About this file

This is a fines and penalties chart approved by the Board of Aldermen (BOA) for the City of New Haven, Connecticut for fiscal year 2024-2025, establishing enforcement mechanisms for construction contract compliance violations under the Commission on Equal Opportunities. The chart details penalties applicable to contractors and subcontractors working on city construction projects, including violations related to pre-award conference attendance, certified and living wage payroll reporting, daily employee attendance and demographics reporting, and failure to meet minority, female, and resident participation goals. Penalties are assessed against responsible parties at all contractor tiers, from subcontractors through general contractors, with violations tracked cumulatively across site visits and project duration.

Penalty amounts range from $750 to $4,000 per violation, with certain violations calculated as percentages of the construction contract amount when that calculation exceeds the fixed penalty amount. For example, late payroll reports incur $1,000 per week or 1% of contract amount weekly, whichever is greater, while violations of maximum effort to reach participation goals incur $2,000 per week or 1% of contract amount weekly, also whichever is greater, potentially extending for the entire project work period. The chart applies to the Animal Shelter Renovation and Addition project in New Haven and establishes compliance expectations that all bidders and contractors must understand and meet throughout project execution.
