About this file
Summary
This is a Contracting Officer's Decision Document justifying a single-source procurement under Federal Acquisition Regulation (FAR) 12.102(a) for lube oil delivery services to two U.S. Army Corps of Engineers dredge vessels. The U.S. Army Corps of Engineers, Portland District, is procuring firm-fixed-price supply deliveries of specialized diesel engine oils from March 31, 2026, through March 19, 2027. The Dredge Essayons requires approximately 900 to 2,000 gallons per delivery of MobilGard HST+ 15w-40 Extra High Performance Diesel Engine Oil for Caterpillar C-280, 3512C, and C18 engines, while the Dredge Yaquina requires approximately 300 to 400 gallons per delivery of Chevron CV DELO 400 XLE SB15W40 Diesel Engine Oil. Deliveries will be made to multiple locations including Port of Portland, Longview, Astoria, Coos Bay, Newport, NOAA Dock, and Morro Bay.
The justification for single-source procurement is twofold: the specific brand-name oils are essential to prevent premature equipment wear, component failures, and sludge buildup that would compromise engine reliability and operational safety; and, critically, any vendor must hold United States Coast Guard (USCG) certification to transfer oil over water in compliance with Title 33 Code of Federal Regulations Sections 154.325(d), 154, and 156 for operations in the Sector Columbia River Captain of the Port Zone. The document notes that while multiple vendors can supply these oil products, the USCG certification requirement effectively restricts competition. The procurement history spans from October 2018 through April 2025, with the most recent award (W9127N-25-C-A016) made on April 11, 2025. Fair and reasonable pricing will be determined based on comparison to an Independent Government Estimate, market research, and pricing from previously awarded orders for the same or similar items.

1. REQUIRING AND CONTRACTING ACTIVITY:
U.S. Army Corp of Engineer, Portland District, 333 SW 1st Ave, Portland, OR 97204
2. DESCRIPTION OF ACTION:
This will be a firm-fixed-price supply procurement of lube oil deliveries upon request for a specific quantity, type, location, and date to the Dredge Essayons and Dredge Yaquina.
The Period of Performance (PoP) of lube oil deliveries is approximately 31 March 2026 -19 March 2027.
Typical volume of request per delivery ~ 900 to 2,000 gallons to the ESSAYONS, and ~ 300-400 gallons to the YAQUINA, located at one of the following locations: Terminal 2, Port of Portland, OR; Longview, WA; Astoria, OR; Coos Bay, OR; Newport, OR; NOAA Dock, OR, and Morro Bay, CA. A USCG over the water oil transfer certificate is required.
3. AUTHORITY CITED: RFO 12.102(a) - For acquisitions valued at or below the simplified acquisition threshold (SAT), document the decision that only one source is available and the basis for the decision.
4. REASON FOR AUTHORITY CITED:
a. Background: This annual request for the Dredge Vessels Essayons and Yaquina, with a total of ~900-2,000 gallons per delivery of MobilGard HST+ 15w-40 Extra High Perf
JUNE 2025
Diesel Engine Oil, used on Caterpillar C-280, 3512C, and C18 engines to maintain efficient operational use for ESSAYONS and ~ 300-400 gallons of Chevron CV DELO 400 XLE SB15W40 Diesel Engine Oil to the YAQUINA. The Vessels will provide seven
(7) days advance notice of docking date and location for deliveries.
b. Justification: Other brand name oils would diminish the reliability of the equipment consistent with premature wear, component failures, and sludge buildup, therefore the use of Chevron CV DELO 400 XLE SB15W40 Diesel Engine Oil for the Yaquina and MobilGard HST+ 15w-40 Extra High Perf Diesel Engine Oil for the Essayons, is advantageous in maintaining the useful life of the engines. Because the diesel oil will be transported across water, interested vendors must be certified by the United States Coast Guard (USCG) to transfer oil over water.
c. Impact: the use of other oils consistent with premature wear, component failures, and sludge buildup, ultimately diminishing the reliability of the equipment. It is imperative to maintain the effectiveness of the identified engines, otherwise engine failure, facility damage and/or loss, and/or human loss or injury is imminent.
d. Alternatives: There are no known alternatives for these brand name products at this time.
5. EFFORTS TO OBTAIN COMPETITION:
There are several vendors that can provide Chevron CV DELO 400 XLE SB15W40 Diesel Engine Oil and MobilGard HST+ 15w-40 Extra High Perf Diesel Engine Oil, but the option to receive this product from a vendor without the USCG certification is in violation of Title 33 Code of Federal Regulations (CFR) Section 154.325(d) and meets all applicable requirements for a mobile transfer facility outlined in 33 CFR Parts 154 and 156 for operations in the Sector Columbia River Captain of the Port Zone.
6. MARKET RESEARCH:
These services have previously been procured under the purchase orders noted below under section 8.
