52.212-2 Evaluation-Commercial Products and Commercial Services. (Deviation) FEB 2026
(a) The Government will utilize the Lowest Price Technically Acceptable (LPTA) source selection process as defined in FAR 15.101-2. Award will be made to the lowest-priced, responsible offeror whose proposal conforms to the solicitation requirements (including all stated terms, conditions, representations, and certifications) and is deemed Technically Acceptable and provides an Acceptable/ Neutral Confidence rating for Past Performance.
A proposal that does not meet the minimum standards for any factor will be deemed "Unacceptable" and will not be considered for award, regardless of price.
Noncompliance with the solicitation requirements will raise serious concern regarding an offeror’s technical ability to fulfill this requirement and may be grounds to eliminate the quote from further consideration for contract award. Evaluation will be conducted as follows:
Factor 1 - Technical Capability
Element 1: Offerors must submit a max of sufficient narrative demonstrating their ability to successfully execute the Performance Work Statement. This document should clearly outline their understanding of the requirements, proposed execution strategies, and operational readiness.
Element 2: Technical Check sheet: Vendors must complete Attachment 8 Technical acceptability will be defined as follows:
The Government will evaluate the offeror's technical capability Factor Submission to determine if it demonstrates a clear understanding of the requirements outlined in the Performance Work Statement (PWS) and submission requirements in 52.212-1 above based on the following rating definitions.
Table 1 – Technical Capability Ratings Rating Definition
Acceptable Proposal clearly meets the minimum requirements of the solicitation Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
Factor 1 will be evaluated first. Offerors who fail to possess an acceptable technical narrative will not be considered for award and Factor 2 of their submission will not be evaluated.
Factor 2 – Past Performance
The Government will evaluate past performance to assess the probability of the offeror successfully accomplishing the requirements based on their record of past performance. Past performance will first be evaluated for recency based on the definition in table 2 below. Recent past performance will then be evaluated for relevance based on the definitions in Table 3 below. Offerors will then be given an overall Confidence Assessment Rating of acceptable, unacceptable, or neutral based on the recency and relevancy of their past performance submission. To receive an overall confidence rating of Acceptable, offerors must be determined acceptable for both recency and relevance.
Table 2 – Past Performance Recency Ratings
Acceptable Performance was within the last three (3) calendar years.
Unacceptable Performance was not within the last three (3) calendar years.
Table 3 – Past Performance Relevance Ratings
Acceptable Performance is similar in scope, complexity, and magnitude (dollar value, volume) to the requirements of the PWS.
Unacceptable Performance is not similar in scope, complexity, and magnitude (dollar value, volume) to the requirements of the PWS.
Table 4 – Overall Past Performance Rating
Acceptable Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Unacceptable Based on the offeror's performance record, the Government has no reasonable expectation that the offeror will successfully perform the required effort.
Neutral In the case of an offeror without a record of recent/relevant past performance, the offeror will not be evaluated favorably or unfavorably and will receive a "Neutral" rating.
An offeror without a record of recent/relevant past performance will not be evaluated favorably or unfavorably, and will receive a "Neutral Confidence" rating, which will be deemed acceptable.
Factor 3 - Price
The Government will evaluate the quoted prices to determine if they are fair and reasonable. The price quote shall include a unit price for each item and a total firm-fixed-price for all line items. The evaluated price will be determined by adding the sum of the extended pricing for all CLINs.
Each Vendor’s price quote must be based on the Government’s specifications and other contractual requirements. If the prices to be used are based on a published price list or catalog, the Vendor shall so state and provide a copy of the document with its price quote. If the prices are to be based on established market prices, not otherwise published, or are prices applicable only to the proposed contract, the Vendor shall so state.
The Government intends to award without discussions; however, the Government may conduct discussions if determined necessary. Each quoter should recognize that its initial price and non-price quote may be used as the sole and final basis for award and should quote accordingly.
Evaluations will be based solely on the materials included in the quotes. Therefore, the Vendor’s initial quote should contain their best terms. After receipt of quotes, the Government will conduct an evaluation. However, during the evaluation process, the Government may, solely at its discretion, communicate with quoters regarding clarification of quote elements. At any time prior to selection, including upon receipt of quotes, the Government may exclude a quote from further consideration for any material failure to follow instructions or including the omission of required information.
(b) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful vendor within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
