About this file
This is an open letter from the Department of the Air Force (DAF) dated 21 March 2025, addressing changes in federal contracting regulations. The letter communicates two key Class Deviations issued by the Office of the Undersecretary of Defense for Acquisition & Sustainment: one focused on restoring merit-based opportunity in federal contracts and another revoking an Executive Order on sustainability.
As a result of these deviations, Contracting Officers are instructed to amend open solicitations and modify contract awards by removing provisions and clauses that are no longer enforceable. The guidance specifies that unnecessary contract modifications should be minimized, with no required changes for contracts nearing the end of their performance period (less than 6 months remaining). The unenforceable provisions became invalid on March 4 and March 7, 2025, respectively. Contractors are advised to contact their Contracting Officer for specific questions about solicitations or contracts.

DEPARTMENT OF THE AIR FORCE
WASHINGTON DC
OFFICE OF THE ASSISTANT SECRETARY
21 March 2025
OPEN LETTER TO THE DEPARTMENT OF THE AIR FORCE (DAF) CONTRACTORS
FROM: SAF/AQC
1060 Air Force Pentagon Washington DC 20330-1060
SUBJECT: Restoring Merit-Based Opportunity in Federal Contracts and Revocation of
Executive Order on Sustainability
The Office of the Undersecretary of Defense for Acquisition & Sustainment’s Principal Director of Defense Pricing, Contracting, and Acquisition Policy issued Class Deviations 2025-O0003 (Attachment 1) and 2025-O0004 (Attachment 2), altering federal contracting regulations on merit-based opportunity in federal contracts and revoking an Executive Order on sustainability.
As a result of these Class Deviations, Contracting Officers will be amending open solicitations and modifying contract awards to remove solicitation provisions and contract clauses that are no longer enforceable. To avoid unnecessary costs, DAF Contracting Officers will modify existing contracts when the next modification is required. Contracting Officers are not required to modify contract actions nearing the end of the period of performance (i.e., less than 6 months remaining) and without options to extend. Please note that Class Deviation requirements for provisions and clauses in paragraph (1) of Attachment 1 have been unenforceable since March 4, 2025, and those in paragraph (1) of Attachment 2 have been unenforceable since March 7, 2025.
Thank you for your support to the DAF mission. Your partnership is appreciated during this process. For questions regarding a specific solicitation/contract, please reach out to your Contracting Officer.
ALICE W. TREVIÑO, Maj Gen, USAF Deputy Assistant Secretary (Contracting)
Assistant Secretary of the Air Force (Acquisition, Technology & Logistics)
