About this file
This document is an Americans with Disabilities Act (ADA) provisions statement issued by the Commonwealth of Pennsylvania on October 14, 2011, applicable to all contractors entering into agreements with the state. The provisions establish compliance requirements under federal regulations 28 C.F.R. 35.101 et seq. and Title II of the ADA. Contractors must ensure that no individual with a disability is excluded from participation in the agreement or from activities provided under it. The contractor agrees to comply with the "General Prohibitions Against Discrimination" outlined in 28 C.F.R. 35.130 and all other applicable ADA regulations pertaining to benefits, services, programs, and activities delivered by the Commonwealth through external contractors.
The contractor is fully responsible for indemnifying and holding harmless the Commonwealth from all losses, damages, expenses, claims, demands, suits, and actions arising from the contractor's failure to comply with these ADA provisions. This requirement applies to all bidders, offerors, suppliers, and grantees seeking to furnish goods, supplies, services, construction, or other activities under purchase orders, contracts, or grants with Pennsylvania. The provision serves as a mandatory condition of contract acceptance and execution and reflects the Commonwealth's commitment to ensuring equal access and non-discrimination in all state-contracted services and programs.
