQ contract.

Provide professional biographies of the proposed Project Manager(s) and Superintendent(s) for this project. Additionally, incorporate professional biographies relevant to key A-E team members to include, at a minimum; the firms (including key subconsultants) Principals and Project Managers.

a. Construction Project Manager: The Construction Project Manager shall have a baccalaureate degree in a relevant field such as engineering, architecture, construction management or equivalent with a minimum of five (5) years of experience managing construction projects and having managed a minimum of two (2) projects that demonstrates the ability to construct projects that are similar in scope, magnitude, and complexity to the project in this solicitation OR a person in the construction field with a minimum of seven (7) years as a project manager on projects similar in scope, magnitude, and complexity to this solicitation. Clearly state in your proposal the number of years of experience that this proposed team member has served as a Construction Project Manager.

b. Project Superintendent: The Project Superintendent shall have a minimum of five (5) years of experience as a project superintendent on construction projects of similar scope, magnitude and complexity. The experience should demonstrate construction knowledge consistent with the type of construction provided for in this solicitation. Clearly state in your proposal the number of years that this proposed team member has served as a Project Superintendent.

c. Design Project Managers: The design project managers shall have a Baccalaureate Degree in Engineering, Architecture or Construction Management and be licensed as a Professional Engineer or Architect, with a minimum of 7 years project management experience, and having managed projects that demonstrate the ability to manage projects similar in scope, cost and complexity to the project in this solicitation.

Provide information relevant to each anticipated subconsultant discipline, at a minimum;

architectural, mechanical, electrical, structural, and industrial hygienist.

4) Resumes - shall be limited to no more than 2 pages per individual and shall include, at a minimum, the following:

● A description of training and experience in respective areas of expertise.

● Duties proposed to be performed in the project for this Solicitation if awarded the contract.

● A description of current and proposed position titles, education, professional licensing, and any personal awards.

● Clearly state in each resume the number of years of experience that the individual has served in his/her proposed respective role (i.e. as a Project Manager).

● Provide no more than three (3) project examples demonstrating requisite experience as identified above.

SEE RESUME FORMAT (See Section J - Exhibit 2, Resume Form):

Any changes to the proposed key team members after award MUST be approved in writing by the Contracting Officer and shall only be approved upon demonstration of “equal or better” qualifications when the new individual is compared to the minimum qualifications and experience of this Solicitation/Contract as well as the level of qualifications and experience of the original proposed individual.

L-3.7.2. Factor 2, Subfactor 2 - Resource Management

Description: Provide information regarding resource management as it relates to this IDIQ contract. Resources include personnel of the prime, i.e. project manager, superintendent, project coordinator(s); subcontractors, architect and engineering consultants, financial capability, and ability to manage simultaneous projects in multiple locations. Particular attention should be given toward:

(a) Addressing the Offeror’s approach to appropriately staff projects throughout the geographical area covered by this contract. Identify primary and satellite office locations and intended means to cover projects and to be readily available to cover project needs outside of firms established office locations.

(b) Management of projects in facilities identified as eligible for or registered on the National Register of Historical Places. Identify strategies for assembling knowledgeable and skilled consultants and tradespeople to accomplish the work and how the Offeror and its subconsultants and subcontractors would ensure compliance with the Secretary of Interior’s Guidelines for the Treatment of Historic Properties.

(c) Management of Design-Build contracts from TORFP to contract closeout.

Identify and describe the roles and responsibilities of the various team members and stakeholders, and the management of the project to ensure a collaborative and quality project completed within given time and cost constraints.

(2) Concurrent Projects – Discuss the firm’s current projects/contracts and how it proposes to manage the GSA work concurrently.

L-3.7.3. Factor 2, Subfactor 3 - Contract Execution Plans

1) Communication Plan:

a) Internal Project Communication Plan – Provide a summary of how the firm shares information internally about potential and current projects. Include insight into how the firm determines to pursue solicitations, to include Task Order RFP’s, management of daily activities for on-site work, closeout.

b) Client Communication Plan – Provide a summary of how the firm intends to communicate with GSA as a client.

2) Schedule Management – Provide information on how the firm will manage individual project schedules and program level schedules for all GSA projects.

3) Budget Management – Provide information regarding corporate management of project budgets, specifically what roles have authority to order materials, secure subcontracts, etc.

4) Change Control Plan – Discuss how the firm approaches and processes changes under the four delivery methods anticipated for this contract.

5) Project Quality Control Plan (QCP) – Provide a corporate level project Quality Control Plan (QCP) which addresses quality control for task and project related submittals, inspection of installed work, constructability issues for design-bid-build projects, design errors and omissions resolution and sustainability and waste management practices.

6) Corporate Safety Plan – Provide corporate level safety and health plan. Project closeout – Provide project closeout coordination processes and procedures.

L-3.7.4. Factor 2, Subfactor 4 – Self Performance & Subcontractor Management

1) Describe what type of work the Offeror will typically self-perform and the qualifications of resources available to perform proposed work.

2) Provide a list of key subcontractors; to include:

a. Role of each subcontractor to which the Offeror has established experience working with, the length of the partnership/experience working with those subcontractors and if that role would be expected to change in the performance of task orders on this contract.

b. Subcontractor Sourcing – Discuss current practices for soliciting subcontractors for all project delivery methods.

c. Subcontract Selection – Discuss how subcontract firms are selected for projects and when they are typically selected (pre-award agreements, post award, etc).

d. Subcontract Management Practices – Discuss the firm’s approach to total subcontractor management for the entire project lifecycle and flow down of terms to subcontract agreements, compliance and quality control procedures, payment, and administrative processes like certified payrolls.

L-3.7.5. Factor 2, Standard for Evaluation

This factor will be evaluated based on the completeness and reasonableness of Offeror’s narrative in comparison to the requirements of the Scope of Service and contract. The Offeror’s proposal must fully address all of the elements included in the description of the factor above.

The proposal shall be sufficient in detail to provide the Government with a reasonable understanding of how the Offeror intends to perform the work under the IDIQ over the total period of performance. Sufficient knowledge and expertise shall be demonstrated for all items in each of the four project delivery methods as required in the Scope of Services. This factor will be assessed with a single rating as a complete and whole factor.

L-3.8. Tab 3, Factor 3 - Seed Project Technical Approach

L-3.8.1. Factor 3, Subfactor 1 - Organizational Structure

L-3.8.2. Factor 3, Subfactor 2 - Proposed Work Plan & Schedule Management (Technical Approach)

1) The technical approach shall not make reference to price data. The technical approach will be evaluated strictly on technical acceptability. As the technical approach will primarily describe the capability of your organization to perform the requirements of the contract, it should be specific and complete in every detail. A positive statement to the effect that you will accomplish all requirements per the statement of work (SOW) is not acceptable. The proposal shall not merely offer to perform work in accordance with the SOW, but shall outline the actual methods proposed as specifically as possible. It is the Offeror’s responsibility to ensure the completeness of the technical approach; hence, the Government technical review team will evaluate on the basis of the information provided in the technical approach. The Government shall not assume that an Offeror possesses any capability unless specified in the proposal. All requirements specified in the SOW are mandatory. By submission of a proposal, the Offeror represents that they will perform all requirements specified in the SOW.

a. Using the task order project documents – See Section J - Attachments B - H.

Demonstrate the capabilities of your firm to execute the project described. Documents may include but are not limited to concept drawings, execution narratives, written discussions, supporting engineering and planning documents. Describe procedures, processes and methods for tracking the progress of the project and interface with the Government from beginning to end. Provide a standard process or checklist used to validate and understand the customer’s requirement.

2) Narrative shall include name of key prime contractor employees and qualifications of each discipline (to include any designer) that will be working on this project. This narrative must include trades for subcontractors and names of subcontractors that will be working on this project. Manufacture product information is to be included as attachment to narrative. Narrative shall demonstrate Offeror’s ability to effectively coordinate trades, ability to complete the project within the approved schedule, and critical phasing of work. Narrative should demonstrate offerors’ ability to ensure delivery of quality product and service; and management of resources/subcontractors.

a. The Contractor shall submit the Project Schedule, Work Breakdown Structure Tier III; this level subdivides each of the major work packages into major work components or deliverables. The Contractor shall submit the Project Schedule that can be manipulated and is editable.

b. The Contractor shall submit the Project Schedule electronically that can be readily uploaded into Microsoft Project 2010® and hard copy print format. Offeror shall provide a Preliminary Project Schedule narrative and a project schedule in MS Project format. The proposed schedule will run from the contract award date through the required date for substantial completion of construction and all punch list items. Detailed methods of accelerating the proposed schedule may be evaluated more favorably.

STANDARD FOR EVALUATION:

The Government shall evaluate the relative merits of each Offeror’s Technical Approach as it applies to the Scope of Work and the Schedule provided by the offeror.

L-4. VOLUME III - PAST PERFORMANCE

L-4.1. Tab 1, Factor 4, Subfactor 1 - Past Performance Relevance and Recency

The offeror shall provide past performance information for each project listed in the offeror's previous experience in response to Factor 1 Relevant Experience of this solicitation. The title of the project shall be consistent with the project experience description name as required in technical Exhibit 3.

For each project the offeror shall include: Project # - Title (matching Project Name for previous experience provided under Factor 1 Relevant Experience); Contract and task order number as applicable; Client Point of Contact including email and phone number, and a description of their role for each of the projects submitted in Volume 2, Factor 1. The offeror shall provide information to document the relevancy and recency of each previous experience project as it relates to requirements of Section C of this solicitation.

Common aspects of relevancy include similarity of services/support, complexity, dollar value, contract type, and degree of subcontract/teaming. With respect to relevancy, more relevant past performance will typically be a stronger predictor of future success and have more influence on the past performance confidence assessment than past performance of lesser relevance.

During past performance evaluation, the Government reserves the right to obtain past performance information from any available source. The Government will consider information submitted by the offeror, Government databases such as Contractor Performance Assessment Reporting System (CPARS) as well as any other relevant and reliable sources of documented past performance information. The Government will evaluate the relevance of the information, the source of the information, and general trends in performance, along with any other information, which will help the Government assess performance risk.

Information on significant problems encountered, customer dissatisfaction, and corrective actions taken should be provided.

The Government intends to assess the relative risks associated with the offeror's performance based on the past performance information provided in the Proposal. A significant achievement, unexplained or unresolved problem, or lack of relevant data may significantly impact the risk rating by the Government.

Therefore, it is incumbent upon the offeror to include all relevant information, including demonstrated corrective actions, in its Proposal.

In addition to the project information requested in this subfactor, the offeror shall also provide notification and information concerning any projects where the right to proceed was terminated for default during the last three (3) years, or state that there were none.

Offerors providing no past performance record will be given a neutral rating.

L-4.2. Factor 4, Subfactor 2 – Performance Quality Assessment

The Contractor Performance Assessment Reporting System (CPARS) is a required system and one source of past performance information, when available. In addition to CPARS, the use of Past Performance Questionnaires (PPQs, Section J - Exhibit 3 Form PPQ of this solicitation) may be utilized to present relevant and recent past performance information. Completed PPQs should be submitted utilizing the questionnaire shown at Section J - Exhibit 3 Form PPQ of this solicitation. Offerors shall not incorporate by reference into their Proposals PPQs previously submitted for other Request for Proposals.

Ensure correct phone numbers and email addresses are provided for the client point of contact. This does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests on the offeror.

If the offeror is unable to obtain a completed PPQ from a client for a project(s) before the Proposal closing date, the offeror should complete and submit with the Proposal the first page of the PPQ (Section J - Exhibit 3), which will provide contact and client information for the respective project(s). Discrepancies between CPARS evaluations and CPARS evaluations and information provided in PPQs will be resolved by the Contracting Officer during the source selection evaluation process.

Completed PPQs shall be sent directly to the Government’s point of contacts, Maribeth Bonner, Contracting Officer, via email at maribeth.bonner@gsa.gov and Savanah Cilk, Contract Specialist, via email at savanah.cilk@gsa.gov, prior to the Proposal closing date. The only information in the subject line shall include: 47PL0123R0035 titled Western Multiple Award Task Order Contract MATOC Replacement. Project Owner Name and the Contractor being rated.

NOTE: Completed PPQ shall not be reviewed by the Offeror or subcontractor prior to submission. The PPQ must be submitted by the client/evaluator directly to the POC noted above. The PPQ shall include project owner and the contractor being rated.

In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including CPARS, using all CAGE/EIN numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s Proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (ESRS), and any other known sources not provided by the offeror.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

L-5. VOLUME IV - PRICE

L-5.1. Tab 1 - SF 1442

The offeror shall complete, in its entirety, all of Section A (SF1442), Attachment D, that applies to the Seed Project TORFP and it shall be signed and dated by an official with the authority to legally bind the company.

L-5.2. Tab 2, Factor 1 - Cost/Price Proposal for the Seed Project

The offeror shall provide and clearly describe all assumptions used when developing their Seed project cost Proposal as though the offeror were submitting a Proposal for a new firm fixed-price construction project task order for the seed project in Section J - Attachment F.

The individual tasks associated with executing the seed project with all costs should be broken out appropriately. The offeror should apply the fully loaded hourly rates (exclusive of profit) on each task and shall include any supplies, materials, travel costs, subcontracting costs, etc., that may be needed to carry out the tasks. The offeror shall provide backup material for their costs proposed (i.e., the team subcontractor(s) or other subcontractors cost Proposal(s), Proposals for rental equipment from at least three (3) sources, etc.). If competition was not able to be obtained, offeror should describe what the process used to attempt to obtain competition, and why it ultimately wasn’t successful. The offeror will find the Construction (Davis Bacon) Wage Rate Determination provided in Section J to be used as a minimum base rate only. The adequacy and value of the cost data, whether the costs are realistic for the work to be performed, whether the costs reflect the offeror’s understanding of the requirements, and whether the costs are consistent with the technically proposed method used in the sample problem, will be determined from this information. The Construction (Davis Bacon) Wage Rate Determination provided in Section J - Attachment G, is intended for use in preparing the seed project only. Each task order will have the appropriate wage determination as part of the TORFP/TO Award.

The offeror shall include all professional and support effort such as project management, professional service resources and overhead costs, as applicable. The cost estimate should be submitted in Construction Specifications Institute (CSI) Masterformat ® (2018 edition) at Level 4 and shall provide sufficient information to adequately and accurately capture the projected project costs. Direct costs should be detailed by labor, equipment, and material, and should include subcontractor markups, when applicable. All quotations and documentation will be noted in the Proposal. Indirect cost categories such as prime contractor’s home office and field office overheads and profit should be identified, if applicable, and appropriate costs included for each in the estimate. Bonding costs should be included for the cost analysis. Include all subcontractor quotes/proposals for supporting documentation.

SECTION M - Evaluation Factors for Award

M-1. INTRODUCTION

This section outlines the criteria the Government will use in evaluating the offeror's capabilities and Proposals for the IDIQ contract. The Government will compare each offeror's capabilities and proposal elements against predetermined measures of merit related to the Government's requirement defined herein.

M-2. AWARD OF CONTRACT

M-2.1. The Government intends to award 4-7 Indefinite Delivery/Indefinite Quantity contracts as part of a Multiple Award Task Order Contract (IDIQ) pool, not to exceed a total shared contract capacity of $75 million, resulting from this solicitation to the responsible offerors whose offers conform to the solicitation criteria established in Section L, and M and are considered most advantageous to the Government, price and other factors considered. If the Contracting Officer determines during the source selection process that fewer or more than six (6) contracts should be awarded, based upon the selection criteria, the Contracting Officer has the discretion https://cscheduling.b-cdn.net/free%20downloads/CSI%20Master%20Format%20DIVISIONS%20&%20TITLES%20-%202018%20EDITION.pdf of adjusting that number, or awarding none at all. The contracts will have a five (5)-year base performance period or until the shared contract capacity of $50 million is reached.

M-2.2. The Government reserves the right to conduct discussions with contractors determined to be within the competitive range, if the Contracting Officer later determines discussions to be necessary. It is the intent of the Government to award based upon initial Proposals. Offerors should provide, in their initial Proposal, their best terms from a cost and price and technical standpoint as there may not be an opportunity to revise their Proposal.

M-2.3. The Government may reject any or all offers if such action is determined to be in the best interest of the Government.

M-2.4. General Basis for Award: This is a competitive, best value-tradeoff, source selection that will be conducted in accordance with Federal Acquisition Regulation (FAR Part 15.3) and General Services Administration Manual (GSAM). In using this best value trade-off approach, the Government seeks to award to offeror(s) who gives the GSA the greatest confidence that best meets our requirements considering non price factors and price. The Government intends to award up to six contracts using the Best Value Trade-off technique.

M-2.5. Technical factors will be rated by the use of a numeric rating. The past performance factor will be evaluated as pass/fail or a neutral rating.

M-2.6. A competitive range determination, if necessary, will be determined from the information submitted in the proposals. Discussions, if necessary, will address deficiencies, significant weaknesses and past performance information that an offeror has not had a previous opportunity to address. Exchanges with offerors after receipt of Proposal will be in accordance with FAR 15.306(a) (b) and (d) where applicable.

M-2.7. The Government reserves the right to discuss aspects of Proposals with offerors in the competitive range, if discussions or competitive range determination is determined to be necessary, upon completion of the evaluation, and to award a contract. Offerors are advised that the Government may make award without discussions, clarifications, or any contact concerning the Proposals received. Therefore, Proposals should be submitted initially on the most favorable terms from a price and technical standpoint. Do not assume that offerors will be contacted or afforded an opportunity to clarify, discuss or revise their Proposals.

M-3. EVALUATION OF OFFERS

The evaluation of offers will be based upon an integrated assessment of the evaluation factors and subfactors listed below:

The cost breakdown shall be in CSI Level IV format and shall include copies of all subcontractor quotes.

M-3.1. Order of Importance

The technical (non-price/cost) evaluation factor 1 is the most important and factor 2 is slightly less important than factor 1. However, the total value of Volume II (Experience and Approach) and Volume III, (Seed Project - Technical Approach) when combined, are significantly more important than the total value of Volume IV (Price). The cost and pricing information found in Volume IV will be evaluated in accordance with section M-12. (Updated via AMD 03 Dated 10.22.2018) It is noted that the total value of factors other than cost/price, when combined, are significantly more important than the total value of cost/price. Factors 1 and 2 are considered to be significantly more important than Factor 3. The numeric rating for Factor 1 and 2 will be double the value of the ratings for Factor 3. Factors 1, 2, and 3 will be given a numeric rating for each factor. The total amount of Factors 1-3 will be added together to determine the best technical proposal.

Factor 4 Performance Risk/Past Performance, will be evaluated as pass/fail or a neutral rating.

(1) The Government will award a contract resulting from this Solicitation to the responsible Offeror whose offer conforming to the Solicitation will be the best value to the Government, Total Evaluated Price and other factors considered. In addition to Total Evaluated Price, the following non-price factors shall be used to evaluate offers:

(a) Factor 1: Relevant Experience

(b) Factor 2: Organization & Technical Approach

(c) Factor 3: Seed Project - Technical Approach

(d) Factor 4: Performance Risk/Past Performance

(2) Non-Price Factors, when combined, are significantly more important than Total Price.

NOTE: Assessment of Non-Price Factors/Technical Proposals. GSA will evaluate proposals for best technical proposal solution for this project.

Evaluation will be completed on ratings for factors 1, 2, and 3 (non-price evaluation factors) set forth in the RFP. GSA will assign a numeric rating for each of the evaluation factors for each of the technical proposals received.

Ratings will be:

4 – Excellent (proposal factor significantly exceeds the requirements as described in this Factor)

3 – Very Good (Proposal exceeds the requirements as described in this Factor)
