About this file

This file is a Form 700 conflict of interest legal review correspondence between the Orange County Transportation Authority (OCTA) and its General Counsel regarding RFP 250198 for the OC ACCESS Paratransit Contract Assessment. The solicitation is for professional services from a qualified consultant to conduct a comprehensive assessment of the OC ACCESS paratransit services contract over a three-month term. No specific response dates, bidders conferences, or award dates are mentioned in the legal correspondence, though the related contract opportunity indicates a project budget of $53,556.

The General Counsel's determination, dated February 10, 2026, concludes that personnel performing duties under this RFP would not be required to file Form 700 conflict of interest disclosures under OCTA's Conflict of Interest Code. The legal opinion states that consultant personnel would not authorize or direct actions, votes, appointments, or commit OCTA to contractual agreements, nor would they provide information, opinions, or recommendations affecting decisions without significant intervening substantive review by OCTA personnel, counsel, and management. The contract is structured as a time and expense agreement, and this Form 700 review was conducted as part of internal audit compliance procedures required by the Contracts Administration and Materials Management (CAMM) division.

I have reviewed the SOW for RFP 25-0198 as to whether the personnel performing these duties would be required to file Form 700's under OCTA's Conflict of Interest Code. Based upon my review, it is the opinion of General Counsel that this RFP and the SOW would not require the filing of Form 700's. The consultant personnel anticipated by this RFP would not authorize or direct any actions, votes, appoint any person, obligate or commit OCTA to any course of action or enter into any contractual agreement on behalf of OCTA. Moreover, no personnel provided for by this RFP would provide information, an opinion or a recommendation for the purpose of affecting a decision without significant intervening substantive review by OCTA personnel, counsel and management.
