About this file

This is a Fines and Penalties Chart for the City of New Haven, Connecticut, related to the Fire Alarm Inspection and Services contract opportunity with the New Haven Public Schools (NHPS). The document establishes the oversight penalties, fines, and sanctions for compliance violations under the Commission on Equal Opportunities, adopted by Mayor Justin Elicker for Fiscal Year 2024-2025. The chart outlines financial penalties for various contractor violations including failure to conduct pre-award conferences, late submission of certified or living wage weekly payroll reports, missing or incorrectly filled daily employee reports, and inadequate efforts to meet minority participation, female participation, and resident participation goals. Penalties range from $750 to $4,000 per violation depending on the type of infraction and whether it is a recurring violation.

The penalty structure uses a tiered approach, with fines calculated either as fixed dollar amounts or as a percentage of the construction contract amount, whichever is greater. Penalties are assessed against subcontractors, general contractors, and all tiers of hiring contractors involved in the project. Notably, some violations incur escalating penalties; for example, payroll report violations assessed after eight weeks of delinquency increase to $1,000 per week or 1% of the construction contract amount per week. Violations related to workforce diversity goals (minority, female, and resident participation) are charged separately against both the subcontractor and all hiring contractors up to the general contractor level. This penalty framework ensures compliance with local labor standards, prevailing wage requirements, and diversity objectives for all construction-related contracts within the New Haven jurisdiction.
