About this file

This is a Memorandum to the File documenting a determination that only one source is reasonably available for a FAR Part 12 simplified acquisition threshold acquisition under the Department of Navy, United States Marine Corps, I&L HCA.

The requirement is for a commercial, firm-fixed-price purchase of commercial-off-the-shelf (COTS) Secure Video Teleconferencing (SVTC) equipment and support services to upgrade the 2d Network Battalion's command and control capabilities. The competition is restricted to brand-name components from Crestron, Extreme Networks, FS, Cisco, Vaddio, Market Central, Biamp, and Shure. The justification for brand-name restriction centers on three primary factors: (1) Cost-Prohibitive "Rip-and-Replace"—the Government already owns functional hardware built around these specific manufacturers, and procuring non-brand equivalents would require complete infrastructure replacement at significantly higher costs in replacement hardware, custom middleware, and labor; (2) Proprietary Interoperability—the existing system's control programming, user interfaces, cryptographic network integration, and DSP audio configuration are intrinsically tied to these manufacturers, and introducing non-specified brands would break native integration and render the system non-functional; and (3) Warranty & Security—use of non-approved core network switches would void existing manufacturer warranties and disrupt established cybersecurity/admin protocols, exposing the Government to unnecessary financial and operational risk. The determination was certified on 14 August 2026 by Capt Miranda, Alexis (Technical/Requirements Certification) and SSgt Bovee, David R. (Contracting Officer Certification). Distribution is limited to DoW Community Only with DL ONLY (Download Only) dissemination control.

Determination that Only One Source is Reasonably Available FAR Part 12 Acquisitions under the SAT

MEMORANDUM TO THE FILE

Subj: DETERMINATION THAT ONLY ONE SOURCE IS REASONABLY

AVAILABLE FOR A FAR PART 12 ACQUISITION UNDER THE SIMPLIFIED

ACQUISITION THRESHOLD

I. BACKGROUND:

1. FAR Part 12 directs contracting activities to use procedures that are, to the maximum extent practicable, consistent with commercial purchase.

2. As required by FAR 12.102(a), this document serves as the basis for the determination determination explains the absence of competition for this acquisition, which is not expected to exceed the simplified acquisition threshold.

II. DESCRIPTION OF ITEM OR SERVICE:

This requirement is for a commercial, firm-fixed-price purchase of commercial-off-the-shelf (COTS) Secure Video Teleconferencing (SVTC) equipment and support services to upgrade the 2d Network Battalion's command and control capabilities. To prevent duplicative integration costs and ensure operational continuity, competition is restricted to brand-name components from Crestron, Extreme Networks, FS, Cisco, Vaddio, Market Central, Biamp, and Shure. These specific brands are required to natively integrate with the Government's existing SVTC architecture, preserving current cybersecurity accreditations and manufacturer warranties without requiring a costly infrastructure overhaul.

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN

COMPETITION IS BASED ON THE FOLLOWING (select all that apply):

A. __ ONLY ONE RESPONSIBLE SOURCE (select all that apply):

1. ___ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.

2. __ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

3. ___ OTHER REASONS.

B. _X_ BRAND NAME

Item required must be a brand name, product, or feature of a product, particular to one manufacturer.

The Government currently operates a highly customized SVTC architecture built upon a proprietary framework. To ensure interoperability and maintain the operational readiness of this critical command and control system, the core processing and network components must be 100% compatible with the existing infrastructure "out-of-the-box."

Due to the proprietary nature of the existing infrastructure, this requirement is restricted to Crestron, Extreme Networks, FS, Cisco, Vaddio, Market Central, Biamp, and Shure major end items. These are essential to avoid the prohibitive costs of a "rip-and-replace" scenario, based on the following reasons:

1. Cost-Prohibitive "Rip-and-Replace": The Government already owns and operates a substantial amount of functional hardware built around these specific manufacturers.

Procuring an "equivalent" non-brand system would require the Government to completely "rip and replace" the entire existing SVTC infrastructure just to make the new hardware compatible. It would cost the Government significantly more money in replacement hardware, custom middleware, and labor to install an "equivalent" system than it will to simply upgrade the existing brand-name components.

2. Proprietary Interoperability: The existing system's control programming, user interfaces, cryptographic network integration, and DSP audio configuration are intrinsically tied to these specific manufacturers. For example, Cisco provides the proprietary SVTC codecs, while Crestron houses the proprietary source code for audiovisual control. Introducing "equivalent" non-specified brands would break native integration, rendering the system non-functional without a total system replacement.

3. Warranty & Security: The use of non-approved core network switches (Extreme on currently installed equipment and disrupt established cybersecurity/admin protocols, exposing the Government to unnecessary financial and operational risk.

C. ___URGENT AND COMPELLING. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:

1. Date on which the requirement was first identified:

2. Required delivery date/period of performance:

3. Explanation of why delivery/commencement of services by the date mentioned above is required:

4. If appropriate, include any additional pertinent information.
