About this file
This is Addendum No. 5 to a Centralized Request for Quote (CRFQ) issued by the West Virginia Department of Administration Purchasing Division on behalf of the West Virginia Conservation Agency for the Brush Creek Site 15 Dam Rehabilitation-Construction project in Mercer County, West Virginia. The solicitation seeks comprehensive construction services to rehabilitate the Brush Creek Site 15 Dam, including excavation (approximately 40,000 cubic yards combined), earthfill placement (34,190 cubic yards), roller-compacted concrete construction (4,430 cubic yards), reinforced concrete work for multiple structures, rock riprap installation (approximately 15,210 cubic yards combined), geotextile placement, principal spillway pipe extension (27.3 linear feet), pond drain gate removal and replacement, and various appurtenant works. The pre-bid meeting occurred on November 12, 2025, with vendor questions due by December 1, 2025. Bid opening is scheduled for January 14, 2026, at 1:30 PM EST/EDT. This addendum comprises the fifth modification to the solicitation and includes vendor question responses, revised pricing exhibits, updated construction specifications for excavation, rock riprap, and geotextile work, revised drawings for toe drain details, a structural conditions report, and National Flood Hazard information.
The solicitation requires vendors to submit bids on a lump-sum basis for the total cost of all Site 15 construction activities as indicated on the pricing page. Addendum No. 5 addresses 30 vendor questions regarding project scope, sediment management, gate replacement procedures, road repair responsibilities, material specifications, construction sequencing constraints, and payment mechanics. Key clarifications include confirmation that sediment relocation costs are incorporated into existing bid items rather than as separate line items, revision of the principal spillway pipe extension quantity to 27.3 feet, inclusion of ASW outlet riprap in Bid Item 30, and removal of an unnecessary stainless steel baffle from drainage details. The project is funded through the Natural Resources Conservation Service (NRCS) and includes federal funding addendum requirements addressing minority business enterprise and women business enterprise solicitation efforts, though documentation and specific participation minimums are not required. Contractors must possess a valid West Virginia contractor's license and submit subcontractor lists within one business day of bid opening if applicable. The downstream embankment work must be completed within a single calendar year per dam safety criteria, with construction sequencing requiring coordination between multiple project phases and potential winter shutdowns.

a. Answer: WV Conservation Agency is unaware of any process that adds vendors as “Plan Holders”.
b. Answer: WV Conservation Agency is unaware of “Construct Connect”. All drawings and specifications can be found on the Vendor Self Service (VSS) portal under solicitation CRFQ AGR2600000016.
*Questions 4-8 are in reference to the following statement.
The solicitation includes a section in the Federal Funds Addendum regarding MBE/WBE solicitation and appears to require “Good Faith Efforts”.
4. Question: Is the contractor required to document and submit these efforts with the bid submittal?
Answer: No
5. Question: Is the contractor required to document utilization throughout the duration of the contract?
Answer: No
6. Question: Are there specific forms for documentation if required?
Answer: No
7. Question: Are there specific MBE/WBE databases that are required to be used to identify such firms (i.e. WVDOT, WV SWAM rpt, etc.)?
Answer: No
8. Question: Are there any minimum participation limits?
Answer: No
9. Question: Could the question date to this project be extended?
Answer: Question date had been extended to December 01, 2025. .
10. Question: Based on our review of the contract documents we have several concerns related to the upstream scope of work. See below:
a. In an effort to get the domestic cast iron sluice gate ordered in time to be installed during specified drawdown schedule, we believe the preliminary investigation (field verification of existing conditions) will need to be performed by divers as early as possible. In order to complete this task, an unknown volume of sediment will need to be dredged but the specifications do not address dredging. Considering this operation would need to take place while the PSD would be actively drawing raw water, we expect there would be some restrictions/limitations to completing dredging work as ask that this be clarified.
i. Note: Hydro-Gate sales rep has indicated a lead time of approximately 36 weeks (for domestic cast iron gate) from release to start shop dwgs which would most likely push this work into the second construction season.
Answer:
The intent is for the gate investigation to be performed at the beginning of the project due to the expected lead times for the gate procurement. CS-71 states to sidecast sediment away from the riser and that an estimated 6-9 feet of sediment is present within the vicinity of the riser. Sediment may not be removed from the reservoir, so the Contractor will not be required to obtain a permit for sediment removal for the initial investigation, or for the upstream stability berm work. Also stated in CS 71, the Contractor shall submit a Pond Drain Gate Removal Plan that includes a narrative of removal of sediment around the riser. Payment for work associated with initial sediment removal shall be paid for under Bid Item 35 - Removal of Pond Drain Gate
b. The condition and volume of sediment to be removed to complete upstream improvements is essentially unknown and may require significant effort to relocate this material within the reservoir footprint inside the delineated LOD. The description for Bid Item 35 in specification 71, section 8.C.1.a - notes “side casting” of sediment. As noted, depending on the condition of this material additional controls may be required to manage/relocate the sediment making it possible to construct the upstream riprap berm and replace the gate. We request the addition of a bid line item to capture and pay for this activity as well as establishing a volume for basis of bid. We also request further clarifications related to management of this material within the reservoir footprint as it could potentially have an impact on operations of the dam facility.
Answer
Payment for initial removal of sediment to verify the gate measurements will be paid for in line item 35 - Removal of Pond Drain Gate. Payment for sediment to be relocated for the installation of the upstream stability berm will be paid for in line item 31 – Embankment Upstream Stability Berm. The LOD shown should provide sufficient area for the relocation of sediment within the reservoir. Approximate sediment elevations and removal limits are shown on drawings 15-C-31 and 15-S-11.
c. Additionally, per paragraph 8.C.3.a - if the contractor has to remove sediment to perform the gate removal work, the contractor is required to obtain necessary permits from responsible authorities. This too could have a substantial impact on the timeline of getting the sluice gate ordered in time for installation window.
Answer:
See responses to previous items.
11. Question: Bid Item 8 section 4.A.9 requires the contractor to repair public roads in the vicinity of the project site. Can project vicinity be further clarified? Can a paving section of existing roads adjacent to the site be provided to help evaluate stability and repair costs.
Answer:
Per correspondences with WVDOH, Dale Hale Reservoir Road (20/12) and Gobbler Run Road ((20/13) are both “local service routes with a 65,000 lb legal weight limit. Both are open to legal 65,000 lb standard legal traffic”. Additionally, WVDOH stated that in regard to the two bridges on these routes, “There are no restrictions on those two structures”. If oversized/overweight loads are needed, a permit is required, see https://transportation.wv.gov/highways/maintenance/hauling_permits/Pages/defa ult.aspx.
CS8, 4., A., 9) - Demobilization shall also include the repair of any damage to paved public roads within the project vicinity in accordance with West Virginia Department of Transportation standards and used for heavy equipment access and material deliveries that exceeds the weight limits for those roads. Damaged areas shall be repaired to pre-work condition or better to the satisfaction of the COR. No separate payment will be made for these restoration activities.

12. Question: Section 7 RCC Mix Plant of RCC specification 36 indicates the plant must be a pugmill. Please clarify if volumetric mixing trucks set up in a stationary, continuous mixing plant configuration would be considered acceptable.
Answer:
All mixing plants need to meet the requirements of Section 7 or as supplemented by Section 22, A. 6).
13. Question: The RFP documents appear to conflict with regard to the contractor license requirement. General Terms and Conditions item 7 notes the request for proof may be prior to or after contract award. Additional Terms and Conditions item 1 notes successful Vendor must furnish a copy of its contractor license prior to issuance of contract award. Exhibit A Pricing Page requests vendor to include a copy of contractor license with the bid response. Please confirm if the vendor is required have a contractor license in place at time of bid and a copy included with the bid submission.
Answer: Vendors should submit a copy of contractor’s license with bid response but are not required to do so. Vendors must provide Contractor’s License upon request prior to contract award.
14. Question: Subcontractor List – Additional Terms and Conditions of the RFP itiem 10 notes:
this section does not apply to any other construction projects, such as highway, mine reclamation, water or sewer projects. It also indicates that the apparent low bidder shall submit the Subcontractor list within one business day of bid opening. Please confirm if the Subcontractor list is required for this project and if it has to be submitted with the bid submission.
Answer: Any vendor using subcontractors must submit list to the WV Purchasing Division within one business day of bid opening.
15. Question: Downstream Embankment work – the Construction Contract Sequencing document includes Dam Safety criteria requiring the downstream embankment scope be completed within the same calendar year. The construction sequence notes on the E&S drawings appear to indicate this scope starting in one construction season (Phase 1A), prepare for winter shutdown by protecting exposed soils (Phase 2), and resuming in the spring (Phase 2). Please clarify construction restrictions related to downstream embankment scope.
Answer:
The Construction sequencing criteria is required for development of the construction schedule. The E&S implementation sequence shall be modified to accommodate the sequencing criteria and approved construction schedule. All downstream embankment work shall be completed with the same calendar year.
16. Question: Site 14 fill stockpile – the Construction Contract Sequencing document considerations note that the Site 15 contractor shall stockpile 9,220 CY of Earthfill materials for future use by Site 14 contractor. Is the Site 15 contractor required to balance the earthfill for both Site 14 and Site 15, if other words – what happens if there is not sufficient suitable earthfill to provide a 9,220 CY stockpile for Site 14? Please clarify. Additionally, is the Site 15 contractor required to conduct QC testing confirming suitability of stockpiled materials for future use?
Answer:
The Site 15 Contractor will be required to construct the downstream berm on the embankment to the required minimum elevations, and stockpile/stabilize excess suitable material available for the Site 14 Contractor. If there is not sufficient on-site suitable material to provide 9,220 CY for the Site 14 Contractor, the Site 15 Contractor will not be responsible for providing additional materials from off-site sources. The Site 15 Contractor will be responsible for initially testing the material prior to stockpiling to confirm it is suitable for use and confirming the amount of material stockpiled prior to closeout of the project.
17. Question: Please confirm if the Contractor’s Quality Control Supervisor (as defined in specification 94) can be assigned other duties and if they are required to be on-site fulltime.
Answer:
The Quality Control Supervisor could be assigned other duties, however the supervisor must be separate and apart from line supervision per CS94.
18. Question: Please confirm there are no stockpile location restrictions within the LOD.
Answer:
Stockpiles can be located within the identified limits of disturbance. The contractor should identify the proposed locations on their Staging and Stockpiling Plan per CS8.
19. Question: Specification 26, Section 7.A.2 references Method 1 shall apply. Method 1 states unsuitable materials encountered shall be disposed of onsite or hauled and disposed of offsite. Please confirm unsuitable soil and excess topsoil will remain onsite and not require disposal offsite.
Answer:
It is anticipated the unsuitable soil materials, and excess topsoil will be disposed of on-site.
20. Question: Please confirm if the 100yr floodplain encroaches the LOD? If so, please provide the locations.
Answer:
The FEMA Zone A flood hazard area is illustrated on the attached National Flood Hazard FIRMette (FIRMETTE_BC15). The Site 14 reservoir, 100-year, 24-hour flood pool, at elevation is 2432.6, is located north of Gobbler Run Road, which is outside the Site 15 LOD area.
21. Question: If encountered, please confirm how the contractor will be compensated for rock excavation?
Answer:
The specification defines common excavation as the excavation of materials that can be excavated, transported, and unloaded using heavy ripping equipment and pusher tractor (having a power rating of at least 150 flywheel horsepower). The intent is to remove material meeting that definition for excavations shown on the drawings. Any rock excavation, if encountered, would be measured and paid for under bid item 10 - Embankment, Common Excavation, and bid item 11 – Auxiliary Spillway, Common Excavation respectively. The most likely places where rock may be encountered include but is not limited to trenching in cutoffs for structures such as the impact basin and tailwater weir wall. A revised Construction Specification 21, Excavation is attached.
22. Question: Multiple concrete structures (Impact basin & RCC Structural Concrete) are proposed to be excavated to rock and foundation set on top of rock. However, these structures also call for concrete turndowns below bedrock. Where will the contractor be compensated for rock excavation in these areas?
Answer:
See previous response.
23. Question: Can the existing office building be utilized for the QA/QC laboratory? This will be a potential savings for the owner.
Answer:
The existing building does not have enough space to meet the specifications to be properly utilized as the QA/QC laboratory.
24. Question: Sediment relocation required for the construction of the Embankment Upstream Stability Berm is described in the requirements of Upstream Stability Berm Installation Plan, however sediment relocation is not listed as a separate bid item.
Under which bid item will sediment relocation be paid?
Answer:

CONSTRUCTION SPECIFICATION 21—EXCAVATION
Scope The work shall consist of the excavation required by the drawings and specifications and disposal of the excavated materials.
Classification Excavation is classified as common excavation, rock excavation, or unclassified excavation in accordance with the following definitions.
Common excavation is defined as the excavation of all materials that can be excavated, transported, and unloaded using heavy ripping equipment and wheel tractor-scrapers with pusher tractors or that can be excavated and dumped into place or loaded onto hauling equipment by excavators having a rated capacity of one cubic yard or larger and equipped with attachments (shovel, bucket, backhoe, dragline, or clam shell) appropriate to the material type, character, and nature of the materials.
Rock excavation is defined as the excavation of all hard, compacted, or cemented materials that require blasting or the use of ripping and excavating equipment larger than defined for common excavation. The excavation and removal of isolated boulders or rock fragments larger than 1 cubic yard encountered in materials otherwise conforming to the definition of common excavation shall be classified as rock excavation. The presence of isolated boulders or rock fragments larger than 1 cubic yard is not in itself sufficient cause to change the classification of the surrounding material.
For the purpose of these classifications, the following definitions shall apply:
Heavy ripping equipment is a rear-mounted, heavy duty, single-tooth, ripping attachment mounted on a track type tractor having a power rating of at least 250 flywheel horsepower unless otherwise specified in Section 10.
Wheel tractor-scraper is a self-loading (not elevating) and unloading scraper having a struck bowl capacity of at least 12 cubic yards.
Pusher tractor is a track type tractor having a power rating of at least 250 flywheel horsepower equipped with appropriate attachments.
Unclassified excavation is defined as the excavation of all materials encountered, including rock materials, regardless of their nature or the manner in which they are removed.
Blasting The transportation, handling, storage, and use of dynamite and other explosives shall be directed and supervised by a person(s) of proven experience and ability who is authorized and qualified to conduct blasting operations.
Blasting shall be done in a manner as to prevent damage to the work or unnecessary fracturing of the underlying rock materials and shall conform to any special requirements in Section 10 of this specification. When specified in Section 10, the Contractor shall furnish the Engineer, in writing, a blasting plan before blasting operations begin.
REVISED BC 15 CS Excavation - 12/30/25
(210-VI-NEH, May 2001) 21-2
Use of excavated material Method 1—To the extent they are needed, all suitable material from the specified excavations shall be used in the construction of required permanent earthfill or rockfill. The suitability of material for specific purposes is determined by the Engineer. The Contractor shall not waste or otherwise dispose of suitable excavated material.
Method 2—Suitable material from the specified excavations may be used in the construction of required earthfill or rockfill. The suitability of material for specific purposes is determined by the engineer.
Disposal of waste materials Method 1—All surplus or unsuitable excavated materials are designated as waste and shall be disposed of at the locations shown on the drawings.
Method 2—All surplus or unsuitable excavated materials are designated as waste and shall be disposed of by the Contractor at sites of his own choosing away from the site of the work. The disposal shall be in an environmentally acceptable manner that does not violate local rules and regulations.
Excavation limits Excavations shall comply with OSHA Construction Industry Standards (29CFR Part 1926) Subpart P, Excavations, Trenching, and Shoring. All excavations shall be completed and maintained in a safe and stable condition throughout the total construction phase. Structure and trench excavations shall be completed to the specified elevations and to the length and width required to safely install, adjust, and remove any forms, bracing, or supports necessary for the installation of the work. Excavations outside the lines and limits shown on the drawings or specified herein required to meet safety requirements shall be the responsibility of the Contractor in constructing and maintaining a safe and stable excavation.
Borrow excavation When the quantities of suitable material obtained from specified excavations are insufficient to construct the specified earthfills and earth backfills, additional material shall be obtained from the designated borrow areas. The extent and depth of borrow pits within the limits of the designated borrow areas shall be as specified in Section 10 or as approved by the Engineer.

CONSTRUCTION SPECIFICATION 61—ROCK RIPRAP
Scope The work consists of the construction of rock riprap revetments and blankets, including filter or bedding where specified.
Material Rock riprap must conform to the requirements of Material Specification 523, Rock for Riprap, or if so specified, must be obtained from designated sources. It must be free from dirt, clay, sand, rock fines, and other material not meeting the required gradation limits.
At least 30 days before rock is delivered from other than designated sources, the Contractor must designate in writing the source from which rock material will be obtained and provide information satisfactory to the Contracting Officer that the material meets contract requirements. The Contractor must provide the responsible Engineer free access to the source for the purpose of obtaining samples for testing. The size and grading of the rock must be as specified in Section 8.
Rock from approved sources must be excavated, selected, and processed to meet the specified quality and grading requirements at the time the rock is installed.
Based on a specific gravity of 2.65 (typical of limestone and dolomite) and assuming the individual rock is shaped midway between a sphere and a cube, typical size/weight relationships are:
Sieve size of rock
Approx. weight of rock
Weight of test pile
16 inches 300 pounds 6,000 pounds
11 inches 100 pounds 2,000 pounds
6 inches 15 pounds 300 pounds
When specified in Section 8 or when it is necessary to verify the gradation of the rock riprap, a particle size analysis must be performed in accordance with ASTM D5519, Test Method A or B.
The analysis must be performed at the work site on a test pile of representative rock. The mass of the test pile must be at least 20 times the mass of the largest rock in the pile. The results of the test are compared to the gradation required for the project. Test pile results that do not meet the construction specifications must be cause for the rock to be rejected. The test pile that meets contract requirements must be left on the job site as a sample for visual comparison. The test pile must be used as part of the last rock riprap to be placed.
Filter or bedding aggregates when required must conform to Material Specification 521, Aggregates for Drainfill and Filters, unless otherwise specified. Geotextiles must conform to Material Specification 592, Geotextile.
Subgrade preparation The subgrade surface on which the rock riprap, filter, bedding, or geotextile is to be placed must be cut or filled and graded to the lines and grades shown on the…
